Subject [SRRA] Vapor Intrusion Investigations at Sites with Number 2 Fuel Oil & Diesel Fuel Oil Contamination

The Department has proposed amendments to the Administrative Requirements for the Remediation of Contaminated Sites (ARRCS) rules at N.J.A.C. 7:26C and the Technical Requirements for Site Remediation rules (Technical Regulations) at N.J.A.C. 7:26E that amends certain mandatory timeframes and regulatory timeframes. The proposal also amends the trigger for what constitutes a vapor intrusion immediate environmental concern in the Technical Regulations and creates a new class of cases that will be called "vapor concern" cases. The proposal can be found on DEP's Web site at https://www.nj.gov/dep/rules/proposals/100410a.pdf .

The Department has also issued a Compliance Advisory which provides critical information and updates relating to these proposed rule changes. https://www.nj.gov/dep/enforcement/advisories/2010-12.pdf The Compliance Advisory applies to all persons who are responsible for conducting remediation in New Jersey, regardless of when remediation was initiated or whether a licensed site remediation professional has been retained.

Should you have questions, please refer to the Compliance Advisory for a list of SRP contacts. If you are currently working with the Department on an existing case and have questions regarding the advisory, please contact your assigned case manager for clarification.

Thank you.
