Notice of Rule Proposal
Outer Continental Shelf Air Rules, N.J.A.C. 7:27-32

PUBLIC NOTICE
Take notice that the NJ Department of Environmental Protection is proposing new Air Pollution Control rules at N.J.A.C. 7:27-32. Currently, the US Environmental Protection Agency (USEPA) has the authority to issue and enforce air permits for sources of air pollution on the outer continental shelf (OCS). The proposed rules would incorporate by reference the relevant provision of 40 CFR Part 55, which set forth the air pollution control requirements that are intended to protect ambient air quality standards and ensure compliance with the requirements in the Clean Air Act for the prevention of significant deterioration of air quality on the OCS. The Department proposes to incorporate the Federal rules by reference to fulfil one of four prerequisites necessary for the Department to seek delegation of the EPA’s authority to issue and enforce air permits on the OCS. By seeking delegation of this authority, the Department expects to facilitate the air permitting process for offshore wind farms located on the OCS of New Jersey’s seaward boundary, as applicable.
