DEPARTMENT OF BANKING & INSURANCE
The Department of Personnel is requesting the creation of three parent titles to be utilized in the Department of Banking & Insurance. Creation of these titles along with their variants will allow for proper classification of their management titles. The Department of Banking & Insurance previously requested to have eight titles inactivated in exchange for the creation of those listed below. The proposed salary ranges of the new titles are comparable to existing titles that perform similar duties.

Initial removal of name from eligible list for Environmental Specialist S60390) based on a claimed inability to communicate effectively in English in order to perform the duties of the position. Settled to the appellant's name being restored to the list for Environmental Specialist (S60390), and the list made appropriate for appointment to the position of Environmental Specialist Trainee.

The appeal of John McKeon, a Senior Correction Officer at East Jersey State Prison, represented by James J. Byrnes, Esq., concerning the denial of sick leave injury (SLI) benefits, was heard by Administrative Law Judge R. Jackson Dwyer (ALJ), who rendered his initial decision on May 21, 1999, acknowledging the settlement of the parties.
ACTION: The Merit System Board remanded the matter to the Office of Administrative Law.

Steven Appuliese, a Laborer with the City of Union City, represented by Robert Peluso, Esq., petitions the Merit System Board for interim relief of his removal, effective June 10, 1999, pending the outcome of his hearing at the Officer of Administrative Law.

The Borough of Carteret, represented by Brian O. Lipman, Esq., petitions the Merit System Board for a stay of its orders to reinstate Wayne Hundemann and Robert Terebetski to their former positions in In the Matter of Wayne Hundemann (MSB decided July 19, 1999) and In the Matter of Robert Terebetski (MSB, decided July 19, 1999), pending the outcome of its appeals to the Appellate Division of the Superior Court of New Jersey.

Rochelle Rosen, a Permit Clerk with Marlboro Township, requests enforcement of the Merit System Board (Board) decision in In the Matter of Susan Donis and Rochelle Rosen (MSB, decided January 14, 1997).
ACTION: The Merit System Board granted the request for enforcement in part.
B-28 WILLIE LOZADA
Willie Lozada, represented by Stuart A. Tucker, Esq., petitions the Merit System Board for back pay, benefits and seniority for the period of his separation from his position as an Income Maintenance Technician with the Hudson County Department of Health and Human Services. Appellant also requests counsel fees.
ACTION: The Merit System Board granted the request for back pay and benefits and denied the request for counsel fees.
B-29 WALTER WALKER
The Department of Corrections requests Merit System Board (Board) review of the amount of back pay to which Walter Walker, a Corrections Sergeant with Northern State Prison, is entitled based on the Board decision of April 15, 1997, acknowledging a settlement in this matter.
ACTION: The Merit System Board ordered the appointing authority to pay the appellant back pay in the amount of $65,384.09
B-30 HENRY MAGEE
Henry Magee, a Fire Fighter with the Town of Kearney, appeals his two-month suspension, on charges. The matter was transmitted to the Office of Administrative Law for a hearing before Administrative Law Judge Thomas R. Vena (ALJ). However, the hearing on the merits of the charges did not proceed since the ALJ granted the Town counsel's request to amend the final notice to withdraw the charges on the grounds that appellant had retired without serving the two-month suspension. Appellant then sought counsel fees. The ALJ issued an initial decision on August 2, 1999. The Merit System Board, at its meeting on September 21, 1999, affirmed the ALJ's recommendation to dismiss appellant's appeal with prejudice as moot and to deny appellant's application for counsel fees. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.
B-31 SIMMIE PIPKIN
The appeal of Simmie Pipkin, a Senior Quality Control Reviewer with the Department of Human Services, regarding a 10-day suspension on charges, was heard by Administrative Law Judge Katherine A. Clark (ALJ), who rendered her initial decision on August 3, 1999 reducing the 10-day suspension to a three-day suspension. At its meeting on September 21, 1999, the Board did not affirm the ALJ's recommendation. Rather, the Board concluded that the appointing authority's action in imposing a 10-day suspension was appropriate. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.
B-32 AURORA REEVES
The appeal of Aurora Reeves, a Customer Service Information Specialist with the Department of Transportation, of her 116- day suspension, was heard by Administrative Law Judge M. Kathleen Duncan (ALJ), who rendered her initial decision on August 12, 1999. At its meeting on September 21, 1999, the Board adopted the ALJ's recommendation that the appellant's 116-day suspension be upheld. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.
B-33 MELISSA BATCHELOR
On behalf of Melissa Batchelor, the Deputy Surrogate of Passaic County appeals the determination of the Division of Selection Services which found that Ms. Batchelor did not meet the experience requirement for the promotional examination for Probate Clerk (PC1908W), Passaic County.
ACTION: The Merit System Board directed that this appeal be granted.
