Public Session Minutes
September 9, 2009

The Legalized Games of Chance Control Commission met on September 9, 2009, at the Division of Consumer of Affairs, located at 124 Halsey Street, 7th Floor Essex Room, Newark New Jersey. Present were Commissioners Marilou Halvorsen, Chairperson, and Christine Vanek. Commissioners Timothy E Ryan and Edward Barrett were not present. Also in attendance: Assistant Counsel, Authorities Unit, Office of the Governor, Joseph Neal, Deputy Attorney General Nancy Miller, Investigative Supervisor Scott Jenkins, Acting Investigative Supervisor William Carter, and Investigators Martin Silva, Joseph Chessere, and supporting staff Farah Rodriguez, Danyelle Williamson, and Ava Peterman.

The meeting was opened at 10:35 a.m. by Commissioner Marilou Halvorsen pursuant to provisions of the Open Public Meetings Act. N.J.S.A. 10:4-6 et seq. Adequate notice of the Legalized Games Public meeting was provided by mailing on September 2, 2009. A list of all regularly scheduled Commission meetings to be held during 2009 was previously provided to the Office of the Secretary of State, Star Ledger, Trenton Times, the Director of the Division of Consumer Affairs, and posted in the State Building at 124 Halsey Street, Newark, New Jersey, as well as being posted on LGCCC website: www.state.nj.gov/oag/ca/lgccc.htm.

Due to lack of quorum, the Commissioners present met as a committee. The committee’s recommendations will be reviewed at the next meeting and ratified as appropriate.

The committee recommends approval of the amended agenda.

The committee recommends acceptance of the comparison figures.

5. List of organizations approved or denied requests for registration for the months of July and August 2009

The committee recommends approval of the lists for July and August 2009. 6. Regulatory Proposals:

The committee asks that the regulatory analyst provide summary of comments previously expressed by the Commission.

The Committee recommends supporting this bill but asks if it would be in conflict with ABC Regulations.

This item was move from the Executive Agenda.
The Committee recommends supporting this bill provided it is amended to clarify that the proposed bingo games may not be held at a location that has a cover charge and that the bill define "nominal value."

12. RWJ University Hospital Foundation - requesting a refund of license fee paid for Hole -in-One raffle that was cancelled.

The committee recommends offering a credit in the amount of $100.00 toward future fees.

13. St Stanislaus Kostika RC Church- requesting a refund for over payment on a raffle license application.

The committee recommends offering a credit in the amount of $80.00 toward future fees. 14. Old Business.

15. New Business.

Arrow International, Inc., submitted a request for certification of an electronic bingo system: E-Max gaming system, along with E-Max Bingo hand held unit. The committee recommends denial of certification as an Electronic Game of chance system.

Arrow International, Inc submitted a request for certification of an electronic bingo system: Blue Dog Prestige Bingo System, along with LD7 hand held unit.
The committee recommends approval of certification for the equipment as it meets regulatory requirements.

The Commission moved to Executive Session. At the conclusion of the Executive Session, and the reading of the closing statement by Commissioner Halvorsen, the meeting was adjourned at 12:30 p.m.
