Notice of Proposed Readoption without Amendments:
Green Acres Rules N.J.A.C. 7:36

PUBLIC NOTICE
Take notice that the New Jersey Department of Environmental Protection, Green Acres Program is proposing to readopt without amendments the Green Acres Program Rules, N.J.A.C. 7:36.   The rules provide the criteria under which, and procedures by which, Green Acres will award funding to counties, municipalities, and nonprofit organizations for the acquisition and development of land for outdoor recreation and conservation purposes.  The rules also govern the use, operation and maintenance, in perpetuity, of lands acquired or developed with Green Acres funding (known as “funded parkland”) and all other parklands held by a local government unit at the time the local government unit received Green Acres funding (known as “unfunded parkland”).  Finally, the rules contain the application process under which a local government unit or a nonprofit may obtain the approval of the Commissioner and the State House Commission to divert or dispose of Green Acres-encumbered parkland.    

The proposal is scheduled to be published in the New Jersey Register dated February 7, 2011.  A copy of the proposal (PDF) is available from the DEP website and LexisNexis Customer Service at (800)223-1944 or www.lexisnexis.com/bookstore.  Be advised that there may be a fee for obtaining a copy of the proposal from some sources.
