ALCOHOL AND DRUG COUNSELOR COMMITTEE
DUTY TO REPORT
N.J.A.C. 13:34C-3.4
Take notice that the Division of Consumer Affairs has discovered errors in the text of N.J.A.C. 13:34C-3.4. N.J.A.C. 13:34C was adopted as new rules effective March 15, 2004 (see 35 N.J.R. 3441(a) and 36 N.J.R. 1394(a)). As proposed and adopted, N.J.A.C. 13:34C-3.4(a)5 and (b)5 each reference N.J.A.C. 13:34C-1.8(c) for a list of prohibited acts. Upon adoption, proposed N.J.A.C. 13:34C-1.8(a) was deleted, resulting in the recodification of proposed N.J.A.C. 13:34C-1.8(b) and (c) as (a) and (b); however, the recodification upon adoption of proposed N.J.A.C. 13:34C-1.8(c) as (b) was not reflected in the N.J.A.C. 13:34C-3.4(a)5 and (b)5 references. This notice, correcting those references, is published pursuant to N.J.A.C. 1:30- 2.7.

13:34C-3.4 Duty to report
(a) A licensee or certificate holder shall notify the Committee of misconduct of another alcohol or drug counselor which the licensee or certificate holder has reason to believe has not been disclosed to the Committee. Such misconduct includes specific acts or omissions or the fact that a counselor has:
1.-4. (No change.)
5. Engaged in any prohibited act listed in N.J.A.C. 13:34C-1.8<<- (c)->><<+(b)+>> and 3.2.
(b) A licensee or certificate holder shall notify the Committee of one's own misconduct which the licensee or certificate holder has reason to believe has not been disclosed to the Committee. Such misconduct includes specific acts or omissions or the fact that a counselor has:
1.-4. (No change.)
5. Engaged in any prohibited act listed in N.J.A.C. 13:34C-1.8<<- (c)->><<+(b)+>> and 3.2
(c) (No change.)
