Legalized Games of Chance Control Commission
Public Session Minutes July 8, 2009 The Legalized Games of Chance Control Commission met on July 8, 2009, at the Seaside Heights Municipal Building, located at 901 Boulevard, 1st Floor Council Chamber , Seaside Heights, New Jersey. Present for the meeting were Commissioners Marilou Halvorsen, Chairperson, Timothy E Ryan, and Christine Vanek (present via teleconference). Edward Barrett was not present. Deputy Attorney General Nancy Miller, Investigative Supervisor Scott Jenkins, Acting Investigative Supervisor William Carter, Investigators Martin Silva and Joseph Chessere, and supporting staff Farah Rodriguez and Danyelle Williamson were also present. The meeting was opened at 10:45 a.m. by Commissioner Marilou Halvorsen pursuant to provisions of the Open Public Meetings Act. N.J.S.A. 10:4-6 et seq. Adequate notice of the Legalized Games Public meeting was provided by mailing a list of all regularly scheduled Commission meetings to be held during 2009 to the Office of the Secretary of State, Star Ledger, Trenton Times, the Director of the Division of Consumer Affairs, and posted in the State Building at 124 Halsey Street, Newark, New Jersey, as well as being posted on LGCCC website: www.state.nj.gov/oag/ca/lgccc.htm.

List of organizations approved or denied requests for registration for the months of April, May and June 2009 The Commission approved the submitted list except for PTA St Anthony’s Church and Ancient Order of Hibernians In America, Inc., Ocean Cty Div #1 list for registration applications for April, May and June 2009 Note Commissioner Vanek recused herself on the application of St Anthony’s Church (April 09) Commissioner Ryan recused himself on the application of Ancient Order of Hibernians in America, Inc., Ocean Cty Div #1(May 09) MOTION: Vanek SECOND: Ryan APPROVED: Unanimous 6. Recommended approval for the approved and denied list of Casino Operators; Casino Operators Pending Additional Correspondence; Manufacturers, Distributors, and Providers, Compensated Workers and Games Submissions for the Month of April, May and June 2009 The Commission approved the recommendations of staff regarding of Casino Operators, Manufacturers, Games Submissions, Distributors, and Providers and Compensated Workers for the months of April, May, and June 2009. 8) Make A Wish Foundation is requesting refund on a cancelled raffle. MOTION: Vanek SECOND: Ryan APPROVED: Unanimous 9) Commission Correspondence A) Bruno Chmiel inquired about the legality of betting on bowling games. The Commission asked that information be provied to Mr. Chmiel.
B) Sara Faust commented on bowling task force. C) Laurence W McKeen, Ph.D., commented on bowling task force. The Commission asked staff to advise Dr. McKeen that the propose penalty had been withdrawn. A) Poker Run Proposal (Charles Manning) B) EC-15-09 Westfield Jaycees- asked to use net proceeds raised in prior year for scholarships for 2010 graduating high school class. Advised it was permissible. FYI C) EC-17-09 North Bergen Township- asked for assistance regarding loud and distracting noise in a bingo hall. Advised local authorities could assist; also call member in change to advise of inquiry. D) EC-24-09 Boys & Girls Club Union- issue regarding the lights on the bingo board. An investigator will follow up on the alleged problem. E) EC-25-09 US Department of Justice Bureau of Alcohol, Tobacco Firearms and Explosives- asked if “Pagan Motorcycle Club of New Jersey “ is a registered organization with Legalized Game of Chance Control Commission. Advised organization not registered. FYI F) EC-26-09 Ms. Jodie Richard & Ms. Catherine Dyson-Asked how to get a Legalized Games of Chance registration. Advised of process. FYI G) OPRA request Woolwich Fire Co. Of Swedwesboro Asked for copy of its registration application. Copy of application to be provided. H) St Theresa R.C. Church- Thanking the Commission and staff for assistance with carnival. FYI
I) Memo to David Szuchman, Director, DCA ( Our Lady of Queen of Peace)-Web site of Our Lady Queen of Peace may have been hacked by SQL-Mahound. This matter was referred to the police. FYI D-1 Jack Connors, Assemblyman 7th Legislative District and Thomas Farrell Commander, VFW Post #3020 The Commission discussed the application from VFW #3020 to use a portion of the net proceeds for construction of a new building. After reviewing materials, including detailed information regarding use of the facility, the Commission approved a $40,000.00 expenditure from net proceeds D-4 S2419 Removes licensing requirement for recreational bingo. The Commission to tabled this item until the next meeting. D-5 American Legion Post #109- Use of Proceeds The Commission tabled this and will obtain additional information before the next meeting. D-6 American Legion Post #279- Use of Proceeds The Commission tabled this and will obtain additional information before the next meeting. D-7 VFW Post #5343- Stolen proceeds- Informed Commission that the Post had been burglarized and that proceeds from games of chance had been taken. FYI D-8 Continental State Fair– Asked the Commission whether a different prize structure (insured prize) would be acceptable. Robert Smolinsky will provide more information to Scott Jenkins. FYI E-1 Senate 2807-Provides for warning letter in lieu of monetary penalty for certain first-time raffles law violations- On preliminary review, the Commission does not support the bill as drafted. If it enacted may conflict with alcoholic beverage laws MOTION: Ryan SECOND: Vanek APPROVED: Unanimous The Commission moved to executive session.
