A regular meeting of the Merit System Board was held on Wednesday December 6, 2006, in Trenton, New Jersey.

Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 12, 2005, and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.
The Merit System Board recorded the recommended changes in the State Classification Plan, copies of which are attached hereto and made a part hereof.

ESTABLISHMENT OF COMMON TITLE
We request the title, Supervisor Information Technology (61454), be made common for local government use.
The Division of Human Resource Management conducted a classification audit of the current duties performed by an incumbent in Monmouth County in order to determine an appropriate title. The audit determined that the title of Supervisor Information Technology best reflects the duties performed by the incumbent.

NEW TITLE- OFFICE OF HOMELAND SECURITY & PREPAREDNESS
Governor Corzine’s Executive Order # 5 ( March 16, 2006) authorizes the creation of a new title, Director, Office of Homeland Security and Preparedness.
The Director, who will serve as a member of the Cabinet, is the Governor’s principal advisor on homeland security issues. The primary function of this position is to administer, coordinate, lead, and supervise New Jersey’s counter terrorism and preparedness efforts as head of the Office of Homeland Security and Preparedness. As such, it is appropriate that this title be allocated to the unclassified service.
Since the Office of Homeland Security and Preparedness is in, but not of, the Department of Law and Public Safety, the new title will be assigned exclusively to the Department of Law and Public Safety.

Recommendation of the Administrative Law Judge – Dismiss with prejudice the appeal of the 62-day suspension and uphold the 10-day, 20-day and 90-day suspensions.

William Pearn, Institutional Attendant, County of Sussex, Department of Health, resignation not in good standing effective January 18, 2005, on the charge of job abandonment. This matter was held over from the November 1, 2006 Merit System Board meeting for further review.

Russell Strother, Firefighter, City of East Orange, Fire Department, 90-working day suspension, on charges of conduct unbecoming a public employee, other sufficient cause and violation of rules and regulations regarding the drug and alcohol policy.
Recommendation of the Administrative Law Judge – Modify the 90-working day suspension to a 60-working day suspension.
ACTION: The Merit System Board reversed the recommendation of the Administrative Law Judge to uphold the 90-working day suspension.
A-11 MICHAEL C. BROWN
Michael C. Brown, County Correction Officer, County of Monmouth, Department of Corrections and Youth Services, removal effective July 22, 2004, on charges of a violation of the County substance abuse policy and conduct unbecoming a public employee.
Recommendation of the Administrative Law Judge – Uphold the removal.
ACTION: The Merit System Board remanded the matter to the Office of Administrative Law.

Tony Mack, Municipal Recycling Coordinator, City of Trenton, Department of Public Works, appeals the good faith of his layoff effective December 8, 2004, for reasons of economy and efficiency. This matter was held over from the July 19, 2006 Merit System Board meeting for summary of testimony.
Recommendation of the Administrative Law Judge – Reverse the layoff.
ACTION: The Merit System Board reversed the recommendation of the Administrative Law Judge to uphold the layoff.

Angela Powell, a Senior Correction Officer with the Department of Corrections (DOC), appeals the decision of the Acting Director, Equal Employment Division (EED), with the DOC, stating that the appellant failed to present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment or Hostile Environments in the Workplace.

Nicole Baldwin, a County Correction Officer with Mercer County, represented by Stuart J. Alterman, Esq., requests that the Merit System Board reinstate the appeals of her 20-day and 10-day suspensions, which were dismissed based on her failure to appear at the settlement conference.

Mark Competello, a Police Sergeant with the City of Hoboken, represented by Catherine M. Elston, Esq., petitions the Merit System Board for interim relief of his disciplinary demotion from the title of Police Lieutenant, pending the outcome of his appeal on the merits.

The Department of Corrections appeals the decision of the Division of Human Resource Information Services which found that Correction Officer Trainees who attend the Correction Officer Training Academy with immediate prior State service incur a break in service for purposes of vacation accrual.

The Department of Corrections requests reconsideration of the final administrative decision, rendered on May 10, 2006, granting Richard Mosco’s request for sick leave injury (SLI) benefits.
ACTION: The Merit System Board granted the request for reconsideration, but affirmed the prior decision granting Mosco’s appeal and awarding SLI benefits.

Jose Rosado, a Police Officer with the City of Newark, represented by Anthony J. Fusco, Jr., Esq., requests reconsideration of the final decision of the Merit System Board, rendered July 19, 2006, which modified the petitioner’s 90-day suspension, beginning October 1, 2004, to a 60-day suspension.

Sukovich, who rendered her initial decision on June 8, 2006. At its meeting on November 15, 2006, the Merit System Board did not adopt the ALJ’s recommendation to acknowledge the terms of the settlement agreement reached by the parties. Rather, the Board dismissed the appeal for lack of jurisdiction. The proposed final decision is now submitted for the Board’s review.
