    A regular meeting of the Civil Service Commission was held on Wednesday, October 21, 2015, in Trenton, New Jersey.

 

            PRESENT: Robert M. Czech, Chairperson, Members Thomas J. Perna and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Appeals and Regulatory Affairs.

 

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2014, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Robert Connizzo, Fire Alarm Operator, Grounds, Paterson Fire Department, removal.

 

Regina DiFiore, Supervising Public Safety Telecommunicator, Burlington County, Department of Public Safety Services, removal.

Recommendation of the Administrative Law Judge - Uphold the 10 working day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge

 

A-3      CHARLES HACKLEY

 

Charles Hackley, Senior Building Maintenance Worker, Montclair State University, removal effective October 23, 2014, on charges of conduct unbecoming a public employee and violation of a last chance agreement.

 

Recommendation of the Administrative Law Judge - Grant motion for summary decision and uphold the removal.

 

ACTION:       The Civil Service Commission directed that this matter be held.

 

A-4      KAYODE LASEKAN

 

Kayode Lasekan, Human Services Technician, Ancora Psychiatric Hospital, Department of Human Services, removal effective August 5, 2014, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5      MARK TORSIELLO (CONSOLIDATED)  (A written decision will be posted in this matter when the Civil Service Commission adopts the decision at                                                                              a future meeting.)

 

Mark Torsiello, Mechanic, Township of Nutley, Department of Public Works, 60 working day suspension, demotion to Truck Driver, and removal effective November 4, 2011, on charges of conduct unbecoming a public employee.

 

Recommendation of the Administrative Law Judge - Uphold the removal and award back pay for the period of the appellant's immediate suspension.  

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge to uphold the removal but did not grant back pay.

 

A-6      PAUL WILLIAMS  (A written decision will be posted in this matter when the Civil Service Commission adopts the decision at a future meeting.)

 

Paul Williams, Human Services Assistant, Greystone Park Psychiatric Hospital, Department of Human Services, removal effective July 6, 2013, on charges of mental abuse of a patient, mistreatment of a patient, conduct unbecoming a public employee, neglect of duty, violation of hospital policy and procedure, and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Modify the removal to a six-month suspension.

 

ACTION:       The Civil Service Commission rejected the recommendation of the Administrative Law Judge and upheld the removal.

 

SECTION B - MISCELLANEOUS MATTERS

 

B-1      SEDINA YOUNG - CSC DOCKET NO. 2015-3286

 

Sedina Young appeals her rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove her name from the eligible list for Correction Officer Recruit (S9988R) on the basis of a positive drug test.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-2      ANGELIQUE COLLAZO - CSC DOCKET NO. 2015-1332

 

Angelique Collazo, represented by Mark D. Laderman, Esq., appeals the decision of the Division of Classification and Personnel Management, which upheld the removal of her name from the special reemployment list for Police Officer, City of Trenton, due to the falsification of her employment application.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-3      ROBIN DAGHLIAN CURASCO - CSC DOCKET NO. 2016-555

 

Robin Daghlian Curasco appeals the determination of the Division of Agency Services upholding the removal of her name from the eligible list for Public Safety Telecommunicator, Bergen County (CO651R), on the basis of falsification of her application.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-4      LAURA CALCESE - CSC DOCKET NO. 2015-3050

 

Laura Calcese appeals the decision of the Division of Agency Services that the proper classification of her position with the Motor Vehicle Commission is Building Services Coordinator 3.  The appellant seeks a Building Management Services Specialist 4 classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

 

B-5      KATHRYN OZOL - CSC DOCKET NO. 2016-618

 

Kathryn Ozol appeals the decision of the Divison of Agency Services that the proper classification of her position with the Department of the Treasury is Pensions Benefits Specialist 3.  The appellant seeks a classification of Pensions Benefits Specialist 2.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-6      EDWARD BYRNES - CSC DOCKET NO. 2016-712

 

The Division of Agency Services, on behalf of Brick Township, requests that Edward Byrnes' out-of-title work experience be accepted as qualifying experience for the title Sign Maker 2.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-7      DANIEL SANTANIELLO - CSC DOCKET NO. 2016-709

 

The Division of Agency Service, on behalf of Brick Township, requests that Daniel Santaniello's out-of-title work experience be accepted as qualifying experience for the title Recreation Supervisor.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-8      KYLE SCARPELLI - CSC DOCKET NO. 2016-711

 

The Division of Agency Services, on behalf of Brick Township, requests that Kyle Scarpelli's out-of-title work experience be accepted as qualifying experience for the title Technician Management Information Systems..

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-9      SARAH SCARPELLI - CSC DOCKET NO. 2016-710

 

The Division of Agency Services, on behalf of Brick Township, requests that Sarah Scarpelli's out-of-title work experience be accepted as qualifying experience for the title Senior Personnel Assistant.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-10    MONICA SCARBOROUGH - CSC DOCKET NO. 2016-720

 

Monica Scarborough appeals her score that was below the minimum rating in Written Part 1 for the open competitive examination for Correction Officer Recruit (S9988T), Statewide.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-11    MICHAEL ZAPOLSKI - CSC DOCKET NO. 2016-1204

 

Michael Zapolski appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the open-competitive examination for Institutional Trade Instructor 1 Food Processing (S0365T), Statewide.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-12    JODIE KLOSEK - CSC DOCKET NO. 2016-571

 

Jodie Klosek appeals the determination of the Division of Agency Services that she was below the minimum requirements in experience for the promotional examination for Keyboarding Clerk 3 (PM0182T), Sayreville.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-13    MAUREEN O'ROURKE - CSC DOCKET NO. 2016-948

 

Maureen O'Rourke appeals the determination of the Division of Agency Services which found that she did not meet the experience requirements for the open-competitive examination for Administrative Analyst 2 Procurement (S0152T), Statewide.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-14    DANIELLE BENNETT - CSC DOCKET NO. 2016-1343

 

Danielle Bennett appeals the determination of the Division of Agency Services which found that she did not meet the experience requirements for the open-competitive examination for Social Work Supervisor 3 Secured Facilities (S0375T), Statewide.

 

ACTION:       The Civil Service Commission directed that this matter be held.

 

B-15    HANSA MEHTA - CSC DOCKET NO. 2015-3086

 

Hansa Mehta appeals the determination of the Division of Agency Services which found that she did not meet the education requirements for the open competitive examination for Human Services Specialist 1 (C0112T), Union County.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-16    CHRISTIAN HAMILTON - CSC DOCKET NO. 2016-628

 

Christian Hamilton appeals his score for the oral portion of the examination for the second level Fire Captain (PM1133S), Nutley.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-17    CARL GRIFFIN SR. - CSC DOCKET NO. 2016-728

 

Carl Griffin Sr. appeals his score for the oral portion of the examination for the second level Fire Captain (PM1128S), Long Branch.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-18    JOSEPH CAVANAGH - CSC DOCKET NO. 2016-748

 

Joseph Cavanagh appeals his seniority score and score for the oral portion of the examination for the second level Fire Captain (PM1121S), Harrison.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-19    JAMES COPONI - CSC DOCKET NO. 2016-813

 

James Coponi appeals his score for the oral portion of the examination for the second level Fire Captain (PM1102S), Belleville.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

Joseph Lang III, represented by Brian Kincaid, Esq., appeals his score for the oral portion of the examination for the second level Fire Captain (PM1121S), Harrison.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-21    BUILDING INSPECTOR APPRENTICE - CSC DOCKET NO. 2016-1306

 

The Division of Agency Services recommends the reallocation of the Building Inspector Apprentice title to the non-competitive division of the career service in accordance with N.J.A.C. 4A:3-1.2.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-22    NUTRITION PROGRAM SPECIALIST APPRENTICE - CSC DOCKET NO. 2016-1340

 

The Division of Agency Services recommends the creation of the non-competitive title of Nutrition Program Specialist Apprentice.  Agency Services also recommends the inactivation of the Chief, Bureau of Food Distribution Program title.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-23    ALFRED GUZZI JR. - CSC DOCKET NO. 2016-631

 

Alfred Guzzi Jr. appeals his score for the oral portion of the examination for the second level Fire Captain (PM1128S), Long Branch.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-24    JOSEPH LYGA - CSC DOCKET NO. 2016-836

 

Joseph Lyga appeals his score on the examination for Deputy Fire Chief (PM1693S), Bayonne.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

Douglas Ahlquist, Sandy Alvarez, Roberto Aravena, Kyle Branch, Lance Brossa, Kevin Carter, Christopher Conti, Stephen Foster, Bryan Fusaro, Robert Hoehman, Justin Kijowski, Mark Littles, Michael Marrero, Frank Martinez, Jose Martinez, Donald McGee, Kim McIntosh-Smith, Andrew Merola, Anna Miglio, Teofilo Moreno, Allison Oliver, Richard Orne, Daniel Ortiz, Jason Polner, Savador Russomano, Thomas Scott, David Soto, Mark Stepniewski, Daniel Wilson and Thananya Wooden appeal the written examination for Correction Sergeant (PS9466I), Department of Corrections.

 

ACTION:       The Civil Service Commission directed that these appeals be denied.

 

B-26    FELIX RIVERA AND BRUCE CORNISH - CSC DOCKET NO. 2016-313 AND 2016-324

 

Felix Rivera and Bruce Cornish, Police Officers with the City of Millville, represented by Michael L. Testa, Esq., petition the Civil Service Commission for interim relief of their immediate suspensions without pay.

 

ACTION:       The Civil Service Commission directed that these petitions be denied.

 

B-27    D.W. - CSC DOCKET NO. 2016-629

 

D.W., a Court Executive 2A with the Judiciary, requests that she be permitted to use donated leave on an intermittent basis.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-28    SUSAN TRAVERS-MCBRIDE - CSC DOCKET NO. 2016-860

 

The Motor Vehicle Commission (MVC) requests a relaxation of N.J.A.C. 4A:4-5.2(e) in order to recalculate the working test period of Susan Travers-McBride, a Compliance Officer 1, MVC.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-29    S.M. - CSC DOCKET NO. 2015-1304

 

S.M., a Senior Correction Officer with the Department of Corrections (DOC), appeals the determination of the Commissioner, DOC, which found that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that one allegation be remanded for further investigation, but the remainder of the appeal be denied.

 

B-30    O.O. - CSC DOCKET NO. 2015-2291

 

O.O., a Charge Nurse, 12 months, with the Department of Human Services, represented by Bruce L. Sobel, Esq., appeals the determination of the Office of Equal Employment Opportunity, which found sufficient evidence that the appellant had violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-31    LEE SILVERMAN - CSC DOCKET NO. 2015-2798

 

Lee Silverman, represented by Brian J. Manetta, Esq., appeals the decision of the Division of Agency Services, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Sheriff's Officer (S9999R), Union County eligible list on the basis of an unsatisfactory background report, an unsatisfactory driving record, and falsification of the employment application.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-32    A.M. - CSC DOCKET NO. 2015-2316

 

A.M., a former Human Services Assistant, Department of Human Services, Woodbine Developmental Center, appeals the decision of the Director, Office of Equal Employment Opportunity, which found sufficient evidence to support a finding that she violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-33    CIVIL SERVICE COMMISSION MINUTES

 

Submitted for adoption are the Civil Service Commission minutes of its meeting of October 7, 2015.

 

ACTION:       The Civil Service Commission adopted the minutes of its meeting on October 7, 2015.

 

B-34    DAXTON CANALES - CSC DOCKET NO. 2016-1022

 

The parties request that the Civil Service Commission acknowledge the attached settlement reached between Daxton Canales, represented by Timothy J.P. Quinlan, Esq., and the Township of Pennsauken, which provides for Canales' appointment as a Police Officer.

 

            ACTION:       The Civil Service Commission acknowledged the settlement.

 

B-35    SUNG M. CHO - CSC DOCKET NO. 2015-3256

 

Sung M. Cho requests that the provisions of N.J.A.C. 4A:6-3.4(a), which govern the time period in which employees must file an application for Supplemental Compensation on Retirement (SCOR), be relaxed to permit him to submit a late application for SCOR benefits.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-36    MARGARET MATEJIK - CSC DOCKET NO. 2016-1440

 

Margaret Matejik appeals the determination of the Division of Agency Services which found that, per the substitution clause for education, she was below the minimum requirements in experience for the promotional examination for Personnel Assistant 2 (PS0800U), Office of Information Technology.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-37    FORTUNATO MONTELLA - CSC DOCKET NO. 2015-2541

 

The appeal of Fortunato Montella, a Police Officer with the Borough of Stanhope, of his removal, effective February 25, 2015, on charges, was heard by Administrative Law Judge Gail M. Cookson, (ALJ), who rendered her initial decision on September 11, 2015.  At its meeting on October 7, 2015, the Civil Service Commission (Commission) did not adopt the ALJ's recommendation to modify the removal to a 60 working day suspension and award 80% counsel fees.  Rather, the Commission imposed a 120 working day suspension and denied counsel fees.  The proposed decision is now submitted for the Commissions review.

 

            ACTION:       The Civil Service Commission adopted the decision.

 

B-38    CRAIG AUGUSTONI, ET AL. - CSC DOCKET NO. 2016-1404

 

Craig Augustoni, Michael Gallagher, David Hughes, James McFadden, Bruce Tynan, and Timothy Weiss, represented by Nicole M. Sharpe, Communications Workers of America, Local 1039 (CWA), appeal and request a stay of the attached decisions of the Division of Agency Services (Agency Services) that the proper classification of their positions with the Department of Community Affairs is Senior Planner, Emergency Management Fire. The appellants seek Principal Planner, Emergency Management Fire classifications. 

 

ACTION:       The Civil Service Commission directed that these appeals be denied.

 

B-39    POLICE SERGEANT, TRENTON - CSC DOCKET NO. 2016-1443

 

The City of Trenton requests retroactive appointment dates to Police Sergeant effective March 9, 2015 for three provisional appointees and retroactive appointment dates to Police Sergeant effective March 20, 2015 for two provisional employees.

 

ACTION:       The Civil Service Commission directed that these requests be granted.

 

 

There being no further business before the Civil Service Commission, the meeting was adjourned to convene on Thursday, November 5, 2015, at 10:00 a.m., at 3 Station Plaza, Trenton, New Jersey.
