Water Resource Management Rule Update
The comment period on the below-listed portions of the New Jersey Pollutant Discharge Elimination System (NJPDES) rule proposal, N.J.A.C. 7:14A, (DEP Docket Number 54-95-12/205) expired November 4, 1996. (The comment period on these portions of the NJPDES proposal had previously been scheduled to close on October 4, 1996.)
- In their entirety, Subchapters 1 (Abbreviations, Acronyms, and Definitions), 5 (Technical Requirements for Ambient Studies for DSW Permits), 12 (Effluent Standards Applicable to Direct Discharges to Surface Water and Indirect Discharges to Domestic Treatment Works), and 13 (Effluent Limitations for DSW Permits)
- Individual sections, N.J.A.C. 7:14A-2.12 (Ambient water quality studies), N.J.A.C. 7:14A-4.5 (Specific technical application requirements for direct DSWs), N.J.A.C. 7:14A-4.10 (Technical requirements for NJPDES-DSW applications), N.J.A.C. 7:14A-7.4 (Exemptions [from requirements for discharges to ground water]), and N.J.A.C. 7:14A-7.5 (Authorization of discharges to ground water by permit-by-rule)
In addition, the DEP decided to not adopt certain portions of the rule proposal governing Water Pollution Control Act/Civil Administrative Penalties and Requests for Adjudicatory Hearings, N.J.A.C. 7:14-8 (DEP Docket Number 56-95-12/576; see 28 N.J.R. 720(a)). The DEP determined additional time is needed to publicly discuss and resolve issues and concerns which have arisen during the comment period. Specifically, the DEP will not be adopting the proposed amendments at N.J.A.C. 7:14-8.1 through 8.15, except N.J.A.C. 7:14-8.1(e) and (f) and 8.3(h) relating to the sections regarding indirect dischargers and industrial pretreatment programs at N.J.A.C. 7:14-8.16 and 8.17 (for which the comment period closed August 5, 1996). The comment period for N.J.A.C. 7:14-8.1(e) and (f), and 8.3(h) closed November 4, 1996.
The DEP is also not adopting the proposal to amend the Surface Water Quality Standards (SWQS), N.J.A.C. 7:9B (DEP Docket Number 57-95-12/577) and will continue public discussions with interested parties in an effort to draft a re-proposal of these amendments.
