A regular meeting of the Merit System Board was held on
Tuesday, October 13, 1999, in Trenton, New Jersey.

PRESENT: Chairwoman Janice Mitchell Mintz; Merit System Board
Members, Alan Dexter Bowman, Margaret E.L. Howard and Judith L.
Shaw, Elizabeth Laufer, Deputy Attorney General; Henry Maurer,
Director, Elizabeth A. Napolitano, Sybil Janowitch and Charles
Spano, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Janice Mitchell Mintz,
Chairwoman, Merit System Board, opened the meeting with the
following statement:

Notice of this meeting was filed with the Secretary of
State and sent to the Trentonian, Trenton Times, Courier-Post
and Star Ledger on November 30, 1998 and posted at the
Department of Personnel, 3 Station Plaza, Trenton, New Jersey.

All other actions were by unanimous vote unless otherwise
specified.

The Merit System Board approved the recommended changes in the
State Classification Plan, copies of which are attached hereto
and made a part hereof.

SUBJECT: Change in the Classification Plan

DEPARTMENT OF BANKING & INSURANCE

The Department of Personnel is requesting the creation of three
parent titles to be utilized in the Department of Banking &
Insurance. Creation of these titles along with their variants
will allow for proper classification of their management titles.
The Department of Banking & Insurance previously requested to
have eight titles inactivated in exchange for the creation of
those listed below. The proposed salary ranges of the new titles
are comparable to existing titles that perform similar duties.

Patrick Monaghan, Truck Driver Single Axle, Department of
Transportation, suspensions (3) and removals (3), on charges
of conduct unbecoming a public employee, assault and/or
battery, and insubordination.

Recommendation of the Administrative Law Judge - Uphold a
one-day suspension, a two-day suspension, a five-day
suspension, two ten-day suspensions, and removal.

ACTION: The Merit System Board directed that this matter
be held over.

A-3 MAGDALENA JOHNSON

Magdalena Johnson, Computer Operator 2, OTIS, Department of
Treasury, OTIS Division, removal effective June 8, 1998, on
charges of abandonment, absence from duty for more than five
consecutive business days.

Recommendation of the Administrative Law Judge - Modify to a
resignation not in good standing.

ACTION: The Merit System Board upheld the
resignation not in good standing.

A-4 NINA D. SATCHEL AND ANGELIQUE J. SATCHEL

Nina D. Satchel and Angelique J. Satchel, Sheriff's
Officers, Sheriff's Office, County of Camden, removals
effective April 1, 1998, each appellant on the charge of
conduct unbecoming a public employee

Recommendation of the Administrative Law Judge - Uphold the
removals.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law Judge.

A motion was made and seconded that the open session be
recessed and that, pursuant to Section 12(b) of the Open
Public Meetings Act, the Merit System Board entered into
Executive Session for the purpose of legal advice on the
matter of A-5 Curry Singleton and B-62 Christopher Silva.
The Board subsequently reconvened the public meeting.

A-5 CURRY SINGLETON

Curry Singleton, Hospital Attendant, Essex County Hospital
Center, Essex County, removal effective May 1, 1997, on
charges of incompetency or failure to perform duties,
insubordination, conduct unbecoming a public employee,
neglect of duty, patient abuse, unfitness for duty.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law Judge.

A-6 WILLIAM BARTLESON, JR.

William Bartleson, Jr., Correction Officer Recruit, Bayside
State Prison, Department of Corrections, removal effective
May 14, 1998, on charges of conduct unbecoming an employee.
The Merit System Board at its meeting of August 31, 1999,
directed that this matter be held over for a testimony
summary.

Recommendation of the Administrative Law Judge - Modify the
removal to a 60 day suspension.

ACTION: The Merit System Board modified the
recommendation of the Administrative Law Judge to
uphold the removal.

A-7 THELMA EVANS-KNIGHT - SETTLEMENT

Initial suspension for 10 days, on charges of neglect of
duty and failure to follow proper procedures. Settled to a
7 day suspension. The Merit System Board at its meeting of
August 31, 1999, directed that this matter be held over for
further clarification.

Recommendation of the Administrative Law Judge - Acknowledge
the settlement.

ACTION: The Merit System Board acknowledged the
settlement.

A-8 DAVID BALCHUNAS

David Balchunas, Senior Correction Officer, Mid State
Correctional Facility, Department of Corrections, removal
effective June 5, 1998, on charges of conduct unbecoming a
public employee and prowling in a public place for the
purpose of obtaining controlled substances. The Merit
System Board at its meeting of September 28, 1999, directed
that this matter be held over for further review.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the
recommendation of the Administrative Law Judge.

A-9 BRIAN RAGAUCKAS - SETTLEMENT

Initial release at the end of working test period effective
April 16, 1997. Settled to return to full term of training
in a police training academy with the next municipal class
of police trainees. The Merit System Board at its meeting
of September 21, 1999, directed that this matter be held
over for further clarification.

Recommendation of the Administrative Law Judge - Acknowledge
the settlement.

ACTION: The Merit System Board acknowledged the
settlement.

A-10 SWAPNA DAS - SETTLEMENT

Initial removal of name from eligible list for Environmental
Specialist S60390) based on a claimed inability to
communicate effectively in English in order to perform the
duties of the position. Settled to the appellant's name
being restored to the list for Environmental Specialist
(S60390), and the list made appropriate for appointment to
the position of Environmental Specialist Trainee.

Recommendation of the Administrative Law Judge - Acknowledge
the Settlement.

ACTION: The Merit System Board acknowledged the
settlement.

B-1 PATRICK S. BOLGER

Patrick S. Bolger appeals his rejection as a Correction
Officer Recruit by the Department of Corrections and its
request to remove his name from the eligible list for
Correction Officer Recruit on the basis of psychological
unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-2 RICHARD QUINN

Richard Quinn, represented by Stacey B. Rosenberg, Esq.,
appeals his rejection as a Fire Fighter candidate by the
City of Bayonne and its request to remove his name from the
eligible list for Fire Fighter on the basis of psychological
unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that
this matter be referred for independent
evaluation.

Charles J. Sheridan appeals his rejection as a Police
Officer candidate by the Township of Millburn and its

Mila Tirado appeals her rejection as a County Correction
Officer by the County of Cape May and its request to remove

Buddy Camp appeals his rejection as a Police Officer
candidate by Camden City and its request to remove his name

position.

B-7 MARIE BENNETT

Marie Bennett, a Supervising Community Program Specialist
with Green Brook Regional Center, Department of Human
Services, represented by William E. Hinkes, Esq., appeals
the denial of sick leave injury (SLI) benefits. Appellant
also requests counsel fees.

ACTION: The Merit System Board denied the request.

Sandra Boyd, a Head Clerk with the Division of Youth and
Family Services, Department of Human Services, appeals the

B-19 CHARLES NADROWSKI

Charles Nadrowski, represented by Arnold C. Lakind, Esq.,
appeals the decision of Human Resource Information Services
which found that the appointing authority had presented a
sufficient basis to remove his name from the eligible list
for Police Officer (S9998U), City of Bayonne, on the basis
of an unsatisfactory driving record.

ACTION: The Merit System Board directed that this appeal
be granted.

B-20 STEVEN O'LEARY

Steven O'Leary, represented by Gary M. Marek, Esq., appeals
the City of Camden's decision to remove his name from the
eligible list for Police Officer (S9999W) based on his non-
residency.

ACTION: The Merit System Board directed that this appeal
be granted.

B-21 DANIEL COYLE

The City of Jersey City, represented by Paul W. Mackey,
First Assistant Corporation Counsel, petitions the Merit
System Board for reconsideration of that portion of the
final administrative decision, rendered on May 18, 1999,
which granted the appeal of Daniel Coyle and afforded him a
retroactive date of appointment for "salary step placement
and seniority-based purposes only."

ACTION: The Merit System Board denied the request for
reconsideration.

B-22 ASA PHILLIPS

Mercer County, represented by Andrew J. Schragger, Assistant
County Counsel, petitions the Merit System Board to
reconsider its final decision, rendered June 8, 1999, which
reversed the County's imposition of a removal of County
Correction Officer Asa Phillips on charges.

ACTION: The Merit System Board denied the request for
reconsideration.

B-23 JOHN MCKEON

The appeal of John McKeon, a Senior Correction Officer at
East Jersey State Prison, represented by James J. Byrnes,
Esq., concerning the denial of sick leave injury (SLI)
benefits, was heard by Administrative Law Judge R. Jackson
Dwyer (ALJ), who rendered his initial decision on May 21,
1999, acknowledging the settlement of the parties.

ACTION: The Merit System Board remanded the
matter to the Office of Administrative Law.

B-24 JUAN GONZALEZ

Juan Gonzalez, Supervisor, Vehicle Maintenance, Newark State
Operated School District, represented by Kevin P. McGovern,
Esq., requests a hearing concerning his removal on charges.

ACTION: The Merit System Board directed that this matter
be held over.

B-25 STEVEN APPULIESE

Steven Appuliese, a Laborer with the City of Union City,
represented by Robert Peluso, Esq., petitions the Merit
System Board for interim relief of his removal, effective
June 10, 1999, pending the outcome of his hearing at the
Officer of Administrative Law.

ACTION: The Merit System Board denied the request for
interim relief.

B-26 WAYNE HUNDEMANN AND ROBERT TEREBETSKI

The Borough of Carteret, represented by Brian O. Lipman,
Esq., petitions the Merit System Board for a stay of its
orders to reinstate Wayne Hundemann and Robert Terebetski to
their former positions in In the Matter of Wayne Hundemann
(MSB decided July 19, 1999) and In the Matter of Robert
Terebetski (MSB, decided July 19, 1999), pending the outcome
of its appeals to the Appellate Division of the Superior
Court of New Jersey.

ACTION: The Merit System Board denied the request for a
stay.

B-27 ROCHELLE ROSEN

Rochelle Rosen, a Permit Clerk with Marlboro Township,
requests enforcement of the Merit System Board (Board)
decision in In the Matter of Susan Donis and Rochelle Rosen
(MSB, decided January 14, 1997).

ACTION: The Merit System Board granted the
request for enforcement in part.

B-28 WILLIE LOZADA

Willie Lozada, represented by Stuart A. Tucker, Esq.,
petitions the Merit System Board for back pay, benefits and
seniority for the period of his separation from his position
as an Income Maintenance Technician with the Hudson County
Department of Health and Human Services. Appellant also
requests counsel fees.

ACTION: The Merit System Board granted the
request for back pay and benefits and denied the
request for counsel fees.

B-29 WALTER WALKER

The Department of Corrections requests Merit System Board
(Board) review of the amount of back pay to which Walter
Walker, a Corrections Sergeant with Northern State Prison,
is entitled based on the Board decision of April 15, 1997,
acknowledging a settlement in this matter.

ACTION: The Merit System Board ordered the
appointing authority to pay the appellant back pay
in the amount of $65,384.09

B-30 HENRY MAGEE

Henry Magee, a Fire Fighter with the Town of Kearney,
appeals his two-month suspension, on charges. The matter
was transmitted to the Office of Administrative Law for a
hearing before Administrative Law Judge Thomas R. Vena
(ALJ). However, the hearing on the merits of the charges
did not proceed since the ALJ granted the Town counsel's
request to amend the final notice to withdraw the charges on
the grounds that appellant had retired without serving the
two-month suspension. Appellant then sought counsel fees.
The ALJ issued an initial decision on August 2, 1999. The
Merit System Board, at its meeting on September 21, 1999,
affirmed the ALJ's recommendation to dismiss appellant's
appeal with prejudice as moot and to deny appellant's
application for counsel fees. The proposed final decision
is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-31 SIMMIE PIPKIN

The appeal of Simmie Pipkin, a Senior Quality Control
Reviewer with the Department of Human Services, regarding a
10-day suspension on charges, was heard by Administrative
Law Judge Katherine A. Clark (ALJ), who rendered her initial
decision on August 3, 1999 reducing the 10-day suspension to
a three-day suspension. At its meeting on September 21,
1999, the Board did not affirm the ALJ's recommendation.
Rather, the Board concluded that the appointing authority's
action in imposing a 10-day suspension was appropriate. The
proposed final decision is now submitted for the Board's
review.

ACTION: The Merit System Board adopted the final decision.

B-32 AURORA REEVES

The appeal of Aurora Reeves, a Customer Service Information
Specialist with the Department of Transportation, of her 116-
day suspension, was heard by Administrative Law Judge M.
Kathleen Duncan (ALJ), who rendered her initial decision on
August 12, 1999. At its meeting on September 21, 1999, the
Board adopted the ALJ's recommendation that the appellant's
116-day suspension be upheld. The proposed final decision
is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-33 MELISSA BATCHELOR

On behalf of Melissa Batchelor, the Deputy Surrogate of
Passaic County appeals the determination of the Division of
Selection Services which found that Ms. Batchelor did not
meet the experience requirement for the promotional
examination for Probate Clerk (PC1908W), Passaic County.

ACTION: The Merit System Board directed that this appeal
be granted.

B-34 YOLANDA R. BROWN

Yolanda R. Brown appeals the decision of the Division of
Selection Services which found that appellant did not meet
the experience and education requirements for the
promotional examination for Accounting Assistant (PM0746U),
Atlantic City Housing Authority.

ACTION: The Merit System Board directed that this appeal
be granted.

B-35 ANTHONY CORRENTE AND GLEN D. WARD

Anthony Corrente and Glen D. Ward jointly appeal their
ineligibility for admittance to the promotional examination
for County Correction Lieutenant (PC0234W), Morris County.

ACTION: The Merit System Board directed that this appeal
be denied.

B-36 BRIAN K. DELLABELLA

Brian K. Dellabella appeals the determination of the
Division of Selection Services which found that he did not
meet the experience requirements for the promotional
examination for Management Specialist (PM0393W), Bayonne.

ACTION: The Merit System Board directed that this appeal
be denied.

B-37 JOHN P. DORRITY

John P. Dorrity appeals the determination of the Division of
Selection Services, which found that he did not meet the
experience requirement for the open competitive examination
for County Alcoholism Coordinator (C6409W), Ocean County.

ACTION: The Merit System Board directed that this appeal
be denied.

Joao A. D'Souza appeals the determination of the Division of
Selection Services which found that he did not meet the

Director of Traffic and Transportation (PM0776W), Jersey
City.

ACTION: The Merit System Board directed that this appeal
be granted.

Neil B. Hamilton appeals the determination of the Division
of Selection Services which found that he did not meet the
experience requirements for the open competitive examination
for Code Enforcement Officer/Zoning Officer (M6432W),
Manasquan Borough.

ACTION: The Merit System Board directed that this appeal
be denied.

B-40 VALERIE M. HARRIS

Valerie M. Harris appeals the decision of the Division of
Selection Services which found that she did not meet the
experience requirements for the promotional examination for
Office Services Manager (PC6701W), Family and Community
Development, Atlantic County.

ACTION: The Merit System Board directed that this appeal
be denied.

County.

James P. Manski appeals the determination of the Division of

Esq., requests interlocutory review of the September 1, 1999
Order of Administrative Law Judge Edgar R. Holmes (ALJ) in
Christopher Silva v. Little Egg Harbor Township pursuant to
N.J.A.C. 1:1-14.10(a).

ACTION: The Merit System Board granted the
request for interlocutory review and modified the
Order of the Administrative Law Judge.

B-63 MICHAEL RUSSO

Michael Russo petitions the Merit System Board for
reconsideration of its decision rendered on December 17,
1996, In the Matter of Department of Transportation, in
which the Board acknowledged a settlement between the
Communications Workers of America and the Department of
Transportation. That decision, in part, provided that the
scores of candidates who participated in the March 29, 1995
Manager 2, Department of Transportation, Roadway Design
(PS8070T) promotional examination would be applied to the
1997 administration of the Manager 2, Department of
Transportation, Roadway Design (PS4245T) promotional
examination administered on May 5, 1997.

ACTION: The Merit System Board denied the request.
