How to Obtain a No Further Action Letter

Regardless of prior use, all child care centers must conduct an environmental review and receive a No Further Action letter before the DCF Office of Licensing will approve an application to operate a child care center.

Environmental Review
An environmental review must include, at a minimum, a Preliminary Assessment (conducted in accordance with the Technical Requirements for Site Remediation) and documentation that safe drinking water is being provided. This minimum package must be accompanied by a $375 check made payable to Treasurer, State of New Jersey and submitted to:

  • To expedite review time by the Department of Health and Senior Services , you should also send a copy of the PA (no fee required) to:

  • If the Preliminary Assessment does not indicate any Areas of Concern which would warrant a Site Investigation, then the approved Preliminary Assessment with water documentation should be the only items needed for DEP to issue the No Further Action letter.
  • If the Preliminary Assessment indicates that a Site Investigation is warranted, the SI report should be submitted to NJDEP along with a fee of $750 and sent to the address referenced above.
  • If the results of the PA and SI (if needed) indicate that there is no contamination at the site, the NJDEP will issue a No Further Action letter.
  • If the results of the PA/SI indicate that there is contamination at the site, the applicant must sign a Memorandum of Agreement (MOA) with NJDEP and conduct a Remedial Investigation and Remedial Action.
  • MOA applications are available by contacting the Case Assignment Section at (609) 292-2943. Direct billing costs for NJDEP oversight and review of all submitted documents will apply.
  • With the MOA application, a Remedial Investigation Workplan should be submitted to the NJDEP or a Remedial Investigation Report and/or Remedial Action Workplan.

When the Remedial Action report is approved by NJDEP, a No Further Action letter will be issued.
