LEGALIZED GAMES OF CHANCE CONTROL COMMISSION
PUBLIC SESSION MINUTES
January 12, 2005

A meeting of the Legalized Games of Chance Control Commission was held on January 12, 2005 at 10:35 A.M., at the Office of the Division of Consumer Affairs, located at 124 Halsey Street, 6th Floor, Somerset Room, Newark, New Jersey. Present for the meeting were Chairperson Marilou C. Halvorsen, Commissioners Christine Vanek, Esq., Edward F. Barrett and Timothy E. Ryan, Executive Officer William J. Yorke (EO), Deputy Attorney General (DAG) Jodi Krugman, DCA Managing E.D. William Mandeville, Johnathan Eisenmenger, Assistant to William Mandeville, Regulatory Analyst, Gene Brenycz, Assistant Counsel, Authority Unit, Office of the Governor, Victoria Pratt, Investigators Annette Misukonis and Martin Silva, and support staff Michelle Rouette and Farah Rodriguez.

The meeting was opened at 10:35 a.m. by Chairperson Marilou Halvorsen pursuant to provisions of the Open Public Meetings Act, N.J.S.A. 10:4-1 et seq.

GENERAL DISCUSSION

1. Minutes of the Public Session meeting of December 8, 2004 - The Commission approved the Public Session minutes of the December 8, 2004 meeting.

2. Public Comment - Edward R. McGlynn, Esq.,Amusement Association, informed the Commission that Dr. Harold Nolan, Monmouth College Professor, had been retained by the Association to study and compile a report regarding the current price to play amusement games and the value of prizes awarded. Dr. Nolan’s report is expected to be available mid February. Mr. McGlynn stated that the Association anticipates the report will indicate an increase in the charge to play and the value of awarded prizes is justified. If that is the case, the Association will present the report to the Commission to substantiate its request to increase the charge to play and the value of prizes awarded. Mr. McGlynn acknowledged that the Commission is required by law to conduct a public hearing on the reasonableness of increasing the price to play and/or the value of prizes awarded. He asked the Commission to realize the importance of the industry receiving the approval of the increases before Memorial Day. Mr .Mc Glynn also commented on LGCCC’s program of inspecting the software contained in electronic amusement games in Point Pleasant, New Jersey. The inspection has disclosed computer chips used in cranes that did not match the certification. It is his understanding that the manufacturer have provided unapproved replacement chips without the operator’s knowledge

3. Statistics report and comparison figures from LGCCC to DCA for the month of November 2004 - The Commission accepted the statistics report and comparison figures. The report is on file.

4. List of organizations approved or denied requests for registration for the month of December 2004 - The Commission approved the lists of organizations approved and denied. The list is attached to and made part of these minutes. Note that Commissioner Ryan requested that future lists indicate briefly the reason for a registration denial.

5. List of Approved and Denied Compensated Workers and Commercial License Providers for the months of December, 2004.-The Commission accepted the list of approved and denied compensated workers and commercial license providers. The list is attached to and made part of these minutes.

6. RMLG-05-01 Request for authorization to host Internet (electronic media) Tricky Tray LGCCC Regulatory Committee scheduled two meetings to discuss the issue of tricky tray auctions on the internet. A letter will be sent to the organization who inquired informing them of the arranged meetings and also letting them know that they may be called upon in the future if more information is necessary to make a determination.

7. RMLG-05-02 Donation of Modified Slot Machines to Caring, Inc. (AC Coin and Slot Service Company, Pleasantville, NJ) The Commission received an inquiry as to whether or not modified slot machines with no pay out used strictly for therapeutic and entertainment purposes are legal. The Commission, after conferring with DAG, Krugman, determined that the above issue is out the Commission’s jurisdiction.

9. LG-03-131 Holly Glen Elementary School PTO (Williamstown) (revisited UPL Letter 04/05/04) Moved to Executive Session for Legal Counsel. Returned to public session and determined that it will uphold the initial UPL penalty imposed upon Holly Glen Elementary School PTO.

11. LATE STARTER

RMLG-05-03 Anheuser Busch "All -IN" Poker Tournament Kenneth L. Judd, Associate General Counsel wrote a letter of inquiry to the Honorable Peter C. Harvey, Office of the Attorney General, regarding the conduct of a progressive tournament involving the game of Texas Hold’em in approximately 36 states including the State of New Jersey. A memo was then received from the desk of Anthony Miragliotta Deputy Director for the Commission to review and confer with DAG, Jodi Krugman and inform him of their position on the legality of the above case number. The Commission, after conferring with Jodi Krugman, has determined that the above issue is out of Legalized Games of Chance Control Commission’s jurisdiction.

12. LGI 04-195 HSA Sacred Heart School - Lyndhurst - Internal - The Commission determined that the above LGI has been resolved. The organization paid complainant the full amount of money they owed complainant for a bingo payout. The check was sent in to LGCCC and we then forwarded the check to the complainant. RESOLVED

*LGI 04-195 and LGI 04-196 were reviewed together and therefore, only one motion was made to approve the final resolution.
