A regular meeting of the Merit System Board was held on Tuesday, October 14, 1998 in Trenton, New Jersey. PRESENT: Chairwoman Janice Mitchell Mintz; Merit System Board Members, Margaret E.L. Howard, Judith L. Shaw, and Edward W. Verner, M.D., Andrea Grundfest, Deputy Attorney General; Henry Maurer, Director, Elizabeth A. RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES
- SETTLEMENT


ACTION: The Merit System Board acknowledged the
settlements with the exception of Donald Evans
which was held over.

A-2 RONALD M. CARTON, JR.

Ronald Carton, Senior Correction Officer, Garden State Youth
Correctional Facility, Department of Corrections, suspension
for 30 days beginning October 28, 1997, on charges of
personal conduct; falsification: intentional mis-statement
of material fact in connection with work, employment,
application, attendance, or in any record, report,
investigation or other proceeding.

Recommendation of the Administrative Law Judge - Reverse the
suspension and award back pay, and attorney's fees.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-3 DRUSCILLA CLARK

Druscilla Clark, Secretarial Assistant III, Adult Diagnostic
& Treatment Center, Department of Corrections, (1)
suspension for 10 days and (2) removals (3 removals)
effective December 10, 1996, on charges of insubordination;
intentional disobedience or refusal to accept a reasonable
order.

Recommendation of the Administrative Law Judge - Uphold the
suspension and removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-4 GAIL FETTERMAN

Gail Fetterman, Senior Library Assistant (Typing), Library,
Sussex County, suspension for 10 days, beginning April 22,
1996 and ending May 3, 1996, on charges of (1)
insubordination and (2) removal effective August 7, 1996, on
charges of insubordination, neglect of duty and conduct
unbecoming a county employee.

Recommendation of the Administrative Law Judge - Uphold the
suspension and uphold the removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-5 DAVID KIFFER

David Kiffer, Senior Corrections Officer, Midstate
Correctional Facility, Department of Corrections, suspension
for 60 days, on charges of neglect of duty, loafing,
idleness, willful failure to devote attention to tasks which
could result in danger to person or property and sleeping
while on duty.

Recommendation of the Administrative Law Judge - Uphold the
suspension.

ACTION: The Merit System Board modified the 60 day
suspension to a 90 day suspension.


A-6 KENNETH LAWSON

Kenneth Lawson, Human Services Technician, Marlboro
Psychiatric Hospital, Department of Human Services,
suspension for 10 days, on charges of verbal abuse regarding
a patient.

Recommendation of the Administrative Law Judge - Reverse the
suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-7 JOSEPH MIKUCKI

Joseph Mikucki, Principal Data Processing Programmer,
Sheriff's Office, Monmouth County, suspension for 60 days
beginning July 14, 1997 and ending October 3, 1997, on
charges of deliberate and repeated inappropriate behavior,
conduct unbecoming a public employee, conduct creating an
adverse working environment and willful violation of County
Policy on antiharassment.

Recommendation of the Administrative Law Judge - Modify the
60 day suspension to a six month suspension.

ACTION: The Merit System Board remanded this matter to the
Office of Administrative Law.

A-8 LESTER SMITH

Lester Smith, Senior Building Maintenance Worker, The
College of New Jersey, resignation not in good standing
effective November 25, 1996, on charges of chronic or
excessive absenteeism and neglect of duty.

Recommendation of the Administrative Law Judge - Modify to
Resignation in Good Standing.

ACTION: The Merit System Board modified the Administrative
Law Judge's decision to a resignation not in good
standing.

A-9 JOHN FABIAN

John Fabian, Police Officer, Police Department, Township of
North Bergen, removal effective September 17, 1996, on
charges of neglect of duty and failure to properly patrol an
assigned sector/post.

Recommendation of the Administrative Law Judge - Reverse the
removal and award back pay, seniority, and counsel fees.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-10 PHYLLIS JENKINS

Phyllis Jenkins, Deputy Court Administrator, City of
Trenton, removal effective February 13, 1996, on charges of
official misconduct, falsifying court records and conduct
unbecoming an employee in public service.

Recommendation of the Administrative Law Judge - Modify the
removal to a two month suspension.

ACTION: The Merit System Board remanded this matter to the
Office of Administrative Law.

SECTION B - MISCELLANEOUS MATTERS

B-1 JEFFREY BUCKMAN

Jeffrey Buckman, represented by Barbara E. Riefberg, Esq.,
appeals his rejection as a Police Officer candidate by the
Township of Gloucester and its request to remove his name
from the eligible list for Police Officer on the basis of
psychological unfitness to perform effectively the duties of
the position.

ACTION: The Merit System Board directed that the appellant
be referred to the Medical Examiner's Panel for
independent evaluation.


B-2 GEORGE HOPE

George Hope appeals his rejection as a Correction Officer
Recruit candidate by the Department of Corrections and its
request to remove his name from the eligible list for
Correction Officer Recruit on the basis of psychological
unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that the appellant
be referred to the Medical Examiner's Panel for
independent evaluation.

B-3 JERALD A. LEE

Jerald A. Lee appeals his rejection as a Police Officer by
the City of Plainfield and its request to remove his name
from the eligible list for Police Officer on the basis of
psychological unfitness to perform effectively the duties of
the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-4 LEROY D. NESMITH

Leroy D. Nesmith appeals his rejection as a Police Officer
by the City of Camden and its request to remove his name
from the eligible list for Police Officer on the basis of
psychological unfitness to perform effectively the duties of
the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-5 LORRY LARRY STINSON

Lorry Larry Stinson appeals his rejection as a Correction
Officer Recruit candidate by the Department of Corrections
and its request to remove his name from the eligible list
for Correction Officer Recruit on the basis of psychological
unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-6 TRACEY STANTON-WATKINS

Tracey Stanton-Watkins appeals her rejection as a Juvenile
Detention Officer candidate by Camden County and its request
to remove her name from the eligible list for Juvenile
Detention Officer.

ACTION: The Merit System Board directed that this appeal
be granted.

B-7 BESSIE WHITE

The appeal of Bessie White, Budget Officer, Newark Board of
Education, resignation not in good standing, effective
October 2, 1995, on charges, was heard by Administrative Law
Judge Marie P. Simonelli (ALJ), who rendered her initial
decision on May 8, 1998.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

Joanne Smith, a Supervisor, Food Service Area Operations

Representative, CWA Local 1040, petitions the Merit System
Board for reconsideration of the final administrative
decision which denied her request for a hearing in regard to
her 15-day suspension on charges.

ACTION: The Merit System Board directed that this appeal
be denied.

B-9 ALPHONSO STRAUSS


Alphonso Strauss, a Senior Correction Officer with Northern
State Prison, Department of Corrections, appeals the denial
of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal

Janice Cribb, a Nursing Services Clerk with Trenton
Psychiatric Hospital, Department of Human Services, appeals

Gloria Lee, a Human Services Technician with Trenton
Psychiatric Hospital, Department of Human Services, appeals
the denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal
be denied.

B-16 CHARLES DIEHM

Charles Diehm, Senior Code Enforcement Officer, Township of
Pennsauken, represented by Joseph Asbell, Esq., seeks
enforcement of that part of the Merit System Board decision
rendered on March 8, 1994, granting him back pay and
benefits for the period of removal. This matter was held
over from the September 29, 1998 Merit System Board meeting
for further review. A review of the record in this matter
found no basis for an award of interest on the back pay
amount or for the assessment of any penalties against the
Township.

ACTION: The Merit System Board directed that this appeal
be granted in part.

B-17 MAHALA WELCH

Mahala Welch, represented by Joseph R. Fischer Esq.,
requests enforcement of that part of the Merit System Board
decision rendered on December 3, 1996, granting her counsel
fees.

ACTION: The Merit System Board directed that this appeal
be granted in part.

B-18 BUILDING MAINTENANCE INSPECTOR (M5528T), TOWNSHIP OF
BELLEVILLE


The Township of Belleville requests reconsideration of that
part of the decision rendered on May 19, 1998 by the Merit
System Board which assessed compliance processing costs with
regard to a certification for Building Maintenance Inspector
(M5528T).

ACTION: The Merit System Board granted the request and
rescinded compliance costs..

B-19 DATA ENTRY MACHINE OPERATOR (C1144T), PASSAIC COUNTY

The appointing authority requests permission not to make an
appointment from the certification for Data Entry Machine
Operator (C1144T), Passaic County.

ACTION: The Merit System Board granted the request but
assess costs.

B-20 JOHN DOLAK, ET AL.

John Dolak, Edward Haran and Charles Luxton, represented by
Paul L. Kleinbaum, Esq., appeal the decision of the
Supervisor, Selection Appeals Unit, which found that
appellants were properly removed from the Supervising Fire
Prevention Specialist/Supervising Fire Prevention Specialist
UFD (PM2640P), Newark Fire Department eligible list.

ACTION: The Merit System Board directed that this appeal
be denied.

B-21 MANUEL GONZALEZ

Manuel Gonzalez appeals the decision of Human Resource
Information Systems which found that the Department of
Corrections had presented a sufficient basis to remove his
name from the Correction Officer Recruit (S9998U) eligible
list.

ACTION: The Merit System Board directed that this appeal
be denied.

B-22 ROBERT A. FANELLE


Robert A. Fanelle, represented by Mark J. Dorval, Esq.,
appeals the decision of the Certification/Placement Services
Unit which found that the appointing authority had presented
a sufficient basis to remove his name from the eligible list
for Police Officer (M1836M), City of Camden.

ACTION: The Merit System Board directed that this appeal
be denied.

B-23 BENITO GONZALEZ

Benito Gonzalez, represented by Lakshmi Roberta Roy, Esq.,
appeals the decision of the Certification/Placement Services
Unit which upheld the request by Camden City to remove the
appellant's name from the Police Officer, Bilingual in
Spanish and English (M1880M) eligible list.

ACTION: The Merit System Board directed that this appeal
be denied.

B-24 WALTER LANGDON

Walter Langdon, a County Correction Officer with Atlantic
County, represented by Bernard J. McBride, Jr., Esq.,
appeals the decision of the Certification/Placement Services
Unit which upheld Atlantic County's request for the removal
of the appellant's name from the County Correction Sergeant
(PC6549N) promotional list due to an unsatisfactory
employment history.

ACTION: The Merit System Board directed that this appeal
be granted.

B-25 JAMES DOWNING

James Downing, represented by Terry Bruce Stomel, Esq.,
appeals the decision of Human Resource Information systems
which found that the Department of Corrections had presented
a sufficient basis to remove his name from the Correction
Officer Recruit (S9998U) eligible list.

ACTION: The Merit System Board directed that this appeal
be denied.

B-26 KEVIN THOMPSON

Kevin Thompson appeals the decision of the
Certification/Placement Services Unit which upheld the
Department of Corrections= removal of the appellant's name
from the Correction Officer Recruit (S9998B) eligible list.

ACTION: The Merit System Board directed that this appeal
be denied.

B-27 JOHN E. PREDALE

John E. Predale, represented by Steven A. Varano, Esq.,
appeals the decision of the Placement Services Unit which
found that the appellant had not been improperly bypassed by
Berkeley Township on the eligible list for Police Chief
(PM2928S).

ACTION: The Merit System Board granted a hearing.

B-28 JOSEPH FERROGINE

The appointing authority for the Department of Human
Services, represented by Leslie-Ann Justus, DAG, petitions
the Merit System Board for reconsideration of its final
decision, rendered on June 2, 1998, which modified the
appointing authority>s removal of Joseph Ferrogine to a
three-month suspension. The appointing authority also
requests a stay of the Board's decision pending the outcome
of its reconsideration request. Appellant, represented by
John S. Furlong, Esq., petitions the Board for
reconsideration of its decision upholding the charge of
conduct unbecoming a public employee.

ACTION: The Merit System Board denied the request for
reconsideration.

B-29 WILLAM CSEH

The Department of the Treasury requests reconsideration of
the attached Merit System Board decision, rendered June 16,
1998, which called for the rescission of the results of the
examination for Manager 2, Human Resources, (PS3751U),
Department of the Treasury and the expeditious development
and administration of a new examination.

ACTION: The Merit System Board denied the request for
reconsideration.

B-30 CHARLES BURNS

Charles Burns appeals the determination of the Division of
Selection Services, which found that he did not meet the
experience requirements for the open competitive examination
for Printing Machine Operator 3 (S1651T).

ACTION: The Merit System Board directed that this appeal
be denied.

B-31 VALERIE CASTAGNA - WOOD

Valerie Castagna-Wood appeals the determination of the
Division of Selection Services, which found that she did not
meet the experience requirement for the open competitive
examination for Research Aide Typing (C1734U), Camden
County.

ACTION: The Merit System Board directed that this appeal
be denied.

B-32 ERIC CRUZ

Eric Cruz appeals the determination of the Division of
Selection Services which found that he did not meet the
requirements for the promotional examination for Employment
Counselor Bilingual in Spanish and English (PS5112N),
Department of Labor.

Irene Leonard appeals the decision of the Division of

specific queo a specific question on the open-competitive
examination for Senior File Clerk (S1604T).

ACTION: The Merit System Board directed that this appeal
be denied

Diana M. Amato appeals the determination by the Supervisor,
Selection Appeals Units, denying her request for a make-up
examination for Library Assistant (S1677T) and (C1344T),
Monmouth County.

ACTION: The Merit System Board directed that this appeal
be denied.

B-67 FRANK WILSON

The Executive Commission on Ethical Standards referred to
the Department of Personnel, for appropriate action,
allegations that Frank Wilson, fer, Department of
Transportation, did not accurately account for leave time.

ACTION: The Merit System Board directed that no further
action be taken.

B-68 MINUTES

The Merit System Board Minutes for the meeting of September
29, 1998 are submitted for adoption.

ACTION: The Merit System Board adopted the minutes of its
September 29, 1998 meeting.


There being no further business before the Merit System
Board, the meeting was adjourned to convene on Tuesday, October
27, 1998 at 10:00 a.m., at 3 Station Plaza, Trenton, New Jersey.
