    A regular meeting of the Civil Service Commission was held on Wednesday, April 5, 2017, in Trenton, New Jersey.

 

          PRESENT: Robert M. Czech, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 28, 2016, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

Clement Collins, Supervisor of Custodians, Newark School District, 45 working day suspension (10 days in the form of a fine) on charges of other sufficient cause.

 

Recommendation of the Administrative Law Judge – Reverse the suspension.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    PAUL SERDIUK

 

Paul Serdiuk, Personnel Assistant 2, Department of Military and Veterans Affairs, removal effective April 25, 2012, on charges of insubordination, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:    The Civil Service Commission directed that this matter be held.

 

A-5    VICTORIA VARTOLONE

 

Victoria Vartolone, Human Services Aide, Bergen County, Board of Social Services, release at the end of the working test period.

 

Recommendation of the Administrative Law Judge – Uphold the release at the end of the working test period.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A.D., represented by Michael L. Prigoff, Esq., appeals his rejection as a Fire Fighter candidate by Jersey City and its request to remove his name from the eligible list for Fire Fighter (M2542M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    G.D. – CSC DOCKET NO. 2016-2747

 

G.D., represented by John D. Feeley, Esq., appeals his rejection as a Police Officer candidate by Verona Township and its request to remove his name from the eligible list for Police Officer (S9999R), Verona Township on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    C.J.L. – CSC DOCKET NO. 2016-3189

 

C.J.L. appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9988T) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

           

B-4    R.R. – CSC DOCKET NO. 2016-1300

 

R.R., represented by Michael L. Prigoff, Esq., appeals his rejection as a Fire Fighter candidate by the Village of Ridgewood and its request to remove his name from the eligible list for Fire Fighter (M2567M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-5    KIAHNA WALCOTT, ET AL. – CSC DOCKET NOS. 2016-3708, ET AL.

 

Kiahna Walcott, represented by Ciro Spina, Esq., Joseph Mirambeaux, and Shawn Murray-Sims appeal their rejection as County Correction Officer candidates by Essex County and its request to remove their names from the eligible list for County Correction Officer (S9999R), Essex County on the basis of failure of a medical examination.

 

ACTION:     The Civil Service Commission directed that these appeals be granted.

 

B-6    ERIK BEAUCHAMP – CSC DOCKET NO. 2016-3255

 

Erik Beauchamp, represented by Matthew R. Dempsky, Esq., appeals the removal of his name from the Sheriff’s Officer (S9999R), Camden County, eligible list due to an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    GUY CAPPELLO – CSC DOCKET NO. 2017-233

 

Guy Cappello appeals the removal of his name from the eligible list for Construction and Maintenance Technician 5 (S0626T), Department of Transportation, on the basis of having an unsatisfactory background report and falsification of his employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-8    PHILLIP SZCZUR – CSC DOCKET NO. 2017-517

 

Phillip Szczur appeals the removal of his name from the eligible list for Social Worker (C0110S), Cape May County on the basis of his failure to complete preemployment processing.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    PETER J. PARKER, JR. – CSC DOCKET NOS. 2016-1742 & 2016-4334

 

Peter J. Parker, Jr., represented by Carl Tripician, Esq., appeals the bypasses of his name on the Police Sergeant (PM5105M), Moorestown Township, eligible list.

 

ACTION:     The Civil Service Commission directed that these matters be held.

 

B-10   SENIOR COTTAGE TRAINING TECHNICIAN (PS1765K) - CSC DOCKET NO. 2017-2891

 

Woodbine Developmental Center requests that the eligible list for Senior Cottage Training Technician (PS1765K) be extended for one year beyond its original expiration date in order to fill future vacancies.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-11   DAVID BOBAL – CSC DOCKET NO. 2017-1440

 

David Bobal appeals the decision of the Division of Agency Services that the proper classification of his position with the Department of the Treasury is Auditor 1, Taxation. The appellant seeks a Supervising Auditor, Taxation job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-12  JUDITH STANTARE – CSC DOCKET NO. 2017-2354

 

Judith Stantare appeals the determination of the Division of Agency Services which found that she did not meet the experience requirements for the promotional examination for Administrative Secretary (PC1842U), Cape May County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-13   SHARON TURNER – CSC DOCKET NO. 2017-734

 

Sharon Turner appeals the determination of the Division of Agency Services which found that she did not meet the minimum experience requirements for the promotional examination for Training Technician (PC0741U), Burlington County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-14   SELVIN WHITE, JR. – CSC DOCKET NO. 2017-1737

 

Selvin White, Jr. appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Executive Assistant (PM1237U), Newark.

 

ACTION:     The Civil Service Commission directed that this matter be held.

 

B-15   JOSEPH CORCORAN – CSC DOCKET NO. 2017-2879

 

The City of Long Branch, on behalf of Joseph Corcoran, requests that he be permitted to participate in the intergovernmental transfer program and to complete his working test period as Police Officer with Long Branch.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-16   GLEN WILSON – CSC DOCKE NO. 2017-2575

 

Glen Wilson requests a make-up examination for the Entry Level Law Enforcement Examination (S9999U).

 

ACTION:     The Civil Service Commission directed that this request be granted.

P.H., a Regional Staff Nurse, Medical Assistance, appeals the decision of the Department of Human Services which denied her request to participate in the Donated Leave Program.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-18   TANERRA DURHAM – CSC DOCKET NO. 2017-88

 

Tenerra Durham, a former Juvenile Detention Officer with Union County, represented by Michael A. Bukosky, Esq., requests a hearing with respect to her resignation in good standing effective June 29, 2016.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-19   SABURA ALEXANDER – CSC DOCKET NO. 2016-2119

 

Sabura Alexander, a Human Services Specialist 4 with Hudson County, petitions the Civil Service Commission for reconsideration of the decision, rendered on December 9, 2015, in which the Director of the Division of Appeals and Regulatory Affairs denied her request for a hearing with respect to her 60 working day suspension effective October 9, 2015.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-20   KEVIN HOLMES – CSC DOCKET NO. 2016-2118

 

Kevin Holmes, a former Juvenile Detention Officer with Morris County, Department of Human Services, petitions the Civil Service Commission for reconsideration of the administrative decision, rendered on November 16, 2015, in which the Director of the Division of Appeals and Regulatory Affairs, denied his request for a hearing with respect to his 180-day suspension.

 

ACTION:     The Civil Service Commission directed that this matter be held.

B-22   FRANK BORG – CSC DOCKET NO. 2016-4002

 

Frank Borg appeals the removal of his name from the eligible list for Office Supervisor (M0466R), New Brunswick, on the basis that he was outside the residency scope.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-23   SONJA MYERS – CSC DOCKET NO. 2017-2391

 

The Division of Agency Services, on behalf of the Department of Human Services, requests a retroactive regular appointment effective November 1, 2014 for Sonja Myers from the Section Chief, Health Care Facility Rehabilitation/Professional Services (PS6124K) eligible list.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-24   SANITATION INSPECTOR (M0006P), TOWN OF WEST NEW YORK CSC DOCKET NO. 2016-602

 

The Town of West New Your (West New York), represented by Angelo Auteri, Esq., requests reconsideration of the decision rendered on June 3, 2015 by the Civil Service Commission in In the Matter of Sanitation Inspector (M0006P), West New York, which ordered it to properly dispose of the December 9, 2013 certification for Sanitation Inspector (M0006P) within 30 days and remit $1,000 in compliance costs.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-25   MARCO NAVARRO – CSC DOCKET NO. 2017-2383

 

Marco Navarro appeals the appointing authority’s request to remove his name from the eligible list for Sheriff’s Officer (S9999R), Hudson County, on the basis of failure to appear for pre-employment processing.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-26   V.W. – CSC DOCKET NO. 2017-96

 

V.W., a Quality Assurance Coordinator with the Department of Human Services (DHS), appeals the determination of the Assistant Commissioner of Human Resources, DHS, which found that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:    The Civil Service Commission directed that this matter be remanded to the Office of Administrative Law for a hearing.

 

B-27   LEWIS PEREZ – CSC DOCKET NO. 2016-4511

 

Lewis Perez appeals the disqualification from the bilingual portion of the promotional examination for Family Services Specialist 1, Bilingual in Spanish and English (PS3421K), Department of Children and Families.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-28   WILLIAM PENA – CSC DOCKET NO. 2017-1810

 

William Pena appeals the determination of the Division of Agency Services that his position with the Department of the Treasury is properly classified as Investigator 2, Taxation, Bilingual in Spanish and English. The appellant seeks an Investigator 1, Bilingual in Spanish and English job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-29   REGGIE DALTON – CSC DOCKET NO. 2017-594

 

Reggie Dalton appeals the bypass of his name on the Police Captain (PM0866S), Lakewood Township, eligible list.

B-30   PAUL DECARLO – CSC DOCKET NO. 2017-2498

 

Paul DeCarlo appeals the determination of the Division of Agency Services that he was below the minimum requirements in experience for the promotional examination for Technological Service Specialist, Commission for the Blind and Visually Impaired (CBVI)(PS1754K), CBVI.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-31   ANDREW KEMP – CSC DOCKET NO. 2017-1776

 

Andrew Kemp appeals the decision of the Division of Agency Service which found that, per the substitution clause for education, he did not meet the experience requirements for the open-competitive examination for Supervising Program Analyst (M0386U), Jersey City.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-32   TINA MARIE LOPEZ – CSC DOCKET NO. 2017-708

 

Tina Marie Lopez appeals the decision of the Division of Agency Services which found that she did not meet the experience requirements for the promotional examination for Assistant Training Supervisor County Welfare Agency (PC0636U), Union County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-33   D.A. – CSC DOCKET NO. 2016-3840

 

D.A., a Senior Technician, Management Information Systems, with the Department of Health, appeals the determination by the Chief of Staff, Department of Health, which found sufficient evidence that she had violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-34   J.C. – CSC DOCKET NO. 2013-3283

 

J.C., a former Manager 2, Human Resource, with the Greystone Park Psychiatric Hospital appeals the determination of the Assistant Commissioner of the Department of Human Services, that the appellant did not present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-35   S.H. – CSC DOCKET NO. 2017-2799

 

The Department of Law and Public Safety, on behalf of S.H., requests the relaxation of the provisions of N.J.A.C. 4A:6-1.22 so as to permit S.H. to receive more than the 260 donated leave days allowed to a recipient.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-36   ANNABELL LOVEL – CSC DOCKET NO. 2016-3475

 

The Division of Agency Services, on behalf of the Department of Law and Public Safety, requests that Annabel Lovell be provisionally appointed to the unrelated above entry-level title Agency Services Representative 4.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-37   MARYANN MILLER – CSC DOCKET NO. 2017-2029

 

Maryann Miller, represented by Carlos Diaz-Cobo, Esq., requests reconsideration of the decision rendered on November 23, 2016 which upheld the determination of the Division of Agency Services that her position is properly classified as Senior Account Clerk.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-38   MARIA PINHO – CSC DOCKET NO. 2017-1398

 

Maria Pinho appeals the decision of the Division of Agency Services which found that her position with the Department of the Treasury is properly classified as Assistant Chief of Operations, Treasury. The appellant seeks a Chief of Operations, Treasury job classification.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-39   CARTHANIEL CRUM – CSC DOCKET NO. 2017-1770

 

Carthaniel Crum appeals the decision of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Signal System Superintendent (PM1541U), Plainfield.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-40   WILLIAM O’DONNELL – CSC DOCKET NO. 2017-1081

 

William O’Donnell appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Assistant Chief Clerk (PM0745U), Jersey City.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.
