| The only necessary provision for administrative continuance of an expired permit is that the permitee submit a timely and complete application request for renewal. |
While the Division has continued to renew presently expired permits as quickly as possible, many permittees request assurance that they may continue to discharge under the terms and conditions of their existing permit without the threat of enforcement action.
The current NJPDES rules at N.J.A.C. 7:14A-2.8 stipulate that expired NJPDES permits are continued in full force until a new permit or authorization under a general permit has been issued. The only necessary provision for administrative continuance of an expired permit is that the permittee submit a timely and complete application request for renewal. This means an administratively complete renewal application must be submitted at least 180 days prior to the expiration date of an existing permit.
The bottom line--all permittees who have submitted a timely and complete renewal application for their existing NJPDES permits may continue to discharge from their facilities in accordance with the terms and conditions of that permit.
