A regular meeting of the Merit System Board was held on Wednesday July 19, 2006, in Trenton, New Jersey.

PRESENT: Chairman Rolando Torres, Jr., Merit System Board Members, John Currie, Flavella Branham, and Robert J. Long; Pamela Ullman, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairman Rolando Torres Jr., opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on July 12, 2006 and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.

The Merit System Board recorded the recommended changes in the State Classification Plan, copies of which are attached hereto and made a part hereof.

GENERAL TITLE

Rowan University has requested the addition of a new work year for the title of Nurse Practitioner, to staff a position in the student health center, working 10 months out of the year. This proposed variant on the existing 12 month title is requested due to the university’s significant drop in health service utilization in the summer.

A Nurse Practitioner may initiate laboratory and other diagnostic tests, and prescribe or order devices and medications which are not controlled dangerous substances, under his/her own signature. The Nurse Practitioner is needed to provide quality health services to students, while reducing the costs associated with physician care.

Negotiations representatives have been notified and support the establishment of this title.

Michael Anton, Safety Specialist 1, Motor Vehicle Commission, 30-day suspension on the charge of insubordination.

Recommendation of the Administrative Law Judge – Modify the 30-day suspension to a 15-day suspension.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to uphold the 30-day suspension.

A-3 TONY MACK

Tony Mack, Municipal Recycling Coordinator, City of Trenton, Department of Public Works, appeals the good faith of his layoff effective December 8, 2004, for reasons of economy and efficiency.

Recommendation of the Administrative Law Judge – Reverse the layoff.

ACTION: The Merit System Board directed that this matter be held over.

A-4 RENEE MEYERS

Renee Meyers, Building Maintenance Worker, County of Hudson, Department of Public Resources, 30-day suspension on charges of insubordination and conduct unbecoming a public employee. It is noted that 10 of the 30 days were held in abeyance for six months and were never served.

Recommendation of the Administrative Law Judge – Modify the penalty to a 15-day suspension.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to uphold a 20-day suspension.


A-5 JESUS ORTIZ

Jesus Ortiz, Senior Correction Officer, New Jersey State Prison, Department of Corrections, 30-day suspension on the charge of neglect of duty.

Recommendation of the Administrative Law Judge – Reverse the 30-day suspension.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-6 JOSE ROSADO, JR.

Jose Rosado, Jr., Police Officer, City of Newark, Police Department, 90-day suspension on charges of violation of Department rules regarding accessibility to department surgeons and superior officers and neglect of duty.

Recommendation of the Administrative Law Judge – Modify the 90-day suspension to a 15-day suspension.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a 60-day suspension.

A-7 CHRISTIAN COFONE (REMAND)

Christian Cofone, Police Officer, Township of Middletown, Department of Public Safety, removal effective June 23, 2003, on charges of violations of various Police Department rules and regulations, including, inter alia, obedience to laws and rules, prohibited activity on duty, and rules of personal conduct, conduct unbecoming a public employee and other sufficient cause.

Recommendation of the Administrative Law Judge – Uphold the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.


A-8 CARMEN COLON (REMAND)

Carmen Colon, Police Officer, City of Camden, Police Department, removal effective May 11, 2004, on charges of conduct unbecoming a public employee, other sufficient cause and violation of various Police Department rules.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-9 KAREN JENKINS

Karen Jenkins, Senior Correction Officer, South Woods State Prison, Department of Corrections, removal effective March 23, 2004, on charges of conduct unbecoming a public employee, safety and security precautions, improper or unauthorized contact with inmate and undue familiarity with inmates, parolees, their families, or friends.

Recommendation of the Administrative Law Judge - Reverse the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-10 VICTOR ONWUZURUIKE

Victor Onwuzuruike, Senior Security Guard, Newark School District, removal effective May 3, 2004, on charges of insubordination, chronic or excessive absenteeism or lateness, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

Recommendation of the Administrative Law Judge – Reverse the removal.

ACTION: The Merit System Board directed that this matter be held over.


A-11 WILLIAM GREENE

William Greene, Human Services Assistant, New Lisbon Developmental Center, Department of Human Services, removal effective November 8, 2004, on the charge of physical abuse of a client. This matter was held over from the June 7, 2006 Merit System Board meeting.

Recommendation of the Administrative Law Judge – Reverse the removal.

ACTION: The Merit System Board directed that this matter be held over.

Raheema Battles appeals the removal of her name from the (S9999F) eligible list for the title of County Correction Officer, County of Essex on the basis of psychological unfitness.

Juliemarie Forte, represented by Benjamin Benson, Esq., appeals her rejection as a County Correction Officer candidate by the County of Ocean and its request to remove her name from the eligible list for County Correction Officer (S9999D) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal be denied.

B-19 POLICE SERGEANT (PM2547C AND PM2505G), CITY OF ATLANTIC CITY

Edward Pollock, Jerry Barnhart, Joseph Falcone, Gregory Stites, Lee Hendricks, and Harold Cooper, Police Officers with the City of Atlantic City, represented by Mary Beth Clark, Esq., appeal the determination of the Division of Selection Services, which denied the appointing authority’s request to certify the Police Sergeant (PM2547C), City of Atlantic City, eligible list. Angelo Maimone and Vincent DeMaria, Police Officers with the City of Atlantic City, object to the certification of the Police Sergeant (PM2547C) eligible list and appeal the cancellation of the February 14, 2006 certification of the Police Sergeant (PM2505G), City of Atlantic City, eligible list.

ACTION: The Merit System Board granted the request for certification of the eligible list for Police Sergeant (PM2547C), City of Atlantic City, but directed that the appeals of Angelo Maimone and Vincent DeMaria be denied.

B-20 REGULATORY OFFICER 1 (S3034F), DEPARTMENT OF HEALTH AND SENIOR SERVICES

The appointing authority requests permission not to make an appointment from the certification for Regulatory Officer 1 (S3034F), Department of Health and Senior Services.

ACTION: The Merit System Board granted the request for appointment waiver and directed that the selection costs be presently deferred.

B-21 BENEDICTA SATIAH

Benedicta Satiah, a Technical Assistant 1 with the Department of Treasury, appeals the determination of the Affirmative Action Office, which found that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

ACTION: The Merit System Board directed that this appeal be denied.


B-22 GREGORY KATSEYEANIS

Gregory Katseyeanis, a Police Officer with the City of Union City, represented by Merick H. Limsky, Esq., petitions the Merit System Board for interim relief of his demotion, effective April 20, 2006.

ACTION: The Merit System Board denied the request.

B-23 JOSEPH W. SCOTT

Joseph W. Scott, a County Correction Officer with Essex County, represented by Ciro A. Spina, III, Esq., petitions the Merit System Board for interim relief of his immediate suspension on or about November 5, 2005.

ACTION: The Merit System Board granted back pay from November 4, 2005 through January 12, 2006.

B-24 BIRDIE CODY

Donna Nelson-Lee, Director, Division of Human Resources, Atlantic County, requests that Birdie Cody be permanently appointed to the title of Chief, Administrative Services.

ACTION: The Merit System Board denied the request.

B-25 SHANTHA SHASHIDHARA

Shantha Shashidhara, a Research Scientist 2 with the Department of Environmental Protection, represented by Adam Liebtag, CWA Local 1034, appeals the determination to place her on step eight of salary range P28, rather than step nine, upon her appointment from the special reemployment list for Research Scientist 2.

ACTION: The Merit System Board directed that this appeal be denied.


B-26 RICHARD BAILEY

Richard Bailey, a former Claims Adjudicator Trainee, Disability Determinations with the Department of Labor and Workforce Development, petitions the Merit System Board for reconsideration of the administrative determination, rendered December 19, 2005, by the Director of Merit System Practices and Labor Relations, denying his request for a hearing concerning the appeal of his release at the end of his working test period, due to the untimely filing of his appeal pursuant to N.J.S.A. 11A:2-6(a)4 and N.J.A.C. 4A:2-4.2.

ACTION: The Merit System Board denied the request for reconsideration.

B-27 DINA FANCHER

Dina Fancher, a County Correction Officer with Monmouth County, represented by Charles J. Sciarra, Esq., petitions the Merit System Board for reconsideration of the administrative determination, rendered January 17, 2006, by the Director of Merit System Practices and Labor Relations, denying her request for a hearing concerning the appeal of a 10-day suspension effective October 1, 2005, due to the untimely filing of her appeal pursuant to N.J.S.A. 11A:2-15 and N.J.A.C. 4A:2-2.8.

ACTION: The Merit System Board granted the request for reconsideration.

B-28 LILIAN FOSTER

Lillian Foster requests reconsideration of the final decision of the Merit System Board rendered on October 19, 2005, which upheld the removal of her name from the Right of Way Negotiator (S6736F) and Right of Way Negotiator Trainee (S6737F), Department of Transportation, eligible lists due to an unsatisfactory employment record.

ACTION: The Merit System Board denied the request for reconsideration.


B-29 POLICE SERGEANT AND POLICE LIEUTENANT, TOWNSHIP OF LONG BEACH

The Township of Long Beach petitions the Merit System Board for reconsideration of the final decision, rendered on June 7, 2006, which denied its request for a postponement of the Police Sergeant and Police Lieutenant, Township of Long Beach, promotional examinations.

ACTION: The Merit System Board granted the request for reconsideration.

B-30 JOHN HERRMANN

John Herrmann, represented by Daniel Zirrith, Esq., petitions the Merit System Board for reconsideration of the decision rendered on January 11, 2006 which found that he was below the minimum requirements in experience for the qualifying examination for Electronic Systems Technician 1, Bergen County Utilities Authority.

ACTION: The Merit System Board denied the request, but directed that the classification matter be referred to the Division of Human Resource Management.

B-31 ANTHONY RENIERI

Anthony Renieri, a former Senior Correction Officer with the Juvenile Justice Commission, Department of Law and Public Safety, represented by Charles J. Sciarra, Esq., petitions the Merit System Board for reconsideration of the administrative determination, rendered December 20, 2005, by the Director of Merit System Practices and Labor Relations, denying his request for a hearing concerning the appeal of his removal from employment effective September 7, 2004, due to the untimely filing of his appeal pursuant to N.J.S.A. 11A:2-15 and N.J.A.C. 4A:2-2.8.

ACTION: The Merit System Board denied the request for reconsideration.

B-32 ADAM BERGER

Adam Berger, represented by Patrick J. Caserta, Esq., and the County of Passaic, petition the Merit System Board for acknowledgement of the settlement agreement reached by the parties, which provides for Berger’s restoration on the County Correction Officer (S9999D), County of Passaic, eligible list.

ACTION: The Merit System Board acknowledged the settlement.

B-33 PETRA M. JAMES

The appeal of Petra M. James, a Senior Parole Officer with the State Parole Board, of her four removals, effective May 2, 2002, May 2, 2002, June 4, 2002, and June 14, 2002, on charges, was heard by Administrative Law Judge Maria Mancini La Fiandra, who rendered her initial decision on April 20, 2006. At its meeting on June 21, 2006, the Merit System Board adopted the ALJ’s recommendation to uphold the appellant’s removal. The proposed final decision is now submitted for the Board’s review.

ACTION: The Merit System Board adopted the final decision.

Raymond Bukowski appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for a lateral title change to Principal Environmental Specialist (Coastal Resources), Department of Environmental Protection.

Elizabeth L. Coupe, Linda G. Cheston, Renee C. Jenkins, and Pela K. Gore-Watts appeal the determination of the Division of Selection Services which found that they did not meet the requirements for the promotional examination for Program Development Specialist 2 (PS5715D), Division of Housing, Department of Community Affairs.

ACTION: The Merit System Board directed that these appeals be denied, and directed that an audit be conducted of the duties performed by Linda G. Cheston and Renee C. Jenkins to determine their correct classification.

Shantesia Crawford appeals the determination of the Division of Selection Services which found that she did not meet the experience requirements for the open competitive examination for Administrative Analyst (M6143G), City of Newark.

ACTION: The Merit System Board directed that this appeal be denied.

B-42 DENNIS DESALVO AND RUTH STEINRUCK

Dennis DeSalvo and Ruth Steinruck appeal the determination of the Division of Selection Services, which found that they did not meet the experience requirements for the open competitive examination for Program Development Specialist 1, Corrections (S6831G).

ACTION: The Merit System Board granted $26,047.43 in back pay and $10,625.08 in reimbursement for healthcare premiums. The Board also granted payment for 2005 and prorated 2006 vacation leave.

Submitted for the Board’s review are Salary Regulations for Fiscal Year 2007.
