Notice of Rule Proposal
N.J.A.C. 7:27-27 Control and Prohibition of Mercury Emissions,
and N.J.A.C. 7:27A-3.10
Public Notice
Take notice that the NJ Department of Environmental Protection
is proposing new rules and amendments at N.J.A.C. 7:27-27, Control
and Prohibition of Mercury Emissions, which set forth the requirements
and procedures for the control and prohibition of air pollution
from mercury emissions. The Department is also proposing related
amendments at N.J.A.C. 7:27A-3.10, Air Administrative Procedures
and Penalties. These new rules and amendments would establish
new requirements for municipal solid waste (MSW) incinerators,
hospital/medical/infectious waste (HMIW) incinerators, iron
and steel melters, and coal-fired boilers, in order to prevent
or decrease emissions of mercury from these operations by requiring
MSW incinerators to further reduce their mercury emissions,
by ensuring that the mercury emissions from HMIW incinerators
will be maintained at low levels, and by requiring the mercury
emissions from iron and steel melters and coal-fired boilers
to be reduced. An additional reduction of about 1,500 pounds
mercury per year would be accomplished. The reductions would
be in addition to the approximately 4,000 pounds per year mercury
emission reductions that were achieved with the adoption of
the first mercury rule on November 7, 1994.
The proposal is scheduled to be published in the New Jersey
Register dated January 5, 2004. Copies of the Department’s
