The agency proposal follows:

Summary

N.J.A.C. 13:37-2.2(b) and 4.1(b) require that an applicant for licensure as a licensed practical nurse complete a licensed practical nurse education program. At present, completion of a registered professional nurse education program cannot serve as a substitute for a licensed practical nurse education program. The Board is aware that the National Council of State Boards of Nursing (NCSBN) permits individuals who complete a registered professional nurse education program to take the practical nursing licensing examination. As N.J.A.C. 13:37-2.2(b) and 4.1(b) contradict NCSBN policy, the Board has decided to delete these regulations, so that individuals who complete a registered professional nurse education program may apply for licensure as a licensed practical nurse. The Board has determined that the comment period for this proposal will be 60 days; therefore, pursuant to N.J.A.C. 1:30-3.3(a)5, this proposal is excepted from the rulemaking calendar requirement.

Social Impact

The Board believes that the proposed amendments will have a beneficial impact on society. By allowing individuals who completed registered professional nurse education programs to obtain licensure as licensed practical nurses, the proposed amendments could increase the number of individuals who obtain licensed practical nurse licensure, which would address the existing nursing shortage.

Economic Impact

The Board does not believe that the proposed amendments will have any economic impact.

Federal Standards Statement

A Federal standards analysis is not required because there are no Federal laws or standards applicable to the proposed amendments.

Jobs Impact

While the proposed amendments will not increase or decrease the number of jobs in New Jersey, it may increase the number of individuals who obtain licensure as licensed practical nurses in New Jersey.

Agriculture Industry Impact

The Board does not believe that the proposed amendments will have any impact on the agriculture industry of this State.

Regulatory Flexibility Statement

Since nurses are individually licensed by the Board, they may be considered "small businesses" under the Regulatory Flexibility Act (the Act), N.J.S.A. 52:14B-16 et seq. The proposed amendments do not impose compliance, reporting or recordkeeping requirements. The deletion of N.J.A.C. 13:37-2.2(b) and 4.1(b) would allow individuals who complete a registered professional nurse education program to apply for licensure as a registered professional nurse or a licensed practical nurse.

Smart Growth Impact

The Board does not anticipate that the proposed amendment will have any impact on the achievement of smart growth and implementation of the State Development and Redevelopment Plan, otherwise known as the State Plan.

[(b) An applicant for licensure by endorsement as a licensed practical nurse shall have graduated from a practical nurse program. Attendance in or successful completion of a professional nursing program shall not serve as an equivalent for the practical nursing educational requirement.]
