A regular meeting of the Merit System Board was held on
Tuesday, January 30, 2001, in Trenton, New Jersey.

PRESENT: Chairwoman Janice Mitchell Mintz, Merit System Board
Members, Margaret E.L. Howard, Judith L. Shaw, and Leo Vartan;
Elizabeth Laufer, Deputy Attorney General; and Henry Maurer,
Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Janice Mitchell
Mintz opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State
and sent to the Trentonian, Trenton Times, Courier-Post and Star
Ledger on November 30, 2000, and posted at the Department of
Personnel, 3 Station Plaza, Trenton, New Jersey.

All actions were by unanimous vote unless otherwise
specified.

SUBJECT: Change in State Classification Plan

DEPARTMENT OF LABOR

A title consolidation for the Manager and Manager, Employment
Services title series in the Department of Labor was approved by
the Merit System Board on August 8, 2000. The requested
consolidated replacement title series, Manager, Workforce New
Jersey was established effective July 29, 2000.

As a result of the implementation of the Workforce Investment Act
of 1998 and the mandate and goals of Governor Whitman's Executive
Order 36, the appointing authority has restructured its service
delivery system to provide one-stop career center approach to the
unemployed and under-employed. The replacement Manager titles
will be located in the Regional Adjudication Centers, Re-
employment Call-In Centers, One-Stop Re-employment Centers and
two Interstate Offices. A significant aspect of this initiative
is the integration of unemployment and employment and training
functions; thus manager roles are evolving as generalists in the
seamless One Stop Service system.

This reorganization has resulted in the redesign of the Manager
title series utilized by the Department of Labor. Subsequently,
Managers have undertaken comprehensive training for months on the
new duties and responsibilities necessary for successful
transition to the new office structure.

The transition process has progressed to the stage where it is
now appropriate to request the elimination of the consolidated
Manager 1 and 2 and Manager 1 and 2, Employment Services titles.
Subsequent to this action, the 3 levels of both title series will
no longer be germane. Therefore, in the interest of expediency we
are recommending those titles be made archaic as was stipulated
by the Board approval on July 28, 2000. The recommended effective
date of of both actions is July 29, 2000.

DEPARTMENT OF TRANSPORTATION

The Department of Transportation requests a one-range salary
increase for the title of Regional Electric Supervisor.

Changes over the past several years have impacted the know-how
factors of this function. The education and experience
requirements were previously increased to address the
technological advances impacting electrical devices used for
traffic control, direction and highway illumination for which the
department is responsible. Incumbents have assumed greater
managerial responsibilities, formerly exercised by higher level
managers, whose titles have now been eliminated.

We support this one-range increase.

Diane Burton, Secretarial Assistant 3, Hagedorn Gero-

Janet Cooke, Fire Alarm Operator, City of Orange, Fire
Department, removal effective November 12, 1996, on charges
of violation of the chain of command and fraudulent claim of
injury.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board remanded the matter to the
Office of Administrative Law.

Kenneth Davis, Mechanic, City of Trenton, Department of
Public Works, removal effective May 20, 1997, on charges of
insubordination and conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the

removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

Christopher Eutsey, Senior Security Guard, Newark School
District, removal effective September 7, 1998, on charges of
chronic or excessive absenteeism or lateness and conduct
unbecoming a public employee.

Recommendation of the Administrative Law Judge - Modify the
removal to a 30-day suspension.

ACTION: The Merit System Board directed that this matter
be held over.

A motion was made and seconded that the open session be
recessed and that, pursuant to Section 12(b) of the Open
Public Meetings Act, the Merit System Board entered into
Executive Session for the purpose of legal advice on the
matter of A-11 Charmaine Hemingway, A-14 Christopher Silva,
and A-15 Harry J. Murray. The Board subsequently reconvened
the public meeting.

Charmaine Hemingway, Police Communication Clerk, City of
Jersey City, Police Department, removal effective May 25,
1999, on charges of insubordination and conduct unbecoming a
public employee.

Recommendation of the Administrative Law Judge - Reverse the
removal.

ACTION: The Merit System Board modified the recommendation
of the Administrative Law Judge to uphold the
removal.

William Oliver, Safety Specialist 2 Division of Motor

A-14 CHRISTOPHER SILVA

Christopher Silva, Police Captain, Township of Little Egg
Harbor, Police Department, removal effective April 22, 1998,
on charges of violations of financial record keeping,
failure to perform and inefficiency, misconduct and neglect
of an internal affairs investigations.

Recommendation of the Administrative Law Judge - Reverse the
removal.

ACTION: The Merit System Board remanded the matter to the
Office of Administrative Law.

A-15 HARRY J. MURRAY

Harry J. Murray, a Principal Research Analyst with the
Department of Transportation (DOT) was removed from his
position, effective July 16, 1999, on charges of conduct
unbecoming a public employee, violation of the DOT's Code of
Ethics, along with the State Conflicts of Interest law and
failure to cooperate with an official investigation. This
matter was held over by the Board at the January 17, 2001
Merit System Board meeting.

Recommendation of the Administrative Law Judge - Modify the
removal to a four-month suspension and $500 fine.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge with respect to
dismissal of the charge of failure to cooperate
with an official investigation. The Merit System
Board modified the recommendation of the
Administrative Law Judge to uphold the removal on
the charge of conduct unbecoming.

his rejection as a Parole Officer Recruit candidate by the
Department of Corrections and its request to remove his name

basis of psychological unfitness to perform effectively the
duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-2 DAVID NIEVES

David Nieves, represented by Anthony J. Fusco, Jr., Esq.,
appeals his rejection as a Sheriff's Officer candidate by
the County of Essex and its request to remove his name from
the subject eligible list on the basis of psychological

ACTION: The Merit System Board granted the appeal and
ordered that Mr. Almeidinha's name be removed from
the eligible list.

B-22 CARMELO BONILLA

The Department of Community Affairs appeals the decision of
Human Resource Information Services which denied its request
to remove the name of Carmelo Bonilla from the eligible list
for Inspector Multiple Dwellings (S6200A), Department of
Community Affairs.

ACTION: The Merit System Board directed that this appeal
be denied.

B-23 VITO HINTON

Vito Hinton, represented by Anthony J. Fusco, Jr., Esq.,
appeals the decision of Selection Services which found that
the City of Newark had presented a sufficient basis to
remove the appellant's name from the Police Officer
(S9999V), City of Newark, eligible list on the basis of an
unsatisfactory driving record.

ACTION: The Merit System Board directed that this appeal
be denied.

B-24 THOMAS MCGUIRE

The Borough of Fair Lawn, represented by Sean D. Dias, Esq.,
petitions the Merit System Board for reconsideration of its
decision rendered July 25, 2000, which denied the Borough's
request to remove the name of Thomas McGuire from the
eligible list for Municipal Court Administrator (M6774A),
Borough of Fair Lawn based on his failure to satisfy the
experience requirement.

ACTION: The Merit System Board denied the request for
reconsideration.

B-25 JOSEPH F. QUILES

Joseph F. Quiles appeals the determination of Human Resource
Information Services (HRIS) which found that the appointing
authority had presented a sufficient basis to remove his
name from the open competitive list for Police Officer,
Bilingual in Spanish and English (S9999V), Morristown, for
failure to maintain continuous permanent residency.

ACTION: The Merit System Board directed that this appeal
be denied.

B-26 JERRY THOMPSON

The Department of Corrections (DOC) appeals the decision of
Selection Services, which found that it did not present a
sufficient basis to remove Jerry Thompson's name from the
Correction Officer Recruit (S9999W) eligible list.

ACTION: The Merit System Board granted the appeal and
ordered that Mr. Thompson's name be removed from
the eligible list.

B-27 SPENCER SCOTT

Spencer Scott, a former County Correction Officer with the
Gloucester County Sheriff's Office, represented by Anthony
J. Fusco, Jr., Esq., petitions the Merit System Board for
interim relief of his immediate suspension, effective August
18, 1999.

ACTION: The Merit System Board directed that this matter
be held over.

B-28 DORELEENA SAMMONS-POSEY

Doreleena Sammons-Posey, a Research Scientist 1 with the
Department of Health and Senior Services, represented by
William G. Schimmel, Esq., appeals the determination of the
Commissioner, Department of Health and Senior Services,
which found that she failed to present sufficient evidence
to support a finding that she had been discriminated against
based on her race or gender.

ACTION: The Merit System Board granted a hearing.

B-29 HANSA A. PATEL

Hansa A. Patel, a Senior Account Clerk with the State-
Operated School District of the City of Newark, requests
reconsideration of the final decision of the Merit System
Board, rendered July 25, 2000, which modified her 90-day
suspension to a 45-day suspension.

ACTION: The Merit System Board denied the request for
reconsideration.

B-30 CHARLES J. SHERIDAN

The Township of Millburn (Township), represented by Thomas
J. Sateary, Esq., requests reconsideration of that portion
of the administrative decision, rendered May 4, 1999, which
ordered that the Township bear the expense of Charles J.
Sheridan's independent psychological evaluation.

ACTION: The Merit System Board denied the request for
reconsideration.

B-31 ZONING OFFICER (M6554W), TOWNSHIP OF EDGEWATER PARK

The Township of Edgewater Park requests reconsideration of
the decision rendered on June 6, 2000, by the Merit System
Board in In the Matter of Zoning Officer (M6554W), Township
of Edgewater Park, which granted the Township's request for
an appointment waiver and ordered that it be assessed for
the costs of the selection process in the amount of $2,048.

ACTION: The Merit System Board granted the request to
allow the appointing authority to make and
appointment and rescinded the assessment of
costs.

B-32 MOSES M. ALOBWEDE

Moses Alobwede appeals the determination of the Division of
Selection Services, which found that he did not meet the
educational requirements for the open competitive
examinations for Probation Officer (S0307W) and Probation
Officer (Child Support Enforcement) (S0316W).

ACTION: The Merit System Board directed that this appeal
be denied.

B-33 JO ANN ANDERSON

Jo Ann Anderson appeals the determination of the Division of
Selection Services, which found that she did not meet the
experience requirements for the open competitive examination
for Administrative Analyst 2 (Fiscal Management) (S6167W).

ACTION: The Merit System Board directed that this appeal
be denied.

B-34 SARAH BLIZZARD

Sarah Blizzard appeals the determination of the Division of
Selection Services, which found that she failed to meet the
licensure requirement for the open competitive examination
for Librarian (Children's) (M9276A), City of Bridgeton.

ACTION: The Merit System Board directed that this appeal
be denied.

B-35 MICHAEL BREZEE

On behalf of Michael Brezee, the appointing authority
appeals the determination of the Division of Selection
Services which found that appellant did not meet the
experience requirements for Fire Official UFD (PM3508B),
Gloucester Township.

ACTION: The Merit System Board directed that this appeal
be granted.

B-36 HAYDER A. CAMARGO AND LAURA FONDE

Hayder A. Camargo and Laura Fonde appeal the determinations
of the Division of Selection Services which found that they
were ineligible for the promotional examination for

ACTION: The Merit System Board directed that these appeals
be denied.

John Fiedorowicz appeals the determination of the Division
of Selection Services, which found that he did not meet the

for Supervising Public Safety Telecommunicator (M1049A),
City of Bayonne.

ACTION: The Merit System Board directed that this appeal
be denied.

B-38 GAIL GEONNETTI

Gail Geonnetti appeals the determination of the Division of
Selection Services, which found that she did not meet the
experience requirements for the open competitive examination
for Income Maintenance Technician (C0873A), Camden County.

ACTION: The Merit System Board directed that this appeal
be denied.

Performance Assessment Review (PAR) ratings on promotional
examinations, be relaxed to allow credit for the PAR ratings
of Correction Lieutenants not on file by the July 20, 2000
closing date of the promotional examination for Correction
Captain (PS2535I), Department of Corrections.

B-54 FAMILY SERVICE SPECIALIST TRAINEE AND FAMILY SERVICE
SPECIALIST TRAINEE BILINGUAL


The Director, Division of Human Resource Management,
requests that the titles of Family Service Specialist
Trainee and Family Services Specialist Trainee Bilingual
within the Division of Youth and Family Services, Department
of Human Services, be allocated to the noncompetitive
division of the career service on an interim basis where
lists currently do not exist.

ACTION: The Merit System Board granted the request.

The Salary Regulations, Supplement 2, Section 3, Special
