The Board Minutes of January 7, 2009, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of February 4, 2009, or soon thereafter as it may be considered. All requirements of the "Open Public Meetings Act" have been complied with according to N.J.S.A. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Meeting of January 7, 2009, was called to order at 9:00 A.M.
The following members were present:

Marian Fiore, Sr. Management Assistant, was present from 9:00 A.M. until the close of the meeting.

Kathleen Moran, Administrative Assistant, III, was present from 9:00 A.M. until the close of the meeting.

Ginger R. Provost, Deputy Attorney General, Division of Law, was present from 9:00 A.M. until the close of the meeting.

Miguel Dominguez, Intern, Division of Law, was present.

The Board saluted the Flag.

The Minutes of the 827TH Business Meeting held December 3, 2008, were not available for approval by the Board.

Motion made by Mr. James H. Flaherty and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve (10) Initial Licenses effective December 3, 2008 to March 31, 2012.

Motion made by Mr. James H. Flaherty and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve (7) Initial Business Permits effective December 3, 2008 to March 31, 2012. Three (3) Initial Business Permits are effective December 3, 2008 to March 31, 2009.

Motion made by Mr. James H. Flaherty and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve (10) Changes in Business Permits effective December 3, 2008 to March 31, 2009.

Check in the amount of $1,500.00, and signed formal reprimand, received from Ronald M. DeGesero, License #6307, as the first and final payment of a civil penalty in the amount of $1,500.00 for violation of N.J.S.A. 45:5A-15.

The Board accepted the payment.

Check in the amount of $1,000.00 received from Alman Clarke, License #11026, as the first and final payment of a civil penalty in the amount of $1,000.00 for violation of N.J.A.C. 13:31-3.2 (a & b).

The Board accepted the payment.

Check in the amount of $100.00 received from James H. Gandy, Unlicensed, as the twentieth installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3. Payments started May 25, 2007 and the balance due is $500.00.

The Board accepted the payment.

Letter dated December 12, 2008, received from Arnold Santos, License #8876, requesting fifteen hours of credit towards the renewal of his License #8876 pursuant to N.J.A.C. 13:31-1.7. Mr. Santos taught the nine hours of code changes and the one hour of laws, rules and regulations and a five hour course entitled "Lighting & Appliances".

Motion made by Mr. Constantinos Papademas and seconded by Mr. Mitchell R. Malec, and unanimously passed, that Mr. Santos be granted 15 credits towards his 2009 to 2012 triennial license renewal.

At its meeting held April 2, 2008, Mr. McCullough advised the Board that in September 2003 the Bureau of Fire Safety issued certifications to Fire Alarm Contractors. The Bureau of Fire Safety stipulated that fire alarm contractors and electrical contractors did not need the certification issued by the Department of Community Affairs as long as those licenses were issued before March 2004.

At the April 2, 2008 meeting, Mrs. Cook advised the Board that a licensed electrical contractor or licensed fire alarm contractor would need this certification if their license was issued after March 2004.

A licensed electrical contractor contacted the Board office stating that the Bureau of Fire Safety advised him that he did not need certification because he was a licensed electrical contractor. Therefore, he is not sure if he needs this certification.

Mr. McCullough suggested that a letter be sent to the Bureau of Fire Safety as the Department of Community Affairs was somewhat adamant in saying that as long as our licensees were issued their license before March 2004 they did not have to register or get the certification from Fire Safety.

Mr. Malec stated that pursuant to N.J.A.C. 5:74-2.2 persons who were issued a fire alarm contractor’s license pursuant to 45:5A-23 by March 1, 2004, or are licensed electrical contractors, are considered exempt. Therefore, it would appear that a licensee of this Board would not need certification from Fire Safety.

Motion made by Mr. James H. Flaherty and seconded by Mr. Constantinos Papademas, and unanimously passed, that Deputy Attorney General Ginger R. Provost clarify the above with the Bureau of Fire Safety.

The Board reviewed a memorandum dated November 25, 2008, received from Darlene Kane, Budget Officer, Division of Consumer Affairs, stating that for the first quarter of Fiscal Year 2009, the Board/Committee was directly billed for 103.9 hours of Deputy Attorney General/Paralegal services totaling $15,644.50.

The Board reviewed applications for the written examination to be administered by Thomson Prometric. Eight (8) applications were approved.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Constantinos Papademas, and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action.
