    A regular meeting of the Civil Service Commission was held on Wednesday, January 18, 2017, in Trenton, New Jersey.

 

          PRESENT: Robert M. Czech, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Nicholas F. Angiulo, Assistant Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 28, 2016, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

 DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

ACTION:    The Civil Service Commission noted the dismissal of the appeal without prejudice.

Recommendation of the Administrative Law Judge – Grant motion to dismiss appeal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    MICHAEL HANSEN

 

Michael Hansen, County Correction Officer, Hudson County, Department of Corrections, 60 working day suspension on charges of insubordination, conduct unbecoming a public employee, neglect or duty, chronic or excessive absenteeism, and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Modify the 60 working day suspension to a 20 working day suspension.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    BETTY GENE JOHNSON-TAYLOR (A written decision will be posted in this matter when the Civil Service Commission adopts the decision at a future meeting.)

 

Betty Gene Johnson-Taylor, Assistant Personnel Director, City of Paterson, Department of Business Administration, removal effective January 16, 2015 on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Modify the removal to a six-month suspension.

 

ACTION:    The Civil Service Commission rejected the recommendation of the Administrative Law Judge and upheld the removal.

 

A5     MICHAEL MULCAHY, ET AL (A written decision will be posted in this matter when the Civil Service Commission adopts the decision at a future meeting.)

 

Michael Mulcahy, Housing Inspector, Gary Parlatti, Field Representative Citizen Complaints, and Michael Smith, Field Representative Citizen Complaints, Bayonne, Department of Municipal Services, good faith layoffs effective July 17, 2015.

 

Recommendation of the Administrative Law Judge – Reverse the layoffs.

 

ACTION:     The Civil Service Commission rejected the recommendation of the Administrative Law Judge and upheld the layoffs.

S.C.A. appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9988T) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    W.F.C. – CSC DOCKET NO. 2016-1803

 

W.F.C. appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9988T) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    A.B. – CSC DOCKET NO. 2016-1544

 

A.B. appeals the request by North Hudson Fire and Rescue to remove his name from the Fire Fighter (M2555M) eligible list for medical unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

J.C. appeals the request by Morris County to remove his name from the Public Works Repairer (C0149T) eligible list for medical unfitness to perform effectively the duties of the position.

B-12   LAWRENCE JENKINS – CSC DOCKT NOS. 2016-3712 AND 2016-3939

 

Lawrence Jenkins appeals the appeals the appointing authority’s determinations to remove his name from the Correction Officer Recruit (S9988R) and (S9988T) eligible lists based on an unsatisfactory background report and falsification of his preemployment application.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-13   ELIEZER MOTA – CSC DOCKET NO. 2016-3651

 

Eliezer Mota appeals Jersey City’s request for the removal of his name from the eligible list for Police Officer (S9999R), Jersey City, on the basis of an unsatisfactory driving record, falsification of his application, and residing outside the residency scope.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-14   TASHANA WATKINS – CSC DOCKET NO. 2017-315

 

Tashana Watkins appeals the removal of her name from the eligible list for Police Officer (S9999R), Irvington on the basis of an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-15   ASSISTANT ASSESSOR (M0115U), WEST NEW YORK - CSC DOCKET NO. 2017-824

 

West New York requests permission not to make an appointment from the June 7, 2016 certification for Assistant Assessor (M0115U).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-16   ASSISTANT ENGINEER (M0719T), CITY OF CLIFTON - CSC DOCKET NO. 2016-4388

 

The City of Clifton requests permission not to make an appointment from the February 16, 2016 certification for Assistant Engineer (M0719T).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-17  IN THE MATTER OF ADMINISTRATIVE ANALYST (C0561P), MERCER COUNTY CSC DOCKET NO. 2016-3704

 

In In the Matter of Administrative Analyst (C0561P), Mercer County (CSC, decided August 13, 2014), the Civil Service Commission (Commission) granted the request of Mercer County (Mercer) for an appointment waiver for the April 22, 2013 certification and ordered that no selection costs would be assessed at that time since there was a possibility that the list could be utilized prior to its expiration. However, Mercer did not utilize the subject eligible list and the matter of the assessment of costs is now before the Commission.

 

ACTION:     The Civil Service Commission assessed selection costs in the amount of $2,048.

 

B-18   CHIEF CHEMIST WATER ANALYSIS (SPECIAL) - CSC DOCKET NO. 2016-3867

 

The Division of Agency Services requests that the City of Trenton be ordered to return the January 15, 2015 certification (OL150064) of the eligible list for Chief Chemist Water Analysis (Special) for proper disposition.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-19   CODE ENFORCMENT OFFICER (M0926R) LAKEWOOD CSC DOCKET NO. 2016-2206

 

The appointing authority’s failure to dispose of the certification for Code Enforcement Officer (M0926R), Lakewood, while a provisional employee is serving in the title, has been referred to the Civil Service Commission for enforcement.

 

ACTION:     The Civil Service Commission ordered the appointing authority to remove the provisional appointee, make an appointment from the certification, and pay compliance costs.

 

B-20   EQUIPMENT OPERATOR (PM2346T), CITY OF CLIFTON - CSC DOCKET NO. 2016-4387

 

The City of Clifton requests permission not to make an appointment from the March 28, 2016 certification for Equipment Operator (PM2346T).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $1,114.

 

B-21   IN THE MATTER OF MANAGEMENT SPECIALIST (C0004R), MONMOUTH COUNTY – CSC DOCKET NO. 2017-674

 

In In the Matter of Management Specialist (C0004R), Monmouth County (CSC, decided September 3, 2014), the Civil Service Commission (Commission) granted the request of Monmouth County (Monmouth) for an appointment waiver for the September 10, 2013 certification and ordered that no selection costs would be assessed at that time since there was a possibility that the list could be utilized prior to its expiration. However, Monmouth did not utilize the subject eligible list and the matter of the assessment of costs is now before the Commission.

 

ACTION:     The Civil Service Commission assessed selection costs in the amount of $2,048.

 

B-22   SENIOR COMMUNITY RELATIONS SPECIALIST (SPECIAL), NEWARK – CSC DOCKET NO. 2016-3817

 

The appointing authority’s failure to dispose of the certification for Senior Community Relations Specialist (Special), Newark, while a provisional employee is serving in the title, has been referred to the Civil Service Commission for enforcement.

 

ACTION:    The Civil Service Commission directed that this matter be held.

 

B-23   CHRISTOPHER BRADSHAW, ET AL. – CSC DOCKET NOS. 2016-4274, ET AL.

Christopher Bradshaw, Michael Pirolli and Marie Revesz appeal the decisions of the Division of Agency Services, which found that their positions with the Department of the Treasury were properly classified as Field Representative, Local Property Tax. They seek Senior Field Representative, Local Property Tax job classifications in this proceeding.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-24   TRICIA BUTERA – CSC DOCKET NO. 2016-3752

 

Tricia Butera appeals the decision of the Division of Agency Services that the proper classification of her position with the Office of Information Technology is Technical Support Specialist 1. The appellant seeks a Data Processing Systems Programmer 2 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-25   FRED DEVOE – CSC DOCKET NO. 2017-898

 

Fred DeVoe appeals the decision of the Division of Agency Services which found that his position with the Department of the Treasury is properly classified as Auditor 2, Taxation. The appellant seeks an Auditor 1, Taxation job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-26   GARLINA FINN – CSC DOCKET NO. – 2016-1642

 

Garlina Finn appeals the October 2, 2015 decision of the Division of Agency Services which found that her position with the Department of Health is correctly classified as Health Care Services Evaluator/Nurse. The appellant seeks an Education Program Development Specialist 3 job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-27   JOHN PIENCIAK – CSC DOCKET NO. 2017-811

 

The Township of Hillside appeals the August 12, 2016 decision of the Division of Agency Services which found that John Pienciak’s position is properly classified as Deputy Fire Chief. It seeks a Fire Captain job classification in this proceeding.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-28   BETH KAMINSKY – CSC DOCKET NO. 2017-1297

 

Beth Kaminsky appeals the determination of the Division of Agency Services, which found that she did not meet the experience requirement for the promotional examination for Personnel Aide 2 (PS1276K), Ancora Psychiatric Hospital.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-29  PAULO MARQUES – CSC DOCKET NO. 2017-1089

 

Paulo Marques appeals the determination of the Division of Agency Services that he was below the minimum requirements in experience for the promotional examination for Traffic Signal Supervisor 1 (PM1199U), Elizabeth.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-30   CRYSTAL MARTIN & BRIETTA MORTON - CSC DOCKET NOS. 2017-979 & 2017-914

 

Crystal Martin and Brietta Morton appeal the decisions of the Division of Agency Services that they did not meet the experience requirements for the promotional examination for Quality Assurance Specialist, Health Services (PS0917K), Department of Human Services.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

Patricia Panaro appeals the determination of the Division of Agency Services that she did not meet the experience requirements for the promotional examination for Contract Administrator 1 (PS1178P), Department of Law and Public Safety.

B-46   BENITA DICKERSON – CSC DOCKET NO. 2016-4407

 

Benita Dickerson requests that the provisions of N.J.A.C. 4A:4-2.6(a)4 be relaxed in order to allow her to file a late application for the promotional examination for Supervisor of Professional Residential Services Developmental Disabilities (PS0641K), Woodbine Developmental Center.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-47   WILLIAM HAWKINS – CSC DOCKET NO. 2016-2495

 

William Hawkins, represented by Lawrence Popp, Esq., requests enforcement of the decision rendered on February 4, 2015 ordering that his title seniority as a Police Officer with the Borough of Somerdale be applied to his current title of Senior Police Officer, Human Services, Department of Human Services.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-48   SHARON WINN – CSC DOCKET NO. 2017-455

 

Sharon Winn, Public Health Nurse with Trenton, appeals the determination of her layoff rights by the Division of Agency Services.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-49   J.F. – CSC DOCKET NO. 2016-3394

 

J.F., a former Personnel Assistant 1 with the Department of Human Services (DHS), appeals the determination of the Assistant Commissioner of Human Resources, DHS, which found that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-50   C.S. – CSC DOCKET NO. 2016-3377

 

C.S., a Sergeant with the Division of State Police, Department of Law and Public Safety, appeals the decision of the Director, Office of Equal Employment Opportunity, which found that the appellant did not present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-51   MATTHEW BULZAK – CSC DOCKET NO. 2016-1696

 

Matthew Bulzak, a County Correction Officer, Camden County Department of Corrections, represented by Christopher Gray, Esq., requests that the Civil Service Commission reinstate the appeal of his 30 working day suspension, which was dismissed based on his failure to appear at a settlement conference on February 2, 2016.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-52  DAVID ANTHONY – CSC DOCKET NO. 2016-1740

 

David Anthony, a Management Specialist with the Hudson County Sheriff’s Office, represented by David Beckett, Esq., seeks enforcement of the decision rendered on August 19, 2015 granting him back pay, benefits and seniority pursuant to N.J.A.C. 4A:2-2.10.

 

ACTION:     The Civil Service Commission orders that David Anthony be awarded $107,477.05 in back pay and $3,466.30 in health insurance premiums.

 

B-53   MARIE JEANPIERRE – CSC DOCKET NO. 2016-3217

The Appellate Division, New Jersey Superior Court, reversed the removal of Paul Williams, a Truck Driver, Heavy, with the Township of Lakewood and remanded to the Civil Service Commission the matter of the calculation of back pay and counsel fees.

 

ACTION:     The Civil Service Commission orders that the appointing authority pay Paul Williams the gross amount of $7,080.55 in back pay and $23,475.00 in counsel fees.

 

B-55   CORRECTION OFFICER RECRUIT (S9988R) - CSC DOCKET. NO. 2017-1997

 

The Department of Corrections requests that the eligible list for Correction Officer Recruit (S9988R) be revived and extended.

B-56   INTERIM DISASTER RECOVERY DIVISION, DEPARTMENT OF COMMUNITY AFFAIRS – CSC DOCKET NO. 2017-1816

 

The Division of Agency Services (Agency Services), on behalf of the Department of Community Affairs (DCA), requests that the Civil Service Commission extend the September 30, 2017 deadline established in In the Matter of Interim Disaster Recovery Relief (CSC, decided April 17, 2013), to make temporary unclassified appointments to various career service titles in order to staff the interim Disaster Recovery Division, DCA.

 

ACTION:     The Civil Service Commission directed that this request be granted.

L.D., an Institutional Telephone Operator with Ancora Psychiatric Hospital, appeals the decision of the Assistant Commissioner, Human Resources, which found that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-60   KRYSTAL MITCHELL – CSC DOCKET NO. 2016-3097

 

Krystal Mitchell requests a retroactive appointment date as an Office Supervisor to November 1, 2011 with the Department of Human Services as a result of the classification determination of the Division of Agency Services.

 

ACTION:    The Civil Service Commission directed that this request be granted in part.

 

B-61   JUDITH NADAL – CSC DOCKET NO. 2016-1640

 

Judith Nadal appeals the decision of the Division of Agency Services that the proper classification of her position with the Department of Law and Public Safety is Agency Services Representative 1. The appellant seeks an Agency Services Representative 4 or Supervisor, Licensing Unit, Professional Board job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

Danny Wong appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Manager 4 Environmental Protection, Technical/Scientific Engineering (PS1790G), Department of Environmental Protection.

The Town of Phillipsburg requests a retroactive appointment date for Sandor Gal to Police Lieutenant, effective April 7, 2016.
