    A regular meeting of the Civil Service Commission was held on Wednesday, December 7, 2016, in Trenton, New Jersey.

 

          PRESENT: Robert M. Czech, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher S. Myers, Assistant Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2015, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

 WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Margaret Burleigh, et al., School Bus Driver, Brick Township, School District, good faith layoff.

DISMISSAL FOR FAILURE TO APPEAR

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    VINCENT MCLEOD

 

Vincent McLeod, Senior Correction Officer, Northern State Prison, Department of Corrections, removal effective November 19, 2015, on charges of conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Modify the removal to a six-month suspension.

 

ACTION:    The Civil Service Commission rejected the Administrative Law Judge’s initial decision and acknowledged the settlement.

 

A-5    MONICA MILLER

 

Monica Miller, Correction Sergeant, Northern State Prison, Department of Corrections, 90 working day suspension on charges of inability to perform duties, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Reverse the 90 working day suspension.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6    MICHAEL MULCAHY, ET AL.

 

Michael Mulcahy, Housing Inspector, Gary Parlatti, Field Representative Citizen Complaints, and Michael Smith, Field Representative Citizen Complaints, Bayonne, Department of Municipal Services, good faith layoffs effective July 17, 2015.

 

Recommendation of the Administrative Law Judge – Reverse the layoffs.

 

ACTION:    The Civil Service Commission directed that this matter be held for testimony summary.

B.C., represented by Craig S. Gumpel, Esq., appeals his rejection as a Fire Fighter candidate by Elizabeth and its request to remove his name from the eligible list for Fire Fighter (M2518M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    N.C. – CSC DOCKET NO. 2016-990

 

N.C. appeals his rejection as a Police Officer Recruit, Human Services candidate by the Department of Human Services and its request to remove his name from the eligible list for Police Officer Recruit, Human Services (S9999R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

B-5    L.P. – CSC DOCKET NO. 2015-98

 

          L.P., represented by Annette Verdesco, Esq., appeals his rejection as a County Correction Officer candidate by Passaic County, and its request to remove his name from the eligible list for County Correction Officer (C9970M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    HUMZA ABDUL-HAQQ – CSC DOCKET NOS. 2016-861 AND 2016-4447

 

Humza Abdul-Haqq, represented by Kenneth J. Hall, Esq., appeals the decision of the Division of Agency Services, which found that the appointing authority had presented a sufficient basis to remove the appellant’s name from the Correction Officer Recruit (S9988R), Department of Corrections eligible list due to an unsatisfactory background report and falsification of the employment application. Mr. Abdul-Haqq also appeals the removal of his name from the Fire Fighter (M2543M), Town of Kearny eligible list on the basis of falsification of the employment application.

 

ACTION:    The Civil Service Commission directed that this appeal be denied.

 

B-7    JOSTANY ACOSTA – CSC DOCKET NO. 2016-3625

 

          Jostany Acosta appeals the removal of his name from the eligible list for Correction Officer Recruit (S9988T), Department of Corrections, on the basis of his failure to complete pre-employment processing.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-8   OLUMIDE AJAO AND TANITA STOCKS – CSC DOCKET NOS. 2017-53 AND 2016-3161

 

Olumide Ajao and Tanita Stocks appeal the removal of their names from the Correction Officer Recruit (S9988T), Department of Corrections, eligible list on the basis they did not complete pre-employment processing.

 

ACTION:     The Civil Service Commission directed that these appeals be granted.

Erasmo Assuncao, represented by Craig Gumpel, Esq., appeals the removal of his name from the eligible list for Fire Fighter (M2554M), Newark, on the basis of his unsatisfactory criminal record.

Geovany Ayala, represented by Randy T. Pearce, Esq., appeals the decision of the appointing authority to remove his name from the County Correction Officer (S9999R), Essex County eligible list on the basis that he falsified his application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-11   BRITTNEY HILL – CSC DOCKET NO. 2016-3971

 

Brittney Hill appeals the decision of the appointing authority to remove her name from the Correction Officer Recruit (S9988T), Department of Corrections eligible list on the basis of an unsatisfactory criminal record, an unsatisfactory background report and falsification of her pre-employment questionnaire.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-12   CHRISTOPHER KRAYNANSKI – CSC DOCKET NO. 2016-2960

 

          Christopher Kraynanski appeals the removal of his name from the eligible list for Sheriff’s Officer (S9999R), Essex County on the basis of an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-13   NADIA MORALES – CSC DOCKET NO. 2016-4443

 

          Nadia Morales appeals the removal of her name from the eligible list for Sheriff’s Officer (S9999R), Hudson County on the basis that her name had been removed from the pool of eligible for another jurisdiction or title area for an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-14   MARIO PEREIRA – CSC DOCKET NO. 2016-4411

 

          Mario Pereira, represented by Thomas J. Cammarata, Esq., appeals the decision of the Division of Agency Services upholding the removal of his name from the Police Officer (S9999R), Hoboken, eligible list on the basis of an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

Jensy Reynosa appeals the removal of his name from the eligible list for Police Officer (S9999R), Pleasantville on the basis of an unsatisfactory criminal record.

          Matthew Hoffman appeals the decision of the Division of Agency Services that the proper classification of his position with the Department of the Treasury is Pensions Benefits Specialist 2. The appellant seeks a Pensions Benefits Specialist 1 job classification.

B-21   JACK KAMINSKI – CSC DOCKET NO. 2017-160

 

Jack Kaminski appeals the decision of the Division of Agency Services that the proper classification of his position with the Department of the Treasury is Building Services Coordinator 1. The appellant seeks a Building Services Coordinator 3 job classification.

Rosemarie Millan requests reconsideration of the final decision, rendered on December 16, 2015, which upheld the determination that she was below the minimum requirements in experience for prospective promotional examinations for Administrative Analyst 2 and Administrative Analyst 3.

 

ACTION:     The Civil Service Commission directed that this request be denied.

          In In the Matter of Human Services Specialist 1, Bilingual in Hindi and English (C0086R), Middlesex County Board of Social Services (SCS, decided April 23, 2014), the Civil Service Commission (Commission) granted the request of the Middlesex County Board of Social Services for an appointment waiver for the July 2, 2013 certification and ordered that no selection costs were to be assessed at the time since there was a possibility that the list could be utilized prior to its expiration. However, the appointing authority did not utilize the subject eligible list and the matter of the assessment of costs is now before the Commission.

The appeal of Anthony Larino, a Police Captain with the City of Bayonne, of his 180 calendar day suspension, on charges, was heard by Administrative Law Judge Joan Bedrin Murray (ALJ), who rendered her initial decision on October 24, 2016. At its meeting on November 23, 2016, the Civil Service Commission (Commission) did not adopt the ALJ’s recommendation to uphold the 180 calendar day suspension. Rather, the Commission modified the penalty to a 120 calendar day suspension. The proposed decision is now submitted for the Commission’s review.

 

            ACTION: The Civil Service Commission adopted the decision.
