Meeting Minutes of July 7, 1999
A regular meeting of the Merit System Board was held on Wednesday, July 7, 1999 in Trenton, New Jersey.

In accordance with L.1975, c.231, Janice Mitchell Mintz, Chairwoman, Merit System Board, opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on June 28, 1999 and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
All other actions were by unanimous vote unless otherwise specified.

A-2 ROBERT S. BLADES
Robert S. Blades, County Correction Officer, Burlington County Jail, suspension for 20 days, on charges of insubordination and neglect of duty and suspension for 15 days, on charges of absent from work without permission for more than five days.
Recommendation of the Administrative Law Judge - Uphold the 20 day suspension and reverse the 15 day suspension.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-3 CURTIS CHIUMENTO
Curtis Chiumento, Sheriff's Sergeant, Sheriff's Office - Camden County, written reprimand, on charges of neglect of duty.
Recommendation of the Administrative Law Judge - Uphold the written reprimand, basic on the charge of allowing officers to change into civilian clothes prior to the end of their shift and dismiss the charge of locking the door to the substation entrance.
ACTION: The Merit System Board directed that this matter be held over.
A-4 SHERON HUGHLEY
Sheron Hughley, Graduate Nurse (12 months), New Lisbon Developmental Center, Department of Human Services, suspension for 30 days, on charges of leaving assigned work area without permission creating danger to persons and falsification: intentional misstatement of material fact in connection with attendance.
Recommendation of the Administrative Law Judge - Modify the 30 day suspension to a 15 day suspension.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-5 WALTER OLIVANT, THOMAS QUIGLEY AND RICHARD DEWAN
Walter Olivant, Principal Environmental Engineer, Division of Water Quality, Thomas Quigley, Hazardous Site Mitigation Specialist, Division of Responsible Party Site Remediation, and Richard DeWan, Section Chief, Division of Water Quality, Department of Environmental Protection, suspension for 65 days, on charges of conduct unbecoming a public employee, misuse of state property, discrimination that affects equal employment opportunity, including sexual harassment, and creating a disturbance on the premises, violation of Department internal agency rules and regulations, policies or procedures and with regard only to Walter Olivant, intentional misstatements of material fact in connection with work, employment, application or attendance or in any record, investigation or other proceeding.
Recommendation of the Administrative Law Judge - Modify the 65 day suspension for Thomas Quigley and Richard DeWan to a 30 day suspension and modify the 65 day suspension for William Olivant to a 90 day suspension.
ACTION: The Merit System Board modified the Administrative Law Judge's recommendation to a 15 day suspension for Thomas Quigley and Richard DeWan and a 30 days suspension for William Olivant.
A-6 THOMAS THERRELL
Thomas Therrell, Auditor I, Taxation, New Jersey Department of Treasury, returned to permanent title (Auditor II, Taxation) at the end of the Working Test Period.

Hector Ramirez, represented by Frankie Fontanez, Esq., appeals the decision of Human Resource Information Systems which removed appellant's name from the Police Officer (M1836M), City of Camden eligible list due to his failure to respond to a certification notice.
ACTION: The Merit System Board directed that this appeal be denied.
B-13 CELSO A. VINUEZA
Celso A. Vinueza appeals the decision of Human Resource Information Systems which found that the City of Newark had presented a sufficient basis to remove his name from the Police Officer (M3394Y) eligible list due to an unsatisfactory criminal record.
ACTION: The Merit System Board directed that this appeal be denied.
B-14 COLLEEN CARROLL
The County of Monmouth, represented by Robert J. Hrebek, Esq., petitions the Merit System Board for reconsideration of the final decision rendered on April 8, 1999 which vacated the resignation not in good standing of County Correction Officer Colleen Carroll, and reinstated her and awarded back pay, benefits, seniority and counsel fees.
ACTION: The Merit System Board denied the request for reconsideration.
B-15 JOHN HOWARD
John Howard, a Cook with the Passaic County Sheriff=s Department, represented by Karimu F. Hill-Harvey, Esq., petitions the Merit System Board to reconsider the final decision rendered on March 9, 1999, dismissing his appeal without prejudice based on his failure to appear at a scheduled hearing.
ACTION: The Merit System Board granted the request for reconsideration and directed that the matter be transmitted to the Office of Administrative Law.
B-16 ABNATHY MASON
The City of Newark, represented by Darryl M. Saunders, Assistant Corporation Counsel, requests reconsideration and a stay pending an appeal to the Superior Court, Appellate Division of the final administrative decision of the Merit System Board, rendered on March 9, 1997, which granted reinstatement to Abnathy Mason, with back pay and benefits, to his former position as Fire Captain. Additionally, Mr. Mason, represented by Vito Carnevale, Esq., requests reconsideration of that part of the subject final decision which failed to grant counsel fees and interest on the back pay award.
ACTION: The Merit System Board denied the request for reconsideration and granted counsel fees with no interest.
B-17 ELSIE BLAKESLEE
Elsie Blakeslee, a Principal Data Entry Machine Operator, Division of Parole and Community Programs, Department of Corrections, appeals her involuntary reassignment to the Substance Abuse Program, effective May 9, 1998.
ACTION: The Merit System Board directed that this appeal be denied.
B-18 LILLIAN RODRIGUEZ
Lillian Rodriguez, a Computer Operator 2 with the Office of Student Assistance, Department of Education, represented by Denice Hunt, CWA Local 1031, appeals the appointing authority=s denial of a work shift change to accommodate her permanent medical disability.
ACTION: The Merit System Board directed that this appeal be denied.
B-19 FABIAN FAZZARI
Fabian Fazzari, represented by David C. Stanziale, Esq., petitions the Merit System Board for appropriate salary step placement and an award of back pay in regard to the final decision, rendered April 30, 1996, which ordered his appointment from the Police Officer (M5423N), City of Orange list.
ACTION: The Merit System Board granted the request in part.
B-20 WILEY WHALEY
Wiley Whaley, a Senior Medical Security Officer with the Ann Klein Forensic Center, Department of Human Services, represented by Robert C. Little IV, Assistant to the Director, AFSCME, petitions the Merit System Board for a hearing in regard to two removals effective June 3, 1998 on charges of being absent from work without permission and without giving proper notice of intended absence.
ACTION: The Merit System Board granted a hearing.
B-21 IN THE MATTER OF COUNTY CORRECTION OFFICERS, MIDDLESEX COUNTY
Pursuant to Judge Melvin P. Antell=s May 10, 1999 Order, the Merit System Board is to consider Middlesex County=s revised request for 10 bona fide occupational qualification (BFOQ) designations (female-only) for correction officers at the Middlesex County Adult Correction Center.
ACTION: The Merit System Board granted the request for six BFOQ designations in the female housing unit and one BFOQ designation for the visitation post.
B-22 ASSISTANT DIRECTOR OF DATA PROCESSING (M6078O), JERSEY CITY
The appointing authority requests permission not to make an appointment from the certification for Assistant Director of Data Processing (M6078O), Jersey City.
ACTION: The Merit System Board granted the request and assessed costs.
B-23 PROGRAM MONITOR (C1190T), ESSEX COUNTY
The appointing authority requests permission not to make an appointment from the certification for Program Monitor (C1190T), Essex County.
ACTION: The Merit System Board granted the request and assessed partial costs.
B-24 SENIOR MAINTENANCE REPAIRER (M0208T), PASSAIC VALLEY WATER COMMISSION
Passaic Valley Water Commission appeals the salary disapproval order issued for Senior Maintenance Repairer (M0208T).
ACTION: The Merit System board directed that this appeal be denied, the list be revived, ordered the Appointing Authority to remove the provisional, make an appointment from the list and pay compliance costs.
B-25 BRIAN BROWN
The appeal of Brian Brown, a Clerk with the Department of the Treasury, of his removal effective November 7, 1997 on charges, was heard by Administrative Law Judge Anthony T. Bruno (ALJ), who rendered his initial decision on May 11, 1999 upholding the removal. At its meeting on June 21, 1999, the Board affirmed the ALJ's recommendation that the appellant=s removal be upheld. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.
B-26 CAROL KAPURELOS, ET AL.
The appeals of Carol Kapurelos, Colleen Murray, and Kevin Hart, Emergency Medical Technicians in the Lower Township Department of Public Safety, concerning their layoff effective April 21, 1997, were the subject of a settlement conference convened by Administrative Law Judge Jeff S. Masin (ALJ). The ALJ recommended that the settlement be acknowledged. The Merit System Board at its meeting of June 8, 1999, acknowledged the settlement regarding 17 other appellants and directed that the matter be remanded to OAL regarding appellants Carol Kapurelos, Colleen Murray, and Kevin Hart, for full disposition or for further proceedings if required. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.
B-27 ASA L. PHILLIPS
The appeal of Asa L. Phillips, County Correction Officer with Mercer County Correction Center, of his removal effective November 8, 1996 on charges, was heard by Administrative Law Judge Anthony T. Bruno (ALJ), who rendered his initial decision on April 23, 1999. At its meeting on June 8, 1999, the Merit System Board did not accept the ALJ's recommendation to modify the penalty to a three-day suspension. Rather, the Board concluded that the charges should be dismissed and the penalty vacated. The proposed final decision in this matter is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.
B-28 EDWARD URBAN
The appeal of Edward Urban, a Laborer with the City of Linden Department of Public Works, of his removal, effective December 18, 1997 on charges, was heard by Administrative Law Judge August E. Thomas (ALJ), who rendered his initial decision on May 10, 1999. At its June 21, 1999 meeting, the Merit System Board did not accept the ALJ's recommendation to uphold the removal. Rather, the Board ordered that this matter be remanded to the Office of Administrative Law. The proposed final decision in this matter is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.
B-29 MICHAEL VOLK
The appeal of Michael Volk, Assistant District Parole Supervisor, Parole and Community Programs, Department of Corrections, of his 30-day suspension on charges, was heard by Administrative Law Judge Mumtaz Bari-Brown (ALJ), who rendered her initial decision on May 3, 1999. At its June 21, 1999 meeting, the Merit System Board did not accept the ALJ=s recommendation to uphold the suspension. Rather, the Board ordered that this matter be remanded to the Office of Administrative Law. The proposed final decision in this matter is now submitted for the Board=s review.
ACTION: The Merit System Board adopted the final decision. B-30 BRIAN WHITTLE
The appeal of Brian Whittle, Fire Fighter, City of East Orange, of his removal effective March 10, 1998 on charges, was heard by Administrative Law Judge Margaret M. Hayden (ALJ), who rendered her initial decision on March 31, 1999. At its meeting on June 8, 1999, the Merit System Board did not accept the ALJ's recommendation to modify the penalty to a five-day suspension. Rather, the Board concluded that a six-month suspension was warranted. The proposed final decision in this matter is now submitted for the Board=s review.
ACTION: The Merit System Board adopted the final decision.
B-31 CYNT ARMSTRONG LEWIS
Cynt Armstrong Lewis appeals the determination of the Division of Selection Services, which found that she did not meet the requirements for the open competitive examination for Community Service Worker (MO842W), City of Trenton.
ACTION: The Merit System Board directed that this appeal be denied.
B-32 LUCY BALLISTY, ET AL.
Lucy Ballisty, Robert Chumar, Gail Del Gaudio, Surlisa Graves-Murphy, Detri Oliver, Eleanor Stuzynski, and Debra Tulli appeal the determination of the Division of Selection Services, which found that they did not meet the experience requirements for the promotional examination for Management Assistant, (PS6357F), Department of Education. These appeals have been consolidated due to common issues.
ACTION: The Merit System Board directed that these appeals be denied.

Dean K. Carter, Sr. appeals the determination of the Division of Selection Services, which found that he did not meet the experience requirement for the promotional examination for Police Chief (PM3504W), Lopatcong Township.

Brigitti R. Castillo appeals the determination of the Division of Human Resource Management which found that she was ineligible for the promotional examination for Income Maintenance Worker (PC0585W), Union County Department of Human Services.

The Director, Division of Human Resource Management, requests that Stewart Diaz be declared eligible to compete in the promotional examination for Personnel Assistant 2 (PS7129K), Greystone Park Psychiatric Hospital.
