SUBJECT: Change in the Classification Plan - New Title
DEPARTMENT OF LABOR
The Department of Labor has requested the creation of a new, department-specific title. The requested title will be utilized as a bridge for the promotion of experienced clerical staff to the professional ranks. It will allow for permanent Senior Unemployment Insurance Clerks having four years of experience to compete for an opportunity to be appointed as an Investigator Aide. The Aide would be required to complete a training program specifically tailored to develop and hone the skills necessary to work as an Investigator.
Approval of this request will permit experienced and competent clerical staff an opportunity to advance into the professional ranks. The Department believes that experience gained as a Senior Unemployment Insurance Clerk, coupled with completion of the training program, is sufficient preparation for movement into the entry-level professional ranks.
In exchange for approval of this request, the Department of Labor is willing to inactivate the title of Claims Reviewer (56122).

GENERAL
Recently, we have found it necessary to create additional workweeks for professional Trainee titles to resolve compensation matters. When the workweek of the Trainee does not correspond with the workweek of the primary title, the Appointing Authority experiences difficulty in dispensing appropriate compensation to the incumbent(s). This request will avoid a future compensation matter with the Time and Leave Reporting System (TALRS).
The Department of Transportation has initiated steps to begin recruitment for a Planner Trainee, with a 40-hour workweek, which corresponds to the workweek of the primary title. Since there is no available 40-hour workweek at the Trainee level, we would like to establish it prior to the appointment date.

Ronald Burkhardt, Senior Correction Officer, East Jersey State Prison, Department of Corrections, suspension for 30 days, on charges of leaving assigned work area without permission but not creating a danger to persons or property.
Recommendation of the Administrative Law Judge - Modify the 30-day suspension to a 10-day suspension and reimbursement of 20 days back pay.
ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to uphold the 30- day suspension.
A motion was made and seconded that the open session be recessed and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Merit System Board entered into Executive Session for the purpose of legal advice on the matters of A-3 Terry Fisher and A-11 Jennifer Jones. The Board subsequently reconvened the public meeting.

A-11 JENNIFER JONES
Jennifer Jones, County Correction Officer, Burlington County Jail, removal effective June 26, 1998, on charges of conduct unbecoming a public employee, neglect of duty, and violation of rules and regulations for custody personnel, staff and contract personnel. The Merit System Board at its meeting of February 1, 2000, did not adopt the recommendation of the ALJ to uphold the removal. Rather, the Board determined that the removal be reversed. The matter is now before the Board for reconsideration.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: A motion was made and carried to reconsider the matter. Upon reconsideration the Merit System Board affirmed the recommendation of the Administrative Law Judge and upheld the removal.

Michael Thomas, Laborer, City of Trenton, Public Works Department, removal effective August 28, 1997, on charges of failure to comply with required enrollment in Mercer Employee's Assistance Program. The Merit System Board at its meeting of March 7, 2000, directed that this matter be held over for receipt of cross exceptions.

Administrative Law Judge (ALJ) Joseph F. Fidler issued an order of consolidation and predominant interest in which he consolidated the Merit System Board and the Division of Youth and Family Services, Department of Human Services (DYFS) matters and found that DYFS had the predominant interest. This joint order is now submitted to the Board for consideration and approval.
ACTION: The Merit System Board adopted the order of consolidation and predominant interest.
B-17 EXECUTIVE ASSISTANT (M5545T), CITY OF CAMDEN REDEVELOPMENT AGENCY
The appointing authority requests permission not to make an appointment from the certification for Executive Assistant (M5545T), City of Camden Redevelopment Agency.

B-18 TELISSA DOWLING
The appeal of Telissa Dowling, a County Correction Officer with the Hudson County Department of Public Safety, of her removal effective June 14, 1994 on charges, was heard by Administrative Law Judge Stephen G. Weiss (ALJ), who rendered his initial decision on July 21, 1999. At its meeting on February 23, 2000, the Board adopted the ALJ's recommendation to uphold the removal. However, the Board did not adopt the ALJ's recommendation to award 11 days of back pay. Rather, the Board concluded that the appellant was not entitled to any back pay. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-19 SHIRLEY HARRISON
The appeal of Shirley Harrison, a Hospital Attendant at Buttonwood Hospital, Burlington County, of her removal effective April 6, 1999, on charges, was heard by Administrative Law Judge Bernard Goldberg (ALJ), who rendered his initial decision on January 12, 2000 upholding the appellant's removal. At its meeting on February 23, 2000, the Board did not adopt the ALJ's recommendation to uphold the removal. Rather, the Board concluded that the appellant should be suspended from April 6, 1999 to May 17, 1999, the period she was on the Department of Health and Senior Services' Nurse Aide Abuse Registry. The proposed final decision is now submitted for the Board's review.

The appeal of James Meinhold, a Police Officer with the City of Wildwood, of his release at the end of his working test period, effective May 5, 1995, was heard by Administrative Law Judge Edgar R. Holmes (ALJ), who rendered his initial decision on September 30, 1999 upholding the release. At its meeting on February 23, 2000, the Board adopted the ALJ's recommendation. The appeal of Lamont D. Walker, a Supervising Building Maintenance Worker with the Department of Buildings and Grounds, Burlington County, who received a 10-day suspension, a demotion to Building Maintenance Worker, and a removal, effective August 5, 1996, was heard by Administrative Law Judge (ALJ) Joseph Lavery, who rendered his initial decision on December 2, 1999, upholding the 10- day suspension, the demotion and the removal. At its meeting on February 23, 2000, the Board ordered that the matter be remanded to the Office of Administrative Law. The proposed decision is now submitted for the Board's review.
