A regular meeting of the Merit System Board was held on
Tuesday, August 10, 1999 in Trenton, New Jersey.

PRESENT: Chairwoman Janice Mitchell Mintz; Merit System
Board Members, Margaret E. L. Howard and Alan Dexter Bowman,
Elizabeth Laufer, Deputy Attorney General; Henry Maurer,
Director, Elizabeth A. Napolitano, Sybil Janowitch, and Charles
Spano, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Janice Mitchell Mintz,
Chairwoman, Merit System Board, opened the meeting with the
following statement:

Notice of this meeting was filed with the Secretary of State
and sent to the Trentonian, Trenton Times, Courier-Post and Star
Ledger on November 30, 1998, and posted at the Department of
Personnel, 3 Station Plaza, Trenton, New Jersey.

All other actions were by unanimous vote unless otherwise
specified.

STATE CLASSIFICATION PLAN

The Merit System Board approved the recommended changes in the
State Classification Plan, copies of which are attached hereto
and made a part hereof.

SUBJECT: Change in the Compensation Plan

NEW JERSEY ELECTION LAW ENFORCEMENT COMMISSION

The New Jersey Election Law Enforcement Commission (NJELEC)
recently requested an upward range reevaluation for the titles of
Election Finance Analyst and Deputy Legal Counsel. The
Commission contended that new and amended legislation increased
the jurisdiction and scope for which these titles are
responsible. The Merit System Board approved the request. The
Commission now requests an upward range reevaluation for the
Legal Counsel.

The Commission was created to administer and enforce the Campaign
Contributions and Expenditures Act, which requires candidates and
campaign committees to file reports of contributors,
contributions and expenditures. It also requires political party
committees and others to file quarterly reports of their
finances.

The Commission indicates that enactment of 1993 legislation
expanded their legal jurisdiction. The concurrent enactment of
amendments to existing legislation established a network of
contribution limits, and placed restrictions on the legally
permissible uses of campaign funds by candidates and elected
officials. Amendments in 1995 added the enforcement of campaign
literature identification requirements, while new legislation,
which provided for the recall of local elected officials,
increased regulatory duties over recall and recall defense
committees.

The Legal Counsel is responsible for the supervising the legal
representation of the Commission in all prosecution of campaign,
gubernatorial public financing, lobbying and personal financial
reporting violations. The position also oversees the
promulgation of regulations.

An analysis of the documentation submitted indicates that the
work of the Legal Counsel has also been impacted by the changes
cited by the Commission. A review of the Hay evaluation for this
title indicates a change in the accountability factor
(answerability for actions and consequences). We believe that an
upward salary adjustment of one (1) range is warranted in this
case.

SUBJECT: Re-establishment of a Title

Department of Labor

The Department of Labor submitted a proposal on December 3, 1997
to create the title of Chief of Occupational Research. To create
the title, the Section Supervisor, Research Unit, Office of
Program Research would be re-established and its title verbiage
changed. Once it is re-established, five existing titles
peculiar to the Department of Labor would be consolidated into
this title.

Following approval of its re-establishment the title is to be
renamed, Chief Labor Market Information.

In accordance with an agreement between this division and the
Department of Labor, the proposed consolidation would be
effective on a current basis. The effective date shall be the
date the action is approved by the Merit System Board.

The consolidated title and recommended range is consistent with
other titles at the bureau chief level within the Department of
Labor. The titles of Staff Director, Census Data Center and
Section Supervisor, Research Unit, Office of Program are
currently inactive. Their inclusion in the consolidation action
would ensure that employees who previously held these titles
would be granted displacement rights to the new title.

As part of the consolidation request, employees in three of the
titles which are currently filled shall be permitted to move into
the consolidated title on a lateral basis. This provision was
added at the recommendation of Peter Boone and agreed to by Susan
Matthews on behalf of the Department of Labor. Employees would
move into the consolidated title with no increase in salary.
They would be aligned into the new salary range on their
respective anniversary date.

SUBJECT: Change in the Local Government Classification Plan

The City of Ocean City has requested the establishment of an
unclassified title to classify the director of the Ocean City
Pops Orchestra. In recognition of the need to classify positions
in local government where the primary responsibilities would
involve direction of cultural or performing arts programs, I
recommend creation of the unclassified local government title of
Arts Director.

The basis for this creation is 4A:3-1.3(a)5. This class of
service would permit local appointing authorities to make choices
of artistic talent as the need arises and as the seasonal demands
may warrant.

The Department of Education has requested the creation of the
title, Education Program Development Specialist 3 (10 months) for
use at the Katzenbach School for the Deaf. This title will be
used to classify positions responsible for evaluating deaf or
hard of hearing students for speech/language proficiency,
classification, and therapy. As a member of the Specialized
Child Study Team, these positions will also participate in
educational planning for students.

The Department has also requested the inactivation of the title,
Administrative Instructor, Education (10 months).

I recommend approval of this request.

Peter Schepelenko, Senior Correction Officer, Department of

Corrections, removal effective December 24, 1996, on charges
of falsification: intentional misstatement of material
fact in connection with work, employment, application,
attendance, or in any record, report, investigation or other
proceeding, conduct unbecoming an employee, actual or
attempted theft of State property or equipment or the
property of other employees, residents, clients or inmates
and misuse of public property, including motor vehicles used
for unauthorized or unofficial purposes. Settled to a
resignation in good standing and appellant making
restitution to the Department of Corrections in the amount
of $1,300.

violation of the rules and regulations of the City of
Paterson Fire Department.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board reversed the removal.

A-16 JOHN POLILLO

John Polillo, Atlantic City Department of Public Works,
removal effective June 20, 1996, on charges of failing to
comply with a directive. This matter was brought before the
Merit System Board as a settlement on November 18, 1997.
The Administrative Law Judge's recommendation was
acknowledge the settlement. The Board determined that the
terms and conditions of the settlement required
clarification.

Recommendation of the Administrative Law Judge - Award back
pay in the amount of $12,950.96 for the period June 20, 1996
through October 22, 1996, and dismiss the balance of the
complaints contained in the appellant's appeal.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law Judge.

A-17 ANTHONY SCHIAVONE

Anthony Schiavone, Correction Officer Recruit, Albert C.
Wagner Youth Correctional Facility, Department of
Corrections, release at the end of the Working Test Period
effective February 16, 1998.

Recommendation of the Administrative Law Judge - Uphold the
release at the end of working test period.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law Judge.

Recommendation of the Administrative Law Judge - Uphold the
removals for Sergeant Jeffrey Sienkiewicz and Senior

suspension for Sergeant Frank Jackson.

ACTION: The Merit System Board directed that
this matter be held over.

A-19 LARRY CALHOUN

Larry Calhoun, Human Services Assistant, Marlboro
Psychiatric Hospital, Department of Human Services,
suspension for 12 days, on charges of inappropriate physical
contact or mistreatment of a patient, client resident, or
employee and insubordination. The Merit System Board
considered this matter at its meeting on June 21, 1999, and
directed that this matter be held over for a testimony
summary.

Recommendation of the Administrative Law Judge - Reverse the
suspension.

ACTION: The Merit System Board reversed the
recommendation of the Administrative Law Judge and
upheld the suspension.

A-20 FELICIA LAWSON

Felicia Lawson, Cottage Training Technician, Woodbine
Developmental Center, Department of Human Services, removal
effective April 8, 1997, on charges of verbal and physical
abuse of a client. The Merit System Board considered this
matter at its meeting on July 21, 1999, and directed that
this matter be held over for a testimony summary.

Recommendation of the Administrative Law Judge - Reverse the
removal.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law Judge.

A-21 NATHAN CAREY

Nathan Carey, Human Services Assistant, Woodbine
Developmental Center, Department of Human Services, removal
effective February 11, 1998, on charges of physical abuse of
a client. The Merit System Board at its meeting of July 7,
1999, directed that this matter be held over for a testimony
summary.

Recommendation of the Administrative Law Judge - Reverse the
removal.

ACTION: The Merit System Board modified the
removal to a 30 day suspension.

A-22 JOSEPH JENSEN - SETTLEMENT

Initial removal effective December 22, 1998, on charges
of Conduct Unbecoming an Employee. Settled to returned to
duty. The Merit System Board at its meeting of June 21,
1999, directed that this matter be held over for the receipt
of a clarifying letter concerning an aspect of the
settlement.

ACTION: The Merit System Board directed that this matter be
held over.

A-23 FRANK KOVACH - SETTLEMENT

Initial suspensions for one day, two days, two days, and
60 days on charges of Unauthorized Absences. Settled to a
Resignation in Good Standing. The Merit System Board at its
meeting of July 7, 1999, directed that this matter be held
over for the receipt of a clarifying letter concerning an
aspect of the settlement.

ACTION: The Merit System Board directed that this matter be
held over.

A-24 MICHAEL BREDEN - SETTLEMENT

Initial suspension for 15 days on charges of Neglect of
Duty and Conduct Unbecoming an Employee. Settled to a five-
day suspension. The Merit System Board at its meeting of
June 21, 1999, directed that this matter be held over for
the receipt of a clarifying letter concerning an aspect of
the settlement.

ACTION: The Merit System Board directed that this matter be
held over.

B-30 WALTER OLIVANT, ET AL.

The appeals of three Department of Environmental Protection
(DEP) employees, Walter Olivant, a Principal Environmental
Engineer with the Division of Water Quality, Thomas Quigley,
a Hazardous Site Mitigation Specialist with the Division of
Responsible Party Site Remediation, and Richard DeWan, a
Section Chief with the Division of Water Quality, concerning
their 65-day suspensions on charges, were heard by
Administrative Law Judge (ALJ) Anthony T. Bruno, who
rendered his initial decision on April 12, 1999. The Merit
System Board, at its meeting on July 7, 1999, did not adopt
the ALJ's recommendation to modify Olivant's penalty to a 90-day
suspension, and to modify the penalties for Quigley and
DeWan to 30-day suspensions. Rather, the Board concluded
that the appropriate penalty for Olivant was a 30-day
suspension, and the appropriate penalties for Quigley and
DeWan were 15-day suspensions. The proposed final decision
is now submitted for the Board's review.

ACTION: The Merit System Board directed that this matter

The appeal of Joseph Ellis, a Custodial Worker with the

removal. At its meeting on July 7, 1999, the Board affirmed

1999 upholding the removal. At its meeting on July 19,
1999, the Board accepted the ALJ's recommendation that the
appellant's removal be upheld. However, while the Board
agreed with the ALJ's recommendation that the removal be
upheld, it determined that the appellant was entitled to
back pay from the date of his immediate suspension to the

The Township of Lacey (Township), represented by Stephen K.
Foran, Esq., petitions the Merit System Board (Board) for a
stay of its order, In the Matter of Municipal Court
Administrator, Township of Lacey, rendered on October 27,
1998, which held that the Municipal Court Administrator
title was in the career service, pending the decision of the
Appellate Division of the Superior Court on the Township's
appeal, which was filed on December 9, 1998.

ACTION: The Merit System Board directed that this appeal
be denied.

B-71 CHIEF LABOR MARKET INFORMATION

The Assistant Commissioner, State and Local Operations,
requests that the provisions of N.J.A.C. 4A:4-7.6, lateral
title change criteria, be relaxed in order to allow three
employees to move laterally into the newly created title of
Chief Labor Market Information.

ACTION: The Merit System Board directed that this appeal
be granted.

B-72 CARRIE WYNDER

Carrie Wynder, represented by Richard Gelade, Esq., appeals
the determination of the Manager, Shared Services Center II,
that her position was properly classified as Executive
Assistant 4 (Class Code 22) for the period of March, 1997 to
March, 1998.

ACTION: The Merit System Board directed that this matter
be held over.

B-73 JOYCE EPISCOPO

Joyce Episcopo, represented by Evelyn Liebman, Staff
Representative, CWA Local 1039, petitions the Merit System
Board for reconsideration of its decision rendered on August
4, 1998 in which appellant's request for admittance to the
examinations for Administrative Analyst 1 (PS4619K) and
Management Improvement Specialist 2 (PS5639K) Medical
Assistance and Health Services, was denied.

ACTION: The Merit System Board denied the request.

B-74 SHERYL KLEIN HARKINS

Sheryl Klein Harkins petitions the Merit System Board for
reconsideration of its decision rendered on September 10,
1998 in which her request for admittance to the examination
for Management Improvement Specialist 2 (PS5639K) Medical
Assistance and Health Services was denied.

ACTION: The Merit System Board denied the request.

B-75 CHRISTINE C. MINNIS

Christine C. Minnis petitions the Merit System Board for
reconsideration of its final administrative decision
rendered on May 18, 1999, which upheld the determination of
the Division of Selection Services that she did not meet the
experience requirements for the Supervising Administrative
Analyst (PS6842K), Division of Youth and Family Services
promotional examination.

ACTION: The Merit System Board denied the request.

B-76 MARILYN BASS, SCOTT RODAS AND DANA ROBERTS

The Director, Division of Human Resource Management, seeks
relaxation of the provisions of N.J.A.C. 4A:4-1.5(a), to
allow the provisional appointment pending promotional
examination of Marilyn Bass from the noncompetitive title of
Public Information Assistant to the non-related competitive
title of Coordinator of Volunteers; Scott Rodas from the
noncompetitive title of Senior Audio Visual Aids Clerk to
the non-related competitive title of Program Coordinator
Special Events; and Dana Roberts from the noncompetitive
title of Principal Library Assistant to the non-related
competitive title of Public Information Officer.

ACTION: The Merit System Board granted the request.

B-77 DELORES D. CAMPBELL

Delores D. Campbell appeals the decision of the Manager,
Shared Services Center II to deny her appointment from the
special re-employment list for the title Technical Assistant
2, Department of Personnel (CSC).

ACTION: The Merit System Board directed that this matter
be held over.

B-78 BRUCE PRICE

Bruce Price appeals the determination of the Division of
Selection Services, which denied his request for a make-up
examination for Police Captain (PM3818V), City of Paterson.

ACTION: The Merit System Board directed that this appeal
be granted.

B-79 GLENDA C. BRYANT

Glenda C. Bryant appeals the determination which found that
she did not meet the one-year continuous permanent service
requirement for the examination for Legal Secretary
(PS7817Q), Office of the Public Defender.

ACTION: The Merit System Board directed that this appeal
be granted.

B-80 RESOLUTION FOR THE REVEREND S. HOWARD WOODSON

The resolution for the Reverend S. Howard Woodson is
submitted for adoption.

ACTION: The Merit System Board adopted the resolution.

The Merit System Board Minutes for the meeting of July 19,
1999, are submitted for adoption.

ACTION: The Merit System Board directed that the
minutes from the meeting of July 19, 1999 be held
over.

B-82 BRUCE C. COOKE

Bruce C. Cooke, a former provisional Senior Parole Officer,
Juvenile Justice, with the Juvenile Justice Commission,
Department of Law and Public Safety, appeals the
determination of the Attorney General, stating that the
appellant failed to present sufficient evidence to support a
finding of probable cause that he had been discriminated
against based on his race.

ACTION: The Merit System Board directed that this matter
be held over.
