Recommendation of the Administrative Law Judge - Modify the 30 day suspension to a five day suspension.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-3 COLLEEN FOX
Colleen Fox, Head Nurse, Buttonwood Hospital, Burlington County, suspension for six days, on charges of incompetency, inefficiency or failure to perform duties, inability to perform duties, conduct unbecoming a public employee, neglect of duty and patient neglect.
Recommendation of the Administrative Law Judge - Modify the suspension to a written reprimand.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

James Meinhold, Police Officer, City of Wildwood Police Department, released at the end of working test period effective May 5, 1995, due to unsatisfactory services.

Robert Collins, Police Officer, Beach Haven Borough, removal effective March 4, 1997, on charges of conduct unbecoming a public employee and conducted unethical and illegal activities while on duty. Recommendation of the Administrative Law Judge - Uphold the removals.
ACTION: The Merit System Board directed that this matter be held over.
A motion was made and seconded that the open session be recessed and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Merit System Board entered into Executive Session for the purpose of legal advice on the matters of A-7 Shirley Harrison, A-11 Lamont Walker, and B- 18 John Esposito. The Board subsequently reconvened the public meeting.
A-7 SHIRLEY HARRISON
Shirley Harrison, Hospital Attendant, Buttonwood Hospital, Burlington County, removal effective April 6, 1999, on charges of incompetency, inefficiency or failure to perform duties, inability to perform duties, chronic or excessive absenteeism or lateness, conduct unbecoming a public employee and being charged with neglect by the Department of Health and Senior Services.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a suspension for the same period of time that the appellant's name was on the Nurse's Aide Abuse Registry.

Louis Sackina, Licensed Practical Nurse, Hunterdon Developmental Center, Department of Human Services, removal effective May 25, 1998, on charges of physical abuse of a patient.

John Hunt, Business Manager, Fire Department (District #1), Woodbridge Township, layoff effective May 20, 1996, for reasons of economy and efficiency. The Merit System Board at its meeting of February 8, 2000, directed that this matter be held over.

A-10 TELISSA DOWLING
Telissa Dowling, County Correction Officer, Department of Public Safety, Hudson County, removal effective June 14, 1994, on charges of conduct unbecoming a public employee, neglect of duty, insubordination and failure to perform duties. The Merit System Board at its meeting of November 9, 1999, directed that this matter be held over for a testimony summary.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-11 LAMONT WALKER
Lamont D. Walker, Supervising Building Maintenance Worker, Department of Buildings and Grounds, Burlington County, (1) suspension for ten days, beginning March 18, 1996 and demotion to the position of Building Maintenance Worker, effective March 11, 1996 and ending at the time the appellant produced a valid driver's license, and (2) removal effective August 5, 1996, on charges of (1) incompetency, inefficiency and failure to perform duties, conduct unbecoming a public employee, neglect of duty and misuse of a county vehicle (driving while on the suspended list) and (2) incompetency, inefficiency and failure to perform duties, chronic or excessive absenteeism and unexcused absences, conduct unbecoming a public employee and neglect of duty. The Merit System Board at its meeting January 11, 2000, directed that this matter be held over.
Recommendation of the Administrative Law Judge - Uphold the ten day suspension, demotion and removal.
ACTION: The Merit System Board remanded the matter to the Office of Administrative Law.
A-12 JOHN MODZELEWSKI - SETTLEMENT
Initial suspension for ten days, on charges of chronic and excessive absenteeism. Settled to a five day suspension. The Merit System Board at its meeting of February 1, 2000, directed that this matter be held over for receipt of a letter clarifying the terms of the settlement.
Recommendation of the Administrative Law Judge - Acknowledge the settlement.
ACTION: The Merit System Board acknowledged the settlement as clarified.

B-1 ROBERTO FUENTES
Roberto Fuentes, represented by Charles M. Grossman, Esq., appeals his rejection as a County Correction Officer candidate by the County of Union and its request to remove his name from the eligible list on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Merit System Board directed that this appeal be denied.

Jonathan Hendrix, who was formerly employed as a Therapy Program Assistant with the Woodbridge Developmental Center, Department of Human Services, represented by John G. Devlin, Esq., appeals the denial of sick leave injury (SLI) benefits.

Anna Roane, a Human Servies Assistant at Ancora Psychiatric hospital, Department of Human Services (DHS), represented by John M. Chomko, Esq., appeals the decision of DHS which found that the appellant failed to present sufficient evidence to support a finding of probable cause that she was a victim of sexual harassment.
ACTION: The Merit System Board directed that this appeal be denied.
B-5 KEVIN SCHAFFER
Kevin Schaffer appeals the decision of Human Resource Information Services which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Juvenile Detention Officer (C01070), Camden County eligible list for failure to appear for a scheduled interview.
ACTION: The Merit System Board directed that this appeal be denied.

George H. Snowden, III, appeals the decision of Human Resource Information Systems which found that the appointing authority had presented a sufficient basis to remove his name from the Correction Officer Recruit (S9999V) eligible list on the basis of an unsatisfactory driving record.

Julio Vega, represented by Charles M. Grossman, Esq., appeals the decision of Human Resource Information Systems which upheld the removal of his name from the eligible list for Police Officer (M3394X), City of Newark, due to his failure to satisfy the City's residency requirement and due to falsification of his pre-employment application.
ACTION: The Merit System Board granted a hearing.
B-8 JEFFREY WESTPHAL
Gloucester Township, represented by Louis Rosner, Esq., appeal the decision of Human Resource Information Systems which found that it had not presented a sufficient basis to remove Jeffrey Westphal's name from the eligible list for Police Officer (S9999V), Gloucester Township, due to falsification of his preemployment application.
ACTION: The Merit System Board granted the appeal and directed that Jeffrey Westphal's name be removed from the subject eligible list.

Gary J. Coghlan appeals the decision of the Selection Services Unit which found that he had not been improperly bypassed by the City of Perth Amboy on the eligible list for Police Captain (PM4013R).

Henrietta Brown, a Cottage Training Technician at the Vineland Developmental Center, Department of Human Services, represented by Robert C. Little, IV, AFSCME Administrative Council 1, petitions the Merit System Board to reconsider its final decision dismissing her appeal without prejudice based on her failure to appear at a scheduled settlement conference.
ACTION: The Merit System Board granted the request for reconsideration and directed that the matter be transmitted to the Office of Administrative Law.
B-12 ELSIE BLAKESLEE
Elsie Blakeslee, a principal Data Entry Machine Operator, Division of Parole and Community Programs, Department of Corrections, requests reconsideration of the final administrative decision, rendered July 7, 1999, which denied her appeal of a reassignment.
ACTION: The Merit System Board denied the request for reconsideration.
B-13 EDWARD G. VETRECIN, JR.
Edward G. Vetrecin, Jr., a Clinic Nurse with the Mounmouth County Jail, represented by Richard C. Leahey, Jr., Esq., petitions the Merit System Board to reconsider its final decision dismissing his appeal without prejudice based on his failure to pursue.
ACTION: The Merit System Board granted the request for reconsideration and directed that the matter be transmitted to the Office of Administrative Law.
B-14 MARCUS LAQUER
Marcus LaQuer, represented by Tanya E. Lawrence, Esq., petitions the Merit System Board to reopen the matter of his appeal of the good faith of his layoff, effective November 15, 1996, from his position of Principal Engineer with the Department of Public Works/Urban Development, City of Plainfield.
ACTION: The Merit System Board denied the request to reopen the matter.
B-15 THEODORE RICCI
Theodore Ricci, Park Police Sergeant, Police Department, County of Middlesex, represented by Lawrence Y. Bitterman, Esq., seeks enforcement of that part of the Merit System Board decision rendered on January 13, 1998, granting him counsel fees.
ACTION: The Merit System Board granted the appeal in part and ordered the appointing authority to pay counsel fees in the amount of $4,740.
B-16 TERRI BAKER
Terri Baker, a Senior Food Service Handler at Vineland Developmental Center, Department of Human Services, appeals the appointing authority's denial of her request for a reasonable accommodation.
ACTION: The Merit System Board directed that this appeal be denied.
B-17 GLYNDELL CURRY
The appeal of Glyndell Curry, Residential Living Specialist, Vineland Developmental Center, Department of Human Services, concerning her removal effective June 30, 1997 on charges, was heard by Administrative Law Judge Lillard E. Law (ALJ), who rendered his initial decision on October 27, 1999. At its meeting on February 8, 2000, the Merit System Board adopted the ALJ's recommendation upholding the removal. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.
B-18 JOHN ESPOSITO
The Appellate Division of the Superior Court has reversed the Board's final decision, In the Matter of John Esposito (MSB, decided May 19, 1998) rev'd and remanded, Docket No. A- 6477-97T5 (App. Div. November 18,1999), and remanded it for a determination of whether his release from his working test period as a Police Officer with the Township of Millburn, effective May 8, 1996, was effected in bad faith.
ACTION: The Merit System Board reversed the prior decision and upheld the release at the end of the working test period.
B-19 FRANK CASSIERE
Frank Cassiere appeals the decision of the Division of Selection Services which found that he did not meet the education and experience requirements for the open competitive examination for Senior Program Analyst (C61490), Essex County.
ACTION: The Merit System Board directed that this appeal be denied.

Walter W. Ferris appeals the determination of the Division of Selection Services, which found that he did not meet the experience requirements for the promotional examination for Supervisor, Roads (PC1804W), Ocean County.

Raymond E. Weicker, a permanent Financial Examiner 2 with the Department of Banking and Insurance, represented by Anita Ashkinazy, Staff Representative, CWA Local 1033, appeals the failure of his working test period for the promotional title of Financial Examiner 1.
ACTION: The Merit System Board acknowledged the settlement and granted a current regular appointment to Financial Examiner 1 and a new working test period.
