New Jersey State Board of Education Contact InformationOffice of the State Board The office serves as a liaison between the Commissioner and the State Board of Education and between the State Board and the public. The office provides support services to the State Board by coordinating the board's meetings and public testimony sessions. It also coordinates the board's special projects and committees. In addition, the office is responsible for the administrative code review process and the equivalency and waiver process. It provides administrative services for State Board-related activities, and it also prepares and conducts orientation for new board members and senior staff. Director: Diane Shoener NOTICE – STATE BOARD APPEALS ELIMINATED On July 7, 2008, Governor Corzine signed into law P.L. 2008, c. 36, which eliminated the role of the State Board of Education in determining appeals from Commissioner of Education decisions. All decisions of the Commissioner now constitute final agency action under the Administrative Procedure Act, N.J.S.A. 52:14B-1 et seq., and therefore, appeals of Commissioner’s decisions go directly to the Appellate Division of the Superior Court. The State Board no longer has authority to consider any appeal of a Commissioner’s decision. The law further provided that the underlying Commissioner’s decision is the final agency action in all cases pending before the State Board at the time of the law’s enactment. Appellants had 45 days from the effective date of the law to file an appeal with the Appellate Division. The law also changes the process for appeals of decisions of the State Board of Examiners and the School Ethics Commission. These appeals now are made directly to the Commissioner, whose determination will be the final agency action. Any such appeals pending before the State Board at the time of the law’s enactment were to be transferred to the Commissioner for review and determination.
