Gregory A. Paw announced that an Essex County
Certified Nurse Assistant has been charged
via a State Grand Jury indictment with allegedly
assaulting an 80-year-old nursing home patient.
According to Insurance Fraud Prosecutor
Greta Gooden Brown, Madeline Petit, 55,
Myrtle Avenue, Irvington, Essex County,
was charged with assault upon an institutionalized
elderly patient (4th degree). If convicted,
Petit faces up to 18 months in state prison
and a criminal fine of up to $10,000. Prior
to the indictment, Petit surrendered her
Nurse Assistant’s license to the New
Jersey Division of Health and Senior Services.
Petit will be ordered to appear in Hudson
County Superior for an arraignment and bail.
The indictment alleges that on Jan. 15,
2004, Petit, while employed at the Hudson
View Care and Rehabilitation Center located
in North Bergen, Hudson County, physically
assaulted an 80-year-old patient.
State Investigator Michael Rasar and Deputy
Attorney General Yvette Gibbons coordinated
the investigation. DAG Gibbons presented
the case to the State Grand Jury.
An indictment is merely an accusation. The
defendant is presumed innocent of the charges
unless and until proven her guilty beyond
a reasonable doubt.
