A regular meeting of the Civil Service Commission was held on Wednesday, May 27, 2009, in Trenton, New Jersey.

 

      PRESENT: Hope L. Cooper, Chairperson, Members Flavella Branham, John Currie and Margaret E. L. Howard; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

 

      In accordance with L.1975, c.231, Hope L. Cooper, Chairperson, opened the meeting with the following statement:

A-2    RUTHANN DAMATO

 

Ruthann Damato, Receptionist/Telephone Operator, Town of Phillipsburg,  appeals the good faith of her layoff effective June 30, 2008, for reasons of economy and efficiency.

 

Recommendation of the Administrative Law Judge - Uphold the layoff.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3    HELEN JOHNSON

 

Helen Johnson, Family Service Worker, Essex County, Department of Citizen Services, release at the end of the working period effective April 25, 2008.

 

Recommendation of the Administrative Law Judge - Uphold the release at the end of the working period.

 

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    FLETCHER STOKLEY

 

Fletcher Stokley, Custodian, Newark School District, 10-day suspension on charges of insubordination, conduct unbecoming a public employee and neglect of duty.

 

Recommendation of the Administrative Law Judge - Uphold the 10-day suspension.

 

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 


A-5    TRACY JOHNSON (REMAND)

 

Tracy Johnson, Correction Sergeant, Northern State Prison, Department of Corrections, removal effective April 27, 2007, on charges of falsification, conduct unbecoming a public employee and violation of administrative procedures and/or regulations involving safety and security.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6    THOMAS PAPPAS

 

Thomas Pappas, Truck Driver, City of Paterson, Department of Public Works, removal May 24, 2005, on charges of conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-7    ARNOLD BORRERO

 

Arnold Borrero, Police Officer, City of Newark, Police Department, removal effective February 5, 2007, on charges of conduct unbecoming a public employee, conviction of a crime and violation of Police Department rules regarding criminal law and unfavorable conduct.  This matter was held over from the May 13, 2009 Civil Services Commission meeting.

 

Recommendation of the Administrative Law Judge - Modify the removal to a six-month suspension.

 

ACTION:     The Civil Service Commission modified the recommendation of the Administrative Law Judge to uphold the removal.

 

 


SECTION B - MISCELLANEOUS MATTERS

B-1    EDWIN J. ANCHUNDIA

 

Edwin J. Anchundia, represented by Nora R. Locke, Esq., appeals his rejection as a Police Officer candidate by Union City and its request to remove his name from the eligible list for Police Officer (S9999F) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

B-2    WILLIAM BUILES

 

William Builes, represented by Justin Talley, Esq., appeals his rejection as a Police Officer candidate by the City of Passaic and its request to remove his name from the eligible list for Police Officer (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission referred this appeal for an independent psychological evaluation.

B-3    ANGEL SANTIAGO

 

Angel Santiago, represented by Scott D. Finckenaurer, Esq., appeals his rejection as a Police Officer candidate by North Bergen and its request to remove his name from the eligible list for Police Officer (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

B-4    ENID CINTRON

 

Enid Cintron, a Program Development Specialist 2 with Southern State Correctional Facility, Department of Corrections, appeals the denial of sick leave injury (SLI) benefits.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

B-5    ROSE CIPPON

 

Rose Cippon, a Software Development Specialist 3 with the Office of Information Technology, appeals the denial of sick leave injury (SLI) benefits.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

B-6    REDA FARJ

 

Reda Farj, an Institutional Trade Instructor 1 (Cooking) with the Adult Diagnostic and Treatment Center, Department of Corrections, appeals the denial of sick leave injury (SLI) benefits.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-7    ALNISA JACKSON

 

Alnisa Jackson, a Senior Correction Officer with Mountainview Youth Correctional Facility, Department of Corrections, appeals the denial of sick leave injury (SLI) benefits.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

B-8    SAUNDRA JORDAN

 

Saundra Jordan, a Teacher 3, 12 months, with the Juvenile Justice Commission, Department of Law and Public Safety, appeals the denial of sick leave injury (SLI) benefits.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.


B-9    MARTIN BERGEN

 

Martin Bergen appeals the decision of the Division of State Human Resource Management, which upheld the removal of his name from the Plumber and Steamfitter (S6933J), Bayside State Prison, eligible list, on the basis of an unsatisfactory background report and falsification of his employment application. 

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

B-10   ANDREW KOERKEL

 

Andrew Koerkel appeals the decision of the Division of State Human Resource Management, which found that the appointing authority had presented a sufficient basis to remove his name from the Correction Officer Recruit (S9999H), Department of Corrections, eligible list as a result of an unsatisfactory criminal record.

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-11   MATTHEW MAINES

 

Sussex County appeals the decision of the Division of Local Human Resource Management, which restored the name of Matthew Maines to the Sheriff's Officer (S9999H), Sussex County, eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 


B-12   WAYNE VARGA

 

Wayne Varga appeals the decision of the Division of Local Human Resource Management which upheld the removal of his name from the eligible list for Investigator, Penal Institution (C1350H), Mercer County.  He also appeals the decision of the Division of State Human Resource Management which upheld the removal of his name from the eligible list for Employment Services Trainee (S0582J), Department of Labor and Workforce Development.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-13   JOHN BRILLA AND MICHAEL GERMAN

 

The Department of Human Services requests that the Civil Service Commission expand the title scope of promotional examinations, pursuant to N.J.A.C. 4A:4-2.5(d)5, in order to permit the promotion of John Brilla and Michael German from the non-competitive title of Computer Operator Assistant to the competitive titles of Communications Systems Technician 2 and Senior Technician, Management Information Systems, respectively.

 

ACTION:     The Civil Service Commission directed that these requests be granted.

 

B-14   JOHN DOWD

 

John Dowd, a Senior Engineering Aide with Parsippany-Troy Hills, petitions the Civil Service Commission for interim relief of his continued separation from employment.

 

ACTION:     The Civil Service Commission directed that this petition be granted in part.

 

B-15   ERIC LEWIS

 

Eric Lewis, a Police Officer with East Orange, represented by Anthony J. Fusco, Jr., Esq., appeals his immediate suspensions, effective May 12, 2008 and November 25, 2008.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-16   ASSISTANT MUNICIPAL CLERK (M8044J), TRENTON

 

The City of Trenton requests permission not to make an appointment from the October 7, 2008 certification for Assistant Municipal Clerk (M0844J).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-17   ELECTRONIC SYSTEMS TECHNICIAN 2 (M6522H), OCEAN CITY

 

Ocean City requests permission not to make an appointment from the October 2, 2007 certification for Electronic Systems Technician 2 (M6522H).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-18   PERSONNEL ASSISTANT 4, EMPLOYEE RELATIONS (S0615J), STATEWIDE

 

William Paterson College requests permission not to make an appointment from the April 4, 2008 certification for Personnel Assistant 4, Employee Relations (S0615J), Statewide.

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed no selection costs at this time.

 

B-19   SECRETARIAL ASSISTANT (C1892J), ATLANTIC COUNTY

 

Atlantic County requests permission not to make an appointment from the February 26, 2008 certification for Secretarial Assistant (C1892J).

 

ACTION:     The Civil Service Commission granted the appointment waiver, assessed no selection costs at this time and referred this matter to the Division of Local Human Resource Management for classification review of the employees serving as Secretarial Assistants.

 


B-20   COUNTY CORRECTION OFFICER (S9999D) AND (S9999F), PASSAIC COUNTY

 

The Passaic County Sheriff's Department appeals the determination of the Division of Local Human Resource Management that it did not properly dispose of certification OL081695 for County Correction Officer (S9999D) and (S9999F), Passaic County.

 

ACTION:     The Civil Service Commission directed that the appeal be granted in part and that the names of Dana Daddurno, Jason Heese, Jason Knoskie, Erminio Luciano, and John Sroka be removed from the S9999F list; Claudio Tundo, Shkelqim Mahmuti, and Rubin Gilgorri be appointed from certification OL081695 and be subject to completion of a new 12-month working test period; and the names of Justin Bisconti, James Racanelli, and Richard Wolak be added to the outstanding certification for County Correction Officer OL090570.

The Division of Local Human Resource Management requests that West New York be ordered to return the April 23, 2007 certification (OL070974) of the eligible list for Drug Abuse Counselor (M0729F) for proper disposition.

 

ACTION:     The Civil Service Commission granted the request.

B-22   HUMAN SERVICES SPECIALIST 2 (PC0026G), PASSAIC COUNTY BOARD OF SOCIAL SERVICES

 

The Passaic County Board of Social Services requests the extension of the eligible list for Human Services Specialist 2 (PC0026G).

 

ACTION:     The Civil Service Commission granted the request.

B-23   DALE E. ALEXANDER

 

Dale E. Alexander, a Senior Interviewer (Veterans Services) with the Department of Labor and Workforce Development (DLWD), appeals the determination of the Commissioner, DLWD, finding that he violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.  This matter was held over from the May 13, 2009 Commission Meeting.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

B-24   DANIEL COSGROVE

 

Daniel Cosgrove, a Major with the Division of State Police, Department of Law and Public Safety, represented by Robert A. Mintz, Esq., appeals the determination of the Counsel to the Attorney General, stating that there was probable cause to substantiate a finding that he violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-25   MICHAL GERWEL

 

Michal Gerwel, a former member of the Senior Executive Service, with the Department of Health and Senior Services, appeals the determination of the Commissioner, which found sufficient evidence that the appellant had violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 


B-26   EDWARD HUDAK

 

Edward Hudak, a Construction Official with the Department of Community Affairs (DCA), appeals the determination of the Commissioner, DCA, stating that the appellant did not present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-27   MARIE KAFKA

 

Marie Kafka, a Senior Clerk Transcriber at North Jersey Developmental Center, Department of Human Services (DHS), appeals the determination of the Assistant Commissioner of the DHS, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-28   JERMAINE CURRY

 

Jermaine Curry petitions the Civil Service Commission for reconsideration of the final decision rendered on February 11, 2009, which upheld the removal of his name from the eligible list for Correction Officer Recruit (S9999H), Department of Corrections.  The appellant also appeals the decision of the Division of State Human Resource Management, which upheld the removal of his name from the eligible list for Correction Officer Recruit, Juvenile Justice (S9999H), Juvenile Justice Commission.

 

ACTION:     The Civil Service Commission directed that the request for reconsideration and list removal appeal be denied.

 


B-29   MARIA MENICHELLI

 

The Mercer County Board of Social Services petitions the Civil Service Commission for reconsideration of the final decision rendered on January 14, 2009, which found that Maria Menichelli's position was properly classified as a Secretarial Assistant.

 

ACTION:     The Civil Service Commission directed that the request for reconsideration be denied.

 

B-30   POLICE SERGEANT, CLARK

 

The Township of Clark requests reconsideration of the decision rendered on February 11, 2009, which granted in part its request to transfer the accumulated seniority of Patrick Grady, Antonio Manata, George Marmarou, Thomas Sarnecki, and Brian Soos gained prior to their intergovernmental transfers from other jurisdictions to Clark.  Steven Francisco and Martin Venezio request transfer of their accumulated seniority gained prior to their intergovernmental transfers from other jurisdictions to Clark. 

 

ACTION:     The Civil Service Commission directed that the petition for reconsideration be granted in part and the order granting the retention of accumulated seniority for Antonio Manata and Thomas Sarnecki as Police Officers gained in other jurisdictions prior to their intergovernmental transfer to Clark be vacated.  Further, the request to reduce the three-year continuous permanent service requirement to completion of the working test period for the upcoming promotional announcement for Police Sergeant be referred to the Division of Selection Services for review.  Moreover, the appeals of Steven Francisco and Martin Venezio be dismissed as moot.

B-31   LYDIA LOPEZ

 

Lydia Lopez appeals the decision of the Division of State Human Resource Management that her position is properly classified as Secretarial Assistant 1, Non-Stenographic.  The appellant seeks a Professional Service Specialist 2, Administrative Services classification in this proceeding.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-32   EDGAR SCHMIDT

 

Monmouth County appeals the determination of the Division of Local Human Resource Management that Edgar Schmidt's position is properly classified as a Principal Purchasing Assistant.  The appointing authority seeks a Management Assistant classification in this proceeding.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-33   KENNETH DUNN

 

Deborah L. Dunn appeals the determination of the Division of Classification and Compensation, which denied the claim of her late husband, Kenneth Dunn, a former Assistant Chief, Division of Pensions with the Department of the Treasury, for Supplemental Compensation on Retirement (SCOR) for unused sick leave.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-34   ROBYN JACKSON

 

Robyn Jackson, a former Community Organization Specialist with the City of Newark's Department of Neighborhood and Recreational Services, represented by Clayton Giles, Esq., appeals the determination of her layoff rights by the Division of Local Human Resource Management.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-35   JERSEY CITY REDEVELOPMENT AGENCY

 

The Jersey City Redevelopment Agency, represented by Michael T. Scaraggi, Esq., requests that the Civil Service Commission grant eight current employees of the JCRA permanent status in their respective titles.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 


B-36   RICHARD KIRKLAND

 

Richard Kirkland, a former Water Meter Reader with the City of Newark's Department of Water and Sewer, represented by Clayton Giles, Esq., requests that he be permitted to exercise his lateral title right to the position of Laborer.  He also appeals the determination of his layoff rights by the Division of Local Human Resource Management.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-37   ERIC LIVSEY

 

Eric Livsey, a Community Organization Specialist with the City of Newark's Department of Neighborhood and Recreational Services, represented by Clayton Giles, Esq., appeals the determination of his layoff rights by the Division of Local Human Resource Management.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-38   SAQUANA HAWKINS AND TRINA HOOKS

 

Saquana Hawkins and Trina Hooks, represented by Brett Richter, CWA Local 1039, appeal the decisions of the Division of Selection Services that they did not meet the experience requirements for the open-competitive examination for Technical Assistant 3 Community Affairs (S6980J), Department of Community Affairs.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-39   OTTO KRUPP

 

Otto Krupp appeals the determination of the Division of Selection Services which found that he did not meet the experience requirements for the promotional examination for Social Worker 2 (PS6817P), Juvenile Justice Commission.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-40   SAKERRA NEAL

 

Sakerra Neal, represented by Brett Richter, Staff Representative with CWA Local 1039, appeals the determination of the Division of Selection Services which found her to be below the experience requirements for the open-competitive examination for Technical Assistant 3 Community Affairs (S6980J), Statewide.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-41   ROBERT NELSON

 

Robert Nelson appeals the determination of the Division of Selection Services which found that, per the substitution clause for education, he was below the experience requirements for the open-competitive examination for Fiscal Analyst (S0064K), Statewide.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-42   NEW JERSEY ENVIRONMENTAL MANAGEMENT SYSTEM STAFF CONSOLIDATION EXAMINATION ELIGIBILITY APPEALS, DEPARTMENT OF ENVIRONMENTAL PROTECTION

 

Various employees impacted by the New Jersey Environmental Management System (NJEMS) Staff Consolidation classification action appeal their examination ineligibility: 1) Anne Clevenger appeals the determination of the Division of Selection Services (Selection Services) which found that, per the substitution clause for education, she was below the minimum requirements in experience for the promotional examination for Program Technician (PS6099G), Department of Environmental Protection (DEP); 2) Annette DeBlois and Bonnie Myslinski appeal the determinations of Selection Services which found that, per the substitution clause for education, they were below the minimum requirements in experience for the promotional examination for Program Technician (PS6101G), DEP; 3) Theresa Pagodin appeals the determination of Selection Services which found that she was below the minimum requirements in experience for the promotional examination for Data Processing Analyst 2 (PS5797G), DEP; 4) Russell Polo appeals the determination of Selection Services which found that he was below the minimum requirements in experience for the promotional examination for Data Processing Analyst 2 (PS5791G), DEP; 5) Richard

Gunoskey and Joseph Ludovico appeal the determinations of Selection Services which found that they did not meet the requirements for the promotional examination for Data Processing Analyst 2 (PS4997G), DEP and 6) Nicole Snook appeals the determination of Selection Services which found that, per the substitution clause for education, she was below the minimum requirements in experience for the promotional examination for Technical Support Specialist 2 (PS5792G), DEP.  It is noted that the appeals of Richard Gunoskey and Joseph Ludovico were held over at the December 17, 2008 Commission meeting.

 

ACTION:     The Civil Service Commission directed that these matters be held over.

 

B-43   RAFAEL NIEVES

 

Rafael Nieves appeals the determination of the Division of Selection Services that he did not meet the experience requirement for the promotional examination for Institutional Trade Instructor 1, Warehousing (PS0966I), Department of Corrections.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-44   ERNEST D. NOSEDA, JR.

 

Ernest D. Noseda, Jr., appeals the determinations of the Division of Selection Services that he did not meet the experience requirement for the open competitive examinations for Food Service Supervisor 2 (S0610K) and Assistant Food Service Supervisor 2 (S0609K).

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 


B-45   PROGRAM SUPPORT SPECIALIST 1 (ASSISTANCE PROGRAMS) (PS1697K) AND PROGRAM SUPPORT SPECIALIST 2 (ASSISTANCE PROGRAMS) (PS1698K), DEPARTMENT OF CHILDREN AND FAMILIES

 

Gloria Ajaga, Andrea Arnold, Janice Carter, Dawn Conover, Swapna Das, Melba Espinosa, Beatris Gonzalez, Kristin Huddy, Jennifer Jeffries, Susan (Iglesias) Lagano, Shannon Lain, George Latham, Erica Lewis, Beth Rolax, Diane Ryan, Teresa Scriptunas, Kimyatta Shafer, Lucy Van Iperen, Evelyn Velazquez and Patricia Warren appeal the determinations of the Division of Selection Services (Selection Services) which found that they were below the minimum requirements in experience for the promotional examination for Program Support Specialist 1 (Assistance Programs) (PS1697K), Department of Children and Families.  The above named individuals (not including Ms. Lain, Ms. Ryan, Ms. Shafer, Ms. Van Iperen, and Ms. Warren) and Trashaun Andrews, Gilberte Bourdeau, Janet Cardona, Otilia Gasbarro, Connie Hernandez, Afia Hodges, Deniece Johnson Jackson and Cynthia (Bradshaw) McKeever appeal the determinations of Selection Services which found that they were below the minimum requirements in experience for the promotional examination for Program Support Specialist 2 (Assistance Programs) (PS1698K), Department of Children and Families.

 

ACTION:     The Civil Service Commission directed that the appeals be granted and referred the matter of the review of the job specifications for the Program Support Specialist (Assistance Programs) title series to the Division of Classification and Compensation.

 

B-46   GILBERT REED

 

Gilbert Reed appeals the determination of the Division of Selection Services, which found that he was ineligible for the promotional examination for Police Chief (PM3614J), Asbury Park.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 


B-47   RICHARD FISHER

B-50   POLICE OFFICERS TO SHERIFF'S OFFICERS, GLOUCESTER COUNTY SHERIFF'S OFFICE

 

The Acting Director, Division of Local Human Resource Management, on behalf of the Gloucester County Sheriff's Office, requests that the provisions of N.J.A.C. 4A:4-7.1A be relaxed in order to permit the Intergovernmental Transfers of Police Officers Ronald Borden, Angelina Michener, and Gregory Weber, and Police Lieutenant Stanley Kemp, who will be laid off from the Borough of Swedesboro, a non-Civil Service jurisdiction, to the title of Sheriff's Officer, Gloucester County Sheriff's Office.

 

ACTION:     The Civil Service Commission granted the request.

 

B-51   CODY EVANS

 

Cody Evans, a former Data Processing Technician with the City of Newark's Department of Neighborhood and Recreational Services, represented by Clayton Giles, Esq., appeals the determination of her layoff rights by the Division of Local Human Resource Management.
