The Departments of Health and Senior Services, and Labor and Workforce Development are jointly proposing the readoption with amendments of rules regarding asbestos licenses and permits (N.J.A.C. 8:60 and N.J.A.C. 12:120.) Specifically, the two identical chapters: · set forth the licensure requirements for employers; · set forth the requirements and procedures for obtaining an asbestos worker or an asbestos supervisor permit; · establish the procedures and qualifications required to obtain, maintain, or renew certification to conduct training courses for asbestos abatement; · establish the requirements for notifying the Departments of Labor and Workforce Development and Health and Senior Services as to when and where asbestos work will be undertaken; · set forth the procedures for appealing any action or inaction by the Commissioner of Health and Senior Services or the Commissioner of Labor and Workforce Development under N.J.S.A. 34:5A-32, et seq., the Asbestos Control and Licensing Act; · establish procedures for filing citizen complaints alleging violations of the Act; and · address the administration of the licensing, permitting and certification standards required under the Act. Amendments are proposed throughout the rules to reflect the name change of the Department of Labor to the Department of Labor and Workforce Development. The title of Commissioner of the Department is likewise updated. Agency addresses have also been updated as necessary.
