Una mujer se declara culpable de cometer fraude en seguros por más de $ 8,800 dólares por reclamo ilegal de incapacidad temporal

TRENTON – El Fiscal General Interino John J. Hoffman informó que una mujer del condado de Monmouth, New jersey, se declaró culpable de cometer fraude en seguros por defraudar al Estado por más de $ 8,800 dólares mediante la presentación de una reclamo ilegal al Departamento de Trabajo y Desarrollo Laboral con información fraudulenta para cobrar el seguro por incapacidad temporal del Estado.
Jennifer Massimo Ruiz, de 31 años, de Belmar, se declaró culpable ayer 9 septiembre, por cometer fraude al seguro en tercer grado, al comparecer ante el Juez del Tribunal Superior Robert J. Mega en el Condado de Union. Un jurado Investigador sometió la denuncia el pasado 25 de julio.

El Juez Mega fijó la fecha de la sentencia para el 7 de febrero 2014. Según el acuerdo de culpabilidad, el Estado recomendará que Ruiz sea sentenciada a 3 años de prisión.
Al declararse culpable, Ruiz reconoció que el 19 de abril de 2010,sometió un formulario de reclamo ante el Departamento de Trabajo y Desarrollo Laboral con información fraudulenta. Como resultado del fraude, Ruiz recibió la cantidad de $ 8,819 dólares en beneficios de seguro por invalidez al que no tenía derecho.
La ley de discapacidad temporal de New Jersey requiere que una persona debe estar

empleada en el último año con el fin de ser elegible para obtener beneficios de incapacidad temporal. Una investigación realizada por la Oficina contra los Fraudes en Seguros determinó que Ruiz no había sido estado empleada ni trabajando durante las 52 semanas anteriores a la presentación de su solicitud de beneficios por incapacidad temporal. La investigación reveló que Ruiz sometió declaraciones falsas diciendo que estuvo empleada como gerente de una oficina desde 2008 hasta 2010, por lo que era elegible para los beneficios del seguro por incapacidad temporal cuando pidió licencia por maternidad, a partir de marzo de 2010. La empresa para la que Ruiz presumiblemente ha trabajado era de propiedad de los miembros de su familia.

El Vice Fisca James Carey y los Detectives Mateo Armstrong y Christine Sullivan coordinaron la investigación. El Vice Fiscal Carey representó a la Oficina contra los Fraudes en Seguros en la audiencia de culpabilidad. El Procurador Interino Ronald Chillemi agradeció al Departamento de Trabajo y Desarrollo Laboral para remitir el asunto a la Oficina contra los Fraudes en Seguros.
