A regular meeting of the Merit System Board was held on Wednesday April 26, 2006, in Trenton, New Jersey.

 

PRESENT: Chairman Rolando Torres, Jr., Merit System Board Members, John Currie, Flavella Branham, Margaret E. L. Howard and Robert J. Long; Pamela Ullman, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

 

In accordance with L.1975, c.231, Chairman Rolando Torres Jr., opened the meeting with the following statement:

 

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 12, 2005, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

 

All actions were by unanimous vote unless otherwise specified.

The Merit System Board recorded the recommended changes in the State Classification Plan, copies of which are attached hereto and made a part hereof.

SUBJECT: Change in the State Classification Plan

 

STATE PAROLE BOARD & JUVENILE JUSTICE COMMISSION

 

The State Parole Board recently requested and received permission for the restructuring of the Hearing Officer State Parole Board series. The restructuring involved the renaming of all levels in the series, a change in bargaining unit for two levels, a range change for one level, and the creation of one new title.

 

The range change was required due to the removal of supervisory duties. CWA Local 1039 had not been advised of the requested change, and objected to the adverse impact the range reduction would have on current incumbents, and filed an appeal.

 

To address this, it is requested that a new title be created at the original salary range for existing incumbents only. This title code will be eliminated once all existing incumbents are separated from State service, or are appointed to other titles.

 

The State Parole Board and the appropriate negotiations representatives have agreed to this proposed solution. CWA Local 1039 will withdraw its appeal on approval of this request.

Eileen Mazzei, Sheriff's Officer, County of Middlesex, Sheriff's Department, 30-day suspension on charges of violation of Department rules and regulations pertaining to insubordination and relief from duty.

 

Recommendation of the Administrative Law Judge - Uphold the 30-day

suspension.

 

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a 5-day suspension.

 

A-3 CARLOS PINA

 

Carlos Pina, Police Officer, City of Union City, Department of Public Safety, 12-day suspension on charges of violation of rules and regulations regarding use of force, conduct unbecoming a public employee and other sufficient cause such as domestic violence.

 

Recommendation of the Administrative Law Judge - Reverse the 12-day suspension.

 

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a 10-day suspension.

 

A-4 ALEXANDER JAMES

 

Alexander James, Truck Driver Heavy, City of Asbury Park, Department of Public Maintenance, removal effective March 18, 2005, on charges of insubordination, conduct unbecoming a public employee and other sufficient cause.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

 

A-5 JAMIE MCGORTY

 

Jamie McGorty, Sheriff's Officer, County of Hudson, Sheriff's Department, removal effective March 10, 2005, on charges of conduct unbecoming a public employee and insufficient attendance at training.

 

Recommendation of the Administrative Law Judge - Grant the motion for summary decision and modify the removal to a resignation in good standing.

 

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

 

A-6 TIMOTHY MITCHELL

 

Timothy Mitchell, Correction Sergeant, South Woods State Prison, Department of Corrections, removal effective August 6, 2004, on charges of conduct unbecoming a public employee, neglect of duty, physical or mental abuse of inmates, patient, client, resident, or employee, negligence in performing duty resulting in injury to persons or damage to property, intentional abuse or misuse of authority or position and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION: The Merit System Board directed that this matter be held over.

 

A-7 LONNIE RAILEY

 

Lonnie Railey, a Senior Youth Worker with the Arthur Brisbane Child Treatment Center, Department of Human Services, was removed from his position, effective November 4, 2002, on the charges of neglect of duty and negligence in performing duty resulting in injury to persons.

 

Recommendation of the Administrative Law Judge - Uphold the charges and the removal.

 

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

 

A-8 ALICE WOART

 

Alice Woart, Human Services Assistant, Woodbridge Development Center, Department of Human Services, removal effective March 8, 2005, on the charge of abuse of a client. This matter was held over from the March 22, 2006 Merit System Board meeting.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION: The Merit System Board directed that this matter be remanded to the Office of Administrative Law.

 

A-9 TAMARA HIDALGO

 

Tamara Hidalgo, a Police Officer with the City of Camden, appeals her removal from employment effective October 27, 1998, based on her failure to successfully complete the requisite physical training requirement of the Gloucester County Police Academy.

 

Recommendation of the Administrative Law Judge - Uphold the charges and the removal.

 

ACTION: The Merit System Board modified the removal to a resignation in good standing.

 

A-10 JENNIFER MORTIMER

 

Jennifer Mortimer, County Correction Officer, Burlington County Jail, removal effective June 7, 2005, on charges of chronic or excessive absenteeism or lateness, time and attendance policy, and resignation not in good standing. This matter was held over from the April 5, 2006 Merit System Board meeting.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge and reversed the removal, granted a new working test period and awarded back pay and counsel fees.

William Burke, Jr., a Police Captain with Atlantic City, appeals the decision of Human Resource Information Services which upheld the bypass of his name on the promotional list for Deputy Police Chief (PM3527F), Atlantic City.

B-32 PATRICIA GEORGE

Patricia George, a County Correction Officer with Essex County, represented by Ciro A. Spina, III, Esq., petitions the Merit System Board for interim relief of her immediate suspension, commencing on September 6, 2005, pending a department hearing.

ACTION: The Merit System Board granted back pay from October 6, 2005 to the date the departmental hearing is initiated.

Carmelo Lio, a Senior Correction Officer at the Adult Diagnostic and Treatment Center, Department of Corrections, appeals the determination of the Acting Director, Equal Employment Division, with the DOC, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.

B-35 MA’RITA SAUNDERS

Ma’Rita Saunders, a Supervisor of Professional Residential Services, Developmental Disabilities, with Vineland Developmental Center, Department of Human Services, appeals the determinations of the Director of the Equal Employment Opportunity Office and the Assistant Commissioner for Human Resources stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace. The appellant further appeals a five day suspension on a sustained charge of neglect of duty which the appellant contends was imposed in retaliation for the appellant’s filing of a discrimination complaint.

ACTION: The Merit System Board directed that these appeals be denied.

B-36 CHARLES BILLINGTON

The appointing authority petitions the Merit System Board for reconsideration of the final decision rendered on December 7, 2005, which granted sick leave injury (SLI) benefits to Charles Billington, a Correction Sergeant at South Woods State Prison, Department of Corrections, from April 5, 2005 through April 26, 2005 and from May 4, 2005 through May 13, 2005.

ACTION: The Merit System Board denied the request.

B-37 IN THE MATTER OF OPEN COMPETITIVE LISTS FOR FIRE FIGHTER (M2303E AND M2304E), TOWNSHIP OF WINSLOW

The Township of Winslow petitions the Merit System Board for reconsideration of that portion of the decision, rendered on February 22, 06, in which the Board extended the open-competitive lists for Fire Fighter (M2303E and M2304E).

ACTION: The Merit System Board granted the request.

B-38 KENNETH HILL

The Department of Human Services petitions the Merit System Board for reconsideration of the Board’s decision rendered on November 3, 2005 which reversed the 20-day suspension of Kenneth Hill, a Supervising Medical Security Officer with the Ann Klein Forensic Center, Department of Human Services.

ACTION: The Merit System Board granted the request for reconsideration but affirmed the prior Board decision.

B-39 ELLEN SIMPSON

Ellen Simpson, a Principal Account Clerk with the Atlantic City Housing Authority, represented by Rachel L. Merrill, Senior Staff Representative, CWA Local 1034, petitions the Merit System Board for reconsideration of the administrative determination, rendered March 1, 06, by the Director of Merit System Practices and Labor Relations, denying her request for a hearing concerning the appeal of her 10-day suspension, due to the untimely filing of her appeal pursuant to N.J.S.A. 11A:2-15 and N.J.A.C. 4A:2-2.8.

ACTION: The Merit System Board granted the request for reconsideration.

B-40 DEBORA TORRES

Debora Torres petitions the Merit System Board for reconsideration of its decision rendered on November 22, 2005 which found that she did not meet the experience requirements for the promotional examination for Administrative Analyst 1 (PS3341K), Division of Youth and Family Services.

ACTION: The Merit System Board granted the request for reconsideration.

 

B-41 DANIEL MCCONNELL

The appeal of Daniel McConnell, a Police Officer with the Township of Parsippany-Troy Hills Police Department, of his 20-day suspension on charges, was heard by Administrative Law Judge Irene Jones, who rendered her initial decision on February 22, 06. At its meeting on April 5, 06, the Merit System Board did not adopt the ALJ’s recommendation to uphold the 20-day suspension. Rather, the Board increased the penalty from a 20-day suspension to a 30-day suspension. The proposed final decision is now submitted for the Board’s review.

ACTION: The Merit System Board adopted the final decision.

B-42 NANCY BROGLIE

Thomas Edison State College requests that Nancy Broglie be permitted to file a late application for the Statewide open-competitive examination for the title of Accountant 3 (S0420G).

ACTION: The Merit System Board denied the request.

B-43 VALERIE FERRIS

Monmouth County petitions the Merit System Board for a retroactive permanent appointment date for Valerie Ferris, Senior Clerk Typist.

ACTION: The Merit System Board directed that the petition be granted.

B-44 KEVIN GEORGE

The Superior Court of New Jersey, Appellate Division has vacated the Merit System Board decision reversing the removal of Kevin George and remanded the matter to the Board for further proceedings consistent with its decision. See Kevin George v. City of Newark, __N.J. Super.__ (App. Div. 06).

ACTION: The Merit System Board remanded the matter to the Office of Administrative Law.

 

 

 

B-45 JOSEPH HOFFMAN

The City of Camden, on behalf of Joseph Hoffman, requests that his resignation be rescinded and seeks his eligibility for the promotional examination for Police Sergeant (PM2650G), City of Camden.

ACTION: The Merit System Board granted the request.

B-46 POLICE OFFICER, PALISADES INTERSTATE PARK COMMISSION

The Palisades Interstate Park Commission requests the reallocation of the title of Police Officer, Palisades Interstate Park, from the career to the unclassified service, pursuant to N.J.S.A. 32:14-21. On January 25, 06, the Board conducted a public hearing in accordance with N.J.S.A. 11A:3-6. This matter was held over for consideration of the comments presented at the public hearing and the subsequent written submissions of the parties.

The appeal of Lawrence Simmons, a former Supervising Code Enforcement Officer with the City of Newark, of his demotion to the position of Senior Code Enforcement Officer, effective April 22, 1999, on charges, was heard by Administrative Law Judge Richard McGill, who rendered his initial decision on February 22, 06. At its meeting on April 5, 06, the Merit System Board adopted the recommendation of the ALJ to modify the demotion to a fine of pay equal to a 15-day suspension. Gorman, who rendered his initial decision on March 2, 06.
