830TH BUSINESS MEETING OF THE BOARD OF EXAMINERS OF ELECTRICAL CONTRACTORS
(PUBLIC SESSION) - - - MARCH 4, 2009 The Board Minutes of March 4, 2009, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of April 1, 2009, or soon thereafter as it may be considered. All requirements of the "Open Public Meetings Act" have been complied with according to N.J.S.A. 10:4-6. The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.
Meeting of March 4, 2009, was called to order at 9:00 A.M.
Mr. Joseph P. Schooley, Chairman Mr. Joseph F. Cantalupo was absent. Marian Fiore, Sr. Management Assistant, was present from 9:00 A.M. until the close of the meeting. Kathleen Moran, Administrative Assistant, III, was present from 9:00 A.M. until the close of the meeting. Ginger R. Provost, Deputy Attorney General, Division of Law, was present from 9:00 A.M. until the close of the meeting. Also in attendance was Robert Jules, Central Jersey Electrical League; Ronald Virack, Slomins Security; Ed Magna and Kennie Fried, Warshauer Electric Supply Company. The Board saluted the Flag. Motion made by Mr. Richard T. Aicher, Jr. and seconded by Mr. Mitchell R. Malec, and unanimously passed, that the Agenda items not be discussed in the order in which they were presented. Robert Shoremount, Chairman, Robert Boyer, Vice Chairman, and George De Luca, Administrative Analyst, Fire Alarm, Burglar Alarm & Locksmith Advisory Committee, appeared before the Board concerning the Township of Hamilton (Mercer County) who is denying a burglar and fire alarm permit unless a licensed electrical contractor obtains the permit. The Township indicates that an alarm contractor cannot install an earth ground without an electrical contractor’s licensee. Mr. De Luca asks that the Board review proposed correspondence to be sent to the Township of Hamilton advising that fire alarm, burglar alarm and locksmiths are authorized to perform all work necessary to affect the installation of work within their respective disciplines up to and including connection to branch circuit wiring. Mr. Shoremount stated that the electrical inspector for the Township of Hamilton will not allow a burglar and fire alarm contractor to install the grounding electrode conductor. The electrical inspector is requesting that a licensed electrical contractor submit a permit to install the earth ground on the burglar alarm panel. Mr. Shoremount also stated that the Committee has reviewed its regulations and it would appear that burglar alarm installers are licensed to do this work. Licensees are allowed to install, service, repair, or alter these systems. Mr. Shoremount brought with him two transformers; a 110 volt transformer used by burglar alarm and some fire alarm installers and a two prong transformer with a low voltage output (18 volt AC transformer which is used to convert to DC to charge the battery). It is plugged into an outlet which is installed by a licensed electrical contractor. Mr. Shoremount stated that the transformers are UL listed. This produces 18 volts AC which connects into the input of the panel. The diagram depicts the circuit board connecting to the control panel with metal mounting screws. The second illustration shows the panel earth ground connections. The manufacturer instructions for the Vista 128B state to run an earth ground to terminal 30 on the circuit board with a 16 gauge wire. A non-corrosive metal strap firmly secured to the cold water pipe is to be used. In the absence of the second type of transformer, the control panel still requires a ground. Mr. Flaherty stated that he understands what the Committee is trying to accomplish which the Board is not against; however, there are licensed electrical contractors that cannot ground correctly. Licensees would have to be educated on which ground can and cannot be done as there is a difference between residential and commercial. Mr. Flaherty also stated that the licensee may follow the manufacturer’s instructions, but the work will not be performed according to code. Mr. Shoremount stated that their examination does include questions concerning grounding and bonding. The Committee has also discussed the requirement that licensees must attend two hours on the Uniform Construction Code, ADA, Barrier Free and life safety courses. Mr. Papademas stated that the municipalities must determine whether the installation is an earth ground or equipment ground. Mr. Malec stated that according to the description provided to the Board, it is not an earth ground. The manufacturer says earth ground to a water pipe; that is not an earth ground. Mr. Malec also stated that the Township of Hamilton is requiring a burglar or fire alarm license and if an earth ground is being installed an electrical contractors license. Mr. Boyer stated that it does become an earth ground in a properly installed system. Mr. Shoremount stated that the other literature indicates that the modules on the Radionics control panels are depicted outside the main control board. Mr. Schooley stated that the question is whether or not burglar and fire alarm contractors are permitted to install the equipment ground or bonding jumper to complete their installation? Motion made by Mr. Richard T. Aicher, Jr. and seconded by Mr. Mitchell R. Malec, and unanimously passed, that a letter be sent to the Township of Hamilton advising them that the installation of an equipment ground or bonding jumper is included in the scope of practice of a burglar alarm, fire alarm and locksmith installer as long as it is performed according to the National Electrical Code. The Board requested that a letter be sent to the Department of Community Affairs asking that this matter be addressed via a DCA Codes and Standards Construction Code Communicator article. Motion made by Mr. James H. Flaherty and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve (48) Initial Licenses effective March 4, 2009 to March 31, 2012. Motion made by Mr. Constantinos Papademas and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve (45) Initial Business Permits effective March 4, 2009 to March 31, 2012 Motion made by Mr. James H. Flaherty and seconded by Mr. Constantinos Papademas, and unanimously passed, to approve (3) Initial Business Permits Previously Expired effective March 4, 2009 to March 31, 2012. Motion made by Mr. James H. Flaherty and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (15) Changes in Business Permits effective March 4, 2009 to March 31, 2012. Check in the amount of $7,500.00 received from Steve A. DiDonato, License #13756, as the first and final payment of a civil penalty in the amount of $7,500.00 for violation of N.J.S.A. 45:5A-9. The Board accepted the payment. Postal Money Orders in the amount of $100.00 and $50.00 were received from James H. Gandy, Unlicensed, as the twenty-first installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3. Payments started May 25, 2007 and the balance due is $350.00. The Board accepted the payment. Letter dated February 18, 2009, received from Claude Pavia, President, Knight Electric, Inc., requesting a second six-month continuance of business under Permit #6768 according to N.J.S.A. 45:5A-14. The licensee, Chester R. White, Jr., died on September 23, 2008. The first extension for Knight Electric, Inc. will expire on March 24, 2009 and Mr. Pavia would like to complete four outstanding projects. Motion made by Mr. James H. Flaherty and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that a letter be sent to Mr. Pavia advising him that pursuant to N.J.S.A. 45:5A-14 the firm of Knight Electrical, Inc. has been granted a second six-month continuance of business under permit #6768. The Board requests that Mr. Pavia forward to it a copy of the bond and certificate of general liability insurance. Letter dated February 23, 2009, received from Adam J. Bird, License #15092, requesting a six-month continuance of business under Permit #14015 according to N.J.S.A. 45:5A-14. The licensee, William M. Bird, (License #14015) is currently in rehabilitation after having surgery. Mr. Bird stated that he will be overseeing all work performed by WMC Inc., t/a Wes Jones and Son Electrical Contractors. (Adam J. Bird does not have a business permit) Adam Bird is also requesting an extension to allow William to complete his Continuing Education Courses for the 2009 to 2012 renewal period. Motion made by Mr. James H. Flaherty and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that a letter be sent to Adam J. Bird advising him that William M. Bird has been granted additional time in order to complete his Continuing Education Courses. Mr. Bird’s extension will expire on January 1, 2010. Additionally, the Board requested that Mr. Bird forward to it medical documentation. (This matter is being held in abeyance) Letter received February 9, 2009, from Paul J. Giovinazzo, License #1140, t/a Rose City Electric Co., Inc., requesting a waiver of the Continuing Education Courses pursuant to N.J.A.C. 13:31-1.7. Motion made by Mr. Constantinos Papademas and seconded by Mr. Mitchell R. Malec, and unanimously passed, that Mr. Giovinazzo’s request be denied pending receipt of additional information concerning his illness. The Board would like to know how long Mr. Giovinazzo has been under a doctor’s care; the approximate date he become incapacitated and the number of hours he can remain in a seated position. Additionally, should Mr. Giovinazzo want to continue his business, he may hire a licensed electrical contractor to endorse the business permit to his company. Facsimile dated February 23, 2009, received from Wayne Harmon, License #8020, t/a Harmon Brothers Electric, Inc., requesting a waiver of the Continuing Education Courses pursuant to N.J.A.C. 13:31-1.7. Motion made by Mr. James H. Flaherty and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that Mr. Harmon be granted an additional six months to complete his Continuing Education Courses. E-Mail dated February 10, 2009, received from Richard Goldbeck, License #6354, requesting an extension to complete his Continuing Education Courses for the 2009 to 2012 renewal period. Mr. Goldbeck stated that he is currently on assignment in Iraq and will return in May 2009. Motion made by Mr. Mitchell R. Malec and seconded by Mr. James H. Flaherty, and unanimously passed, that Mr. Goldbeck be granted an extension to take his Continuing Education Courses. Mr. Goldbeck’s extension will expire on January 1, 2010. Letter dated February 8, 2009, received from Norman D. Finkel requesting credit towards the renewal of his License #4737 pursuant to N.J.A.C. 13:31-1.7. Mr. Finkel has provided a letter from Bergen Community College stating that he is a Uniform Construction Code Instructor for Electrical ICS and HHS. Motion made by Mr. Constantinos Papademas and seconded by Mr. Richard T. Aicher, Jr., and passed, that Mr. Finkel’s request be denied as the courses he is teaching do not meet the requirements to be granted continuing education credits pursuant to N.J.A.C. 13:31-1.7(d). Mr. Malec abstained from the motion. Additionally, the Board requested that Mr. Finkel forward to it copies of his Continuing Education Course certificates for the 2006 to 2009 triennial renewal period. Letter dated February 26, 2009, received from John F. Grillo, License #3242, t/a John Grillo Electrical Contractor, requesting an extension to complete his Continuing Education Courses for the 2009 to 2012 renewal period. Mr. Grillo was recently hospitalized for emergency surgery. Motion made by Mr. Mitchell R. Malec and seconded by Mr. James H. Flaherty, and unanimously passed, that Mr. Grillo be granted an additional six months to complete his Continuing Education Courses. Facsimile dated February 26, 2008, received from James Benson, License #13454, requesting an extension to complete his Continuing Education Courses for the 2009 to 2012 renewal period. The Board directed that Mr. Benson’s request be denied as he did not provide a valid reason for his request. Letter dated February 17, 2009, received from Thomas McNulty, Educational Director, NECA, requesting approval of Bob Mitchell, Instructor #510, to teach a previously approved course entitled "Managing Schedule Acceleration". Mr. McNulty stated that the instructor initially approved to teach this course, Dr. Randolph Thomas, is unable to do so due to health issues. Motion made by Mr. Constantinos Papademas and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve Mr. Mitchell to teach a previously approved course. The sub-committee reviewed an application for Continuing Education Course/Seminar approval received from John A. Delesandro, ECSP 111, NJ Dept. of Community Affairs/Rutgers University, requesting approval of previously approved courses. Mr. Delesandro is also requesting the approval of Ken Garahou to teach a previously approved course entitled "What’s New in Photovoltaic Systems". Mr. Delesandro stated that the instructor initially approved to teach this course, Suzanne Borek, is unable to do so due to conflicting job related duties. Motion made by Mr. Constantinos Papademas and seconded by Mr. Mitchell R. Malec, and unanimously passed, to approve Mr. Garahou to teach a previously approved course. Mr. Delesandro’s request that the Board approve previously approved courses is being held in abeyance and will be reviewed by the Board at its April 2009 meeting. E-Mail dated January 15, 2009, received on February 13, 2009, from Karen Graham requesting the Board’s assistance in determining the type of license required for the work performed by her company. Motion made by Mr. James H. Flaherty and seconded by Mr. Richard T. Aicher, Jr., and unanimously approved, that Ms. Graham be advised to review N.J.S.A. 45:5A-18 "Exempt Work or Construction" which should assist her with any questions that she may have. The Board reviewed applications for the written examination to be administered by Thomson Prometric. Three (3) applications were approved. The Board reviewed a response received from Joseph C. Caramanna, License #12563, to the Provisional Order of Discipline filed February 6, 2009, ordering that Mr. Caramanna pay a civil penalty in the total amount of $2,750.00. Mr. Caramanna was penalized $250.00 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; a public reprimand is imposed upon Mr. Caramanna for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13 et seq. and N.J.A.C. 13:1-7(a, b & c) and Mr. Caramanna must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22. Motion made by Mr. James H. Flaherty and seconded by Mr. Constantinos Papademas, and unanimously passed, that a Final Order of Discipline be drafted rescinding the Provisional Order of Discipline as an error was made in calculating the continuing education hours. The Board reviewed a response received from Mr. Amer to the Provisional Order of Discipline filed February 6, 2009, ordering that Salah E. Amer, License #14164, pay a civil penalty in the total amount of $4,750.00. Mr. Amer was penalized $750.00 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $1,500.00 for failing to complete the required ten hour course in violation of N.J.A.C. 45:5A-13.1 et seq and N.J.A.C. 13:1.1.7 (b and c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; a public reprimand is imposed upon Mr. Amer for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13 et seq. and N.J.A.C. 13:1-7(a, b & c) and Mr. Amer must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22. Mr. Bonica was penalized $1,500.00 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; a public reprimand is imposed upon Mr. Bonica for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-7(a, b, c & f); civil penalty in the amount of $100.00 for violation of N.J.A.C. 13:31-1.7(f) for failing to retain or provide course documentation and Mr. Bonica must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22. Mr. Bonica was penalized $1,500.00 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; a public reprimand is imposed upon Mr. Bonica for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-7(a, b, c & f); civil penalty in the amount of $100.00 for violation of N.J.A.C. 13:31-1.7(f) for failing to retain or provide course documentation and Mr. Bonica must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22. The Board reviewed a response received from Carmine S. Berardinelli, License #13873, to the Provisional Order of Discipline filed February 6, 2009, ordering that Mr. Berardinelli pay a civil penalty in the total amount of $4,000.00. Mr. Berardinelli was penalized civil penalty in the amount of $1,500.00 for failing to complete the required ten hour course in violation of N.J.A.C. 45:5A-13.1 et seq and N.J.A.C. 13:1.1.7 (b and c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; a public reprimand is imposed upon Mr. Berardinelli for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-7(a, b & c); and Mr. Berardinelli must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22. Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, that a Final Order of Discipline be drafted rescinding the Provisional Order of Discipline. Mr. Berardinelli will be ordered to pay a civil penalty in the amount of $100.00 for his failure to fully cooperate with the Board’s audit letter by supplying the requested documentation. The Board reviewed a response received from William Passione, License #11485 (Expired) to the Provisional Order of Discipline filed November 5, 2008, ordering that he pay a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq., and an additional civil penalty in the amount of $1,000.00 for violation of N.J.A.C. 13:45C-1.2 for a total of $3,500.00; return the pressure seal issued to B. Passione Electric within ten days (failure to do so may result in an additional penalty of $100.00 per day up to $10,000.00); License and Business Permit #11485 is suspended; and cease and desist from engaging in the business of electrical contracting. Pressure seal was returned September 17, 2007. Motion made by Mr. James H. Flaherty and seconded by Mr. Mitchell R. Malec, and unanimously passed, that Ginger R. Provost finalize the Provisional Order of Discipline and issue a Final Order of Discipline ordering that Mr. Passione pay a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq., and an additional civil penalty in the amount of $1,000.00 for violation of N.J.A.C. 13:45C-1.2 for a total of $3,500.00; License and Business Permit #11485 is suspended; and cease and desist from engaging in the business of electrical contracting until such time as his license and business permit are reinstated. The Board reviewed the Provisional Order of Discipline filed February 6, 2009 ordering that John Brodnicki, License #10922, pay a civil penalty in the total amount of $3,000.00. Mr. Brodnicki was penalized $500.00 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; a public reprimand is imposed upon Mr. Brodnicki for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-7(a, b & c); and Mr. Brodnicki must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22. Motion made by Mr. James H. Flaherty and seconded by Mr. Constantinos Papademas, and unanimously passed, that a Final Order of Discipline be drafted rescinding the Provisional Order of Discipline as an error was made in calculating the continuing education hours. Ms. Fried stated that Warshauer is trying to organize its classes for the new renewal cycle and will soon advertise same. Ms. Fried asked if her application will be reviewed by the Board at its April 2009 meeting. Mr. Malec stated that the Board will begin reviewing continuing education course applications at its April 1, 2009 meeting for the next triennial renewal period. At its February 4, 2009 meeting, the Committee reviewed a letter received January 21, 2009 from Robert Vaccarella concerning the electrical contractor’s examination he took in 2008 and again in 2009. Mr. Vaccarella stated that his ADA accommodations were not met; proctors displayed disruptive behavior such as answering their cell phone, they were fidgety and tried to carry on a conversation with Mr. Vaccarella. Mr. Vaccarella also stated that he received a failing score of 69% and believes he received this score because of the conditions of the examination. Mr. Vaccarella further stated that in 2008, he was approved for the ADA accommodations; however, when he arrived at the testing site he was advised by the proctor that there was no indication that ADA provisions had been set up. The Committee requested that Mr. Flaherty speak with Andy Parker of Thomson Prometric concerning their ADA procedures. The Board reviewed an explanation received from Mr. Parker. DAG Provost stated that it does not appear that Mr. Parker answered the Board’s questions concerning the proctors; he only answered the questions regarding ADA accommodations. Mr. Malec stated that the Board is still unsure as to whether or not ADA protocol is being followed by the proctors. The Board requested that Thomson Prometric be requested to forward to it the packet of information that is provided to proctors. The Board would also like to know what the responsibilities are of the proctors. Motion made by Mr. James H. Flaherty and seconded by Mr. Mitchell R. Malec, and unanimously passed, that Mr. Vaccarella be allowed to re-take the examination with the proper ADA Accommodations and at no charge to him. Additionally, because Mr. Vaccarella’s examination was improperly conducted, the test should be considered null; therefore, Mr. Vaccarella should not have to wait the required six months before being allowed to retake same. Further, it is the opinion of the Board that the taking of telephone calls, whether or not the telephone rings or vibrates, is not a proper occurrence during the testing time. Motion made by Mr. James H. Flaherty and seconded by Mr. Mitchell R. Malec, and unanimously passed, that the Board go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Board determines to initiate disciplinary action or other law enforcement action. Meeting adjourned at 2:30 P.M.
