PROGRAM DESCRIPTION:

Underground Storage Tank (UST) is a component of the Division’s Water Compliance and Enforcement program. This program is dedicated to enforcing what are commonly referred to as the “operational compliance” requirements for USTs, found in N.J.A.C. 7:14B. These include, but are not limited to, registration, general operating procedures, release detection, release reporting and investigation, out-of-service and closure procedures and financial responsibility.

The bureau functions include providing compliance assistance, performing UST facility inspections, and the investigation of regulated UST related complaints. The bureau also issues enforcement documents that may include penalty assessments, negotiation of return to compliance schedules and penalty settlements. In addition, the bureau assists the Attorney General 's Office in developing enforcement cases and testifying in court, and negotiating compliance schedule and penalty settlements.

MONETARY ASSISTANCE PROVIDED:

No monetary assistance is provided. However, the County Environmental Health Act (CEHA) Program provides grant money to certified county health agencies for the purpose of supporting environmental health services. This program can provide free on-site compliance assistance upon request to determine regulatory compliance under the department’s Greenstart program.
