The Committee Minutes of April 1, 2009, have not been formally approved and are subject to change or modification by the Public Body at its next meeting of May 6, 2009, or soon thereafter as it may be considered. All requirements of the "Open Public Meetings Act" have been complied with according to N.J.S.A. 10:4-6.

The notice of the meeting has been mailed to the Newark Star Ledger, Camden Courier Post, and the Trenton Times, and also notice has been posted on the Bulletin Board at the office of the Secretary of State, Trenton, New Jersey.

Meeting of April 1, 2009, was called to order at 9:00 A.M.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Kennie Fried, Warshauer Electric Supply Company, ECSP 016.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve three (3) new courses, previously approved courses, and instructors as submitted.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Anthony T. Urbanik, ECSP 011.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve sixty (60) new courses, previously approved courses, and instructors as submitted.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from Thomas McNulty, Penn-Del-Jersey Chapter - NECA, ECSP 094.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve eight (8) new courses, previously approved courses, and instructors as submitted.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from John Delesandro, NJ Department of Community Affairs/Rutgers University, ECSP 111.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve ten (10) new courses, previously approved courses, and instructors as submitted.

The sub-committee reviewed an application for Continuing Education Course/Seminar Approval received from George Dzurina, G-Crew, LLC.

Motion made by Mr. Mitchell R. Malec and seconded by Mr. Richard T. Aicher, Jr., and unanimously passed, to approve (2) new courses, and an instructor, as submitted.

Check in the amount of $4,100.00 received from Robert Bonica, License #13265, as the first and final payment of a civil penalty in the amount of $4,100.00 for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:31-1.7(a, b, c & f).

The Committee unanimously recommended to accept the payment.

Check in the amount of $25.00 received from Frank D’Arpa, License #8778 (Inactive), as the forty-second installment of a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. Payments started September 25, 2002 and the balance due is $1,450.00

The Committee unanimously recommended to accept the payment.

Check in the amount of $200.00 received from William Passione, License #11485 (Expired), as the first installment of a civil penalty in the amount of $500.00 for violation of N.J.A.C. 13:45C-1.2. Balance due is $300.00.

The Committee unanimously recommended to accept the payment.

Cashier’s Check in the amount of $1,500.00 received from David J. Paltjon, License #7282, as the third and final installment of a civil penalty in the amount of $3,000.00 for violation N.J.S.A. 45:5A-9 and N.J.A.C. 13:31-3.3 (c).

The Committee unanimously recommended to accept the payment.

Check in the amount of $4,500.00 received from Joseph C. Chickachop, License #4847, t/a Chick-A-Chop Electrical Contractors, as the first installment of a civil penalty, and costs, in the amount of $13,765.00 for violation of N.J.S.A. 45:5A-17; N.J.A.C. 13:31-1.4; N.J.A.C. 13:31-3.2; N.J.A.C. 13:45A-15.2(a)10; N.J.A.C. 13:31-3.7; N.J.A.C. 13:45C-1.2 & 1.3; N.J.A.C. 13:31-3.4 and N.J.S.A. 45:1-21(b). The balance due is $9,265.00.

The Committee unanimously recommended to accept the payment.

Letter received March 9, 2009, from John Loschiavo, License #4708, t/a JL Electric, requesting an extension to complete his Continuing Education Courses for the 2009 to 2012 renewal period.

The Committee unanimously recommended that Mr. Loschiavo be granted an additional six (6) months to complete his continuing education courses. Mr. Loschiavo will be requested to provide the Board with copies of his Continuing Education Course Certificates totaling 34 hours for the 2006 to 2009 and 2009 to 2012 triennial renewal period.

Letter dated March 11, 2009, received from Paul Levenberg, License #9446, t/a Atlas Electric Service, requesting an extension to complete his Continuing Education Courses for the 2009 to 2012 renewal period.

The Committee unanimously recommended that Mr. Levenberg be granted an additional sixty (60) days to complete his continuing education courses. Mr. Levenberg will be requested to provide the Board with copies of his Continuing Education Course Certificates totaling 34 hours for the 2006 to 2009 and 2009 to 2012 triennial renewal period.

Letter dated March 11, 2009, received from Paul F. Jessen, License #5231, t/a Paul F Jessen Electrical Contractor, requesting an extension to complete his Continuing Education Courses for the 2009 to 2012 renewal period.

The Committee unanimously recommended that Mr. Jessen be granted an additional ninety (90) days to complete his continuing education courses. Mr. Jessen will be requested to provide the Board with copies of his Continuing Education Course Certificates totaling 34 hours for the 2006 to 2009 and 2009 to 2012 triennial renewal period.

Letter dated March 31, 2009, received from Patrick Ford, Jr., License #14631, t/a Ford Electric, LLC, requesting an extension to complete his Continuing Education Courses for the 2009 to 2012 renewal period.

The Committee unanimously recommended that Mr. Ford be granted an additional ninety (90) days to complete his continuing education courses. Mr. Ford will be requested to provide the Board with copies of his Continuing Education Course Certificates totaling 34 hours for the 2006 to 2009 and 2009 to 2012 triennial renewal period.

Letter dated March 6, 2009, addressed to David M. Szuchman, Director, Division of Consumer Affairs, received from Stephen M. Sweeney, Senate Majority Leader and John J. Burzichelli, Deputy Speaker, New Jersey Senate and General Assembly, on behalf of their constituent regarding the cost of Continuing Education Courses.

The Committee unanimously recommended that the letter drafted by DAG Provost be sent to Senator Sweeney and Assemblyman Burzichelli advising them that pursuant to the Electrical Contractors Licensing Act of 1962 all licensed electrical contractors are required to complete 34 hours of continuing education for each renewal cycle as a condition for renewal. The hours of continuing education per triennial renewal cycle was increased to 34 hours by the Legislature in an amendment to the statute in 1999 which the Board merely enforces. The Board does not have any authority over the amount charged by the providers of such programs.

An E-Mail dated March 12, 2009, was received from Richard Paris, Investigator for the Commonwealth of Massachusetts, Division of Professional Licensure, regarding the installation of photovoltaic systems in the State of New Jersey.

The Committee unanimously recommended that a letter be sent to Mr. Paris directing him to the Board’s website address so that he may obtain its Laws, Rules and Regulations. Additionally, Mr. Paris will be advised that the "racks" or any other portion of the photovoltaic system that is non-electrical does not need to be installed by a licensed electrical contractor who holds a business permit. However, an electrical contractor is permitted to do work that is incidental to the installation of the photovoltaic system.

Letter dated March 9, 2009, received from Leo Kob, License #10215, requesting 25 hours of credit toward the renewal of his License #10215. Mr. Kob stated that he recently passed the examination required to become a LEED commissioning authority.

The Committee unanimously recommended that a letter be sent to Mr. Kob advising him that his request is denied as the Board cannot approve courses already taken. According to the Continuing Education Requirements, Continuing Education Courses must be sent in by the Sponsor/Instructor, and must be pre-approved by the Board in order for the licensee to receive credit.

The Committee reviewed a response received from Gregory Cardillo, License #15000, to the Provisional Order of Discipline filed February 6, 2009, ordering that Mr. Cardillo pay a civil penalty in the total amount of $5,500.00. Mr. Cardillo was penalized $1,500.00 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; civil penalty in the amount of $1,500.00 for failing to complete the required 10 hour course of study relating to code and law for the 2006 to 2009 triennial renewal period in violation of N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-1.7 (b & c); a public reprimand is imposed upon Mr. Cardillo for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13 et seq. and N.J.A.C. 13:1-7(a, b & c) and Mr. Cardillo must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22.

The Committee unanimously recommended that DAG Provost finalize the Provisional Order of Discipline and issue a modified Final Order of Discipline ordering that Mr. Cardillo pay a civil penalty in the total amount of $3,000.00. Mr. Cardillo was penalized $1,500.00 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $1,500.00 for failing to complete the required 10 hour course of study relating to code and law for the 2006 to 2009 triennial renewal period in violation of N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-1.7 (b & c); a public reprimand is imposed upon Mr. Cardillo for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13 et seq. and N.J.A.C. 13:1-7(a, b & c) and Mr. Cardillo must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22. (The civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education has been deleted). Mr. Cardillo may pay his penalty in monthly installments in the amount of $300.00.

Mr. Richard T. Aicher, Jr., abstained from the following discussion and committee recommendation as his office is the sponsor of the courses attended by Mr. Canavera.

The Committee reviewed a response received from Paul Canavera, License #11095, to the Provisional Order of Discipline filed February 6, 2009, ordering that Mr. Canavera pay a civil penalty in the total amount of $4,812.50. Mr. Canavera was penalized $812.50 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; civil penalty in the amount of $1,500.00 for failing to complete the required 10 hour course of study relating to code and law for the 2006 to 2009 triennial renewal period in violation of N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-1.7 (b & c); a public reprimand is imposed upon Mr. Canavera for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13 et seq. and N.J.A.C. 13:1-7(a, b & c) and Mr. Canavera must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22.

The Committee recommended that DAG Provost finalize the Provisional Order of Discipline and issue a modified Final Order of Discipline ordering that Mr. Canavera pay a civil penalty in the total amount of $3,312.50. Mr. Canavera was penalized $812.50 ($62.50 for each hour of Continuing Education he failed to attend) for violation of N.J.S.A. 45:5A-13.1 and N.J.A.C. 13:1-1.7(b & c); civil penalty in the amount of $2,500.00 for violation of N.J.A.C. 13:31-1.7(a) for falsely stating that he attended thirty-four hours of continuing education; a public reprimand is imposed upon Mr. Canavera for violation of N.J.S.A. 1-21a, N.J.S.A. 45:5A-13 et seq. and N.J.A.C. 13:1-7(a, b & c) and Mr. Canavera must complete all missing course hours within six months from the date of the Order pursuant to N.J.S.A. 45:1-22. (The civil penalty in the amount of $1,500.00 for failing to complete the required 10 hour course of study relating to code and law for the 2006 to 2009 triennial renewal period in violation of N.J.S.A. 45:5A-13.1 et seq. and N.J.A.C. 13:1-1.7 (b & c) has been deleted).

Letter dated February 23, 2009, received from William Passione, License #11485 (Expired) in response to a Provisional Order of Discipline filed November 5, 2008, ordering that he pay a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq., and an additional civil penalty in the amount of $1,000.00 for violation of N.J.A.C. 13:45C-1.2 for a total of $3,500.00; return the pressure seal issued to B. Passione Electric within ten days (failure to do so may result in an additional penalty of $100.00 per day up to $10,000.00); License and Business Permit #11485 is suspended; and cease and desist from engaging in the business of electrical contracting.

Pressure seal was returned September 17, 2007.

The Committee unanimously recommended that the Provisional Order of Discipline be finalized and DAG Provost issue a modified Final Order of Discipline ordering that Mr. Passione pay a civil penalty in the amount of $2,500.00 for violation of N.J.S.A. 45:5A-9 and N.J.S.A. 56:8-1 et seq. and an additional civil penalty in the amount of $1,000.00 for violation of N.J.A.C. 13:45C-1.2 for a total of $3,500.00. Mr. Passione may pay his penalty in monthly installments of not less than $400.00. Failure to pay within fifteen days of due date will result in the entire amount due and owing. Additionally, Mr. Passione will be allowed to reinstate his License and Business Permit #11485 with the payment of the proper fees and documentation.

The Committee reviewed applications for the written examination to be administered by Thomson Prometric. Seven (7) applications were approved.

The Committee unanimously recommended that it go into Executive Closed Session to consider and to review consumer complaints, investigative reports and other information received pursuant to the Board’s investigative authority in order to determine whether violations of the law, including Board regulations have occurred. The results of the deliberations will be made known when and if the Committee determines to initiate disciplinary action or other law enforcement action.
