AND LAND SURVEYORS Minutes of January 15, 2009 Public Session CALL TO ORDER The meeting of the State Board of Professional Engineers and Land Surveyors was called to order by Board President James Valenti at 9:00 a.m. at 124 Halsey Street, 3rd Floor Union Conference Room, Newark, New Jersey. All parties were duly notified of the time, date and place, with all pertinent material being provided. SUNSHINE LAW ANNOUNCEMENT Board President Valenti read the statement required by Chapter 231, Laws of 1975 known as the Open Public Meetings Act, and announced that notice of this meeting was prepared in the office of the Board and mailed to the Secretary of State, the Newark Star Ledger, Trenton Times, the Camden Courier Post, Bergen Record, and the Atlantic City Press.

REVIEW OF THE MINUTES December 4, 2008 On a motion by BM Cleary, seconded by BM Jones, the Board voted to accept the minutes as amended. BM Angeline abstained. COMMITTEE REPORTS Legislation BM Vernick reported to the Board that there has not been any movements on bills. Regulations VP Purcell informed the Board that he has begun reviewing the regulations for the January 2010 sunset. VP Purcell, BP Valenti and BMs Schwartz and Jones will form a sub-committee to assist in this matter. Joint Committee BP Valenti informed the Board that BM Schwartz was elected incoming chairman of the Joint Committee. On a motion by BM Schwartz, second by BM Angeline, the Board voted to prepare a draft notice indicating that only a licensed professional land surveyor can prepare as-built surveys. Licensure Promotion BM Vernick suggested to the Board that a followup letter should be sent to Stevens Institute of Technology regarding their past visit. The Board staff will compile a list of colleges formerly visited by the Board. A spring trip is planned to attend Fairleigh Dickinson University, Teaneck, NJ, as well as a fall trip to Rowanuth University. Education BM Schwartz informed the Board of the reduction of the number of students entering the engineering field, and that licensure promotion should be geared at the high school level, by promoting the STEM (Science, Technology, Engineering & Mathematics) program for high school students. He will update the Board at its next meeting. Continuing Education On a motion by BM Angeline, second by BM Jones, the Board voted to approve the following continuing education courses: SPONSOR COURSE PDH NJ Society of PLS Environmental Regs for Property Transactions 1 Contract Renewal Committee The time and events calender for the bidding of a new contract for the administration of the Board’s examinations was distributed. APPEARANCE BY JEFFREY S. PAUL, #1250289 Mr. Paul appeared before the Board to discuss his request for a waiver of the fundamentals of engineering examination based upon his background and experience. Mr. Paul had previously passed the principles and practices portion of the engineering examinations. On a motion by BM Vernick, second by BM Schwartz, the Board voted to waive the fundamentals of engineering examination for Mr. Paul. APPEARANCE BY JONATHAN GREENBERG, #1355199 Mr. Greenberg appeared before the Board to discuss his professional engineer’s application. After reviewing his application the Board concluded that Mr. Greenberg may sit for the April 2009 principles and practices portion of the engineering examination if additional satisfactory references are timely received. REPORT OF THE EXECUTIVE DIRECTOR General Report ED Russo provided statistics regarding the number of licensed PE & LS’s for 2008. This correspondence was noted for the record. Executive Director Russo informed the Board that Professional Credentials Services (PCS) has requested the completion of the review of the PCS databank of questions for the state specific law examination. ED Russo stated that a total of 31 complaints were filed with the Board during 2008. Executive Director Russo stated that the father of Albert Faraldi, PLS, died on January 1, 2009. Staff member Richardson stated that all applications for certificates of authorization have been processed. 1,576 applications were processed and approximately 600 did not renew. VP Purcell stated he would be attending the NCEES Board Presidents Assembly meeting in February 2009. BM Angeline stated he will be leaving the Board and will not be seeking reappointment at the end of his 5 year term. BM Angeline informed the Board that he has completed and mailed to the NCEES Northeast Zone nominating committee, the documents nominating Louis Raimondi, PE, PLS, for its distinguished service award. INCOMING CORRESPONDENCE
Sherrie Holcomb (NCEES) Ms. Holcomb informed the Board of the Northeast Zone meeting and is requesting funded delegate information. BP Valenti will review his schedule and inform the Board whether he would be attending the meeting scheduled for April 16-18, 2009 in Norfolk, VA.
Dana J. Parrish, PLS Ms. Parrish requested approval from the Board to use an alternate to concrete monuments. After discussing this matter, the Board on a motion by BM Angeline, second by BM Jones, determined to refer Ms. Parrish to its regulations on this matter.
Robert Weatherford, PE Mr. Weatherford requested clarification whether certain projects are permitted to be permfomed by an Engineer under Building Design Services Act. The Board, on a motion by BM Vernick, second by BM Schwartz, voted to inform Mr. Weatherford that there was insufficient information to make any determinations. Accordingly, he shall be advised that he may provide additional information which would be forwarded to the Joint-Committee of Architects and Engineers for handling.
John F. Mann, PE Mr. Mann has concerns regarding information published on the DCA website. This correspondence was noted for the record. FULL BOARD REVIEW Michael Feldbusch, PLS Applicant #1023428 After discussing this application, the Board, on a motion by BM Angeline, second by BM Jones, voted to approve Mr. Feldbusch’s application to take the land surveyors state specific examination subject to the Board obtaining an affidavit stating that he does not have any prior disciplinary actions in the states he holds an existing license. Rolando Sanidad, PE Applicant #1339031 After reviewing Mr. Sanidad’s application, the Board, on a motion by BM Marshall, second by BM Schwartz, voted to approve his application. Richard Fromuth, PE Comity Applicant # 1320362 After discussing this application, the Board, on a motion by VP Purcell, second by BM Schwartz, voted to have Mr. Fromuth appear before the Board to discuss his design experience and to provide examples of design projects he worked on. Frank Brown, PE Applicant # 1263595 After discussing this application, the Board concluded to request an additional reference from Mr. Brown. Ruihan Kang, EIT Applicant # 1347505 After discussing this application, the Board, on a motion by VP Purcell, second by BM Schwartz, voted to approve Mr. Kang’s EIT application. REINSTATEMENT APPLICATIONS Shashikant V. Athavale The Board reviewed the reinstatement application for Mr. Athavale and, on a motion by BM Schwartz, second by VP Purcell, voted to reinstate his license. Tze-Heng Chin, PE The Board reviewed the reinstatement application for Mr. Chin and, on a motion by VP Purcell, second by BM Marshall, voted to approve reinstatement. Richard T. Hallahan, PE The Board reviewed Mr. Hallahan’s application and on a motion by VP Purcell, second by BM Schwartz, voted that Mr. Hallahan provide an affidavit so stating if he holds license(s) in other state(s), and to provide information regarding any disciplinary actions previously taken against him. Richard Charles Michel, PE The Board reviewed Mr. Michel’s application for reinstatement and determined that he had not demonstrated proficiency. Thus, on a motion by VP Purcell, second by BM Vernick, the Board voted that Mr. Michel take the principles and practices portion of the engineering examination. INFORMATIONAL/DISCUSSION ITEMS Licensure of Engineering Faculty - a Difficult Proposition The Board suggested that this issue be addressed by the Sunset Regulation Review Committee. This correspondence was noted for the record. The Board requested that a letter be sent to Educational Perspectives requesting that their explanation/summaries be more definitive, clear and concise. PUBLIC COMMENTS Charles Blumeling, PE, PLS, spoke about various discrepancies and sought clarification between the proposed changes to the map filing law and the existing municipal land use law. MOVE TO EXECUTIVE SESSION The Board, on a motion by BM Vernick, second by BM Schwartz unanimously voted to enter into Executive Session to review disciplinary matters. RETURN TO PUBLIC On a motion contained within the Executive Session minutes, the Board re-entered into Public Session to adjourn. ADJOURNMENT On motion by BM Angeline, second by BM Schwartz the Board unanimously voted to adjourn the meeting at 2:00pm. APPROVED BY:
