New Jersey Specific Requirements - Correspondent Residential Mortgage Lender Branch


Each branch location desiring to conduct business under a company license must be separately licensed and will require a filing of Form MU3 to New Jersey through the Nationwide Mortgage Licensing System (“NMLS”).  A branch office is any office, other than the principal licensed office of a company, where in the regular course of business applications for residential New Jersey mortgage loans are distributed to or received from consumers, loan records are maintained, underwriting decisions are made, commitments or lock-in agreements are issued, or any fees or charges relating to such loans are received from consumers.

An application for a branch office license MUST be for a license of the same type as that being applied for or held by the company.

A branch manager must be designated for each licensed location.  The branch manager is expected to be located at the branch office and to supervise the residential mortgage lending or brokering activities of that location.  The branch manager will be required to become licensed as a Mortgage Loan Originator if he/she will perform any of the activities requiring such licensure.

Certification of Office Suitability
Provision of an executed certification, as prescribed by the commissioner, of office suitability.  NOTE: select the applicable certification for the branch – (1) an office to be located within the State of New Jersey OR (2) an office to be located outside of New Jersey.

Disclosure Questions
Provision of complete details of all events or proceedings for any “Yes” answer to any of the Disclosure questions in the Form MU3 for the Branch Manager, including copies of any applicable orders, judgments of conviction or other documents.

Within 5 business days of the electronic submission of the application to New Jersey through the NMLS, jurisdiction-specific requirements as identified above must be submitted to the Department at the following:
