SUBJECT: Hudson County Chromate Update #27, June 1998

The following summarizes significant developments, which have occurred between July 1997 and June 1998 regarding the Hudson County Chromate Waste Sites.

AlliedSignal, Inc.

The Phase I Remedial Investigation (RI) for Allied was completed in the fall of 1997. Data gathered in this phase will be used to determine the preliminary extent of contamination at 21 chromium-contaminated sites in Hudson County. Fieldwork for Phase II of the investigation began in April 1998. This second phase is for filling any data gaps that are identified in Phase I of the data review. It is anticipated that the RI report will be submitted to the NJDEP for review in early 1999.

The Ryerson Steel Site (chromium site #117) remedial action, which began on June 16, 1997, was officially completed on December 4, 1997. This is now the location of a Home Depot hardware store. The ground water remedial investigation and remedial action will be performed by Allied on a regional basis under their June 17, 1998 Administrative Consent Order.

The College Towers Apartments Site (chromium site #154) was investigated by Allied in the fall of 1997. Preliminary results indicate that the contamination exists primarily on the eastern side of the property. Allied will continue delineating the extent of chromium in Phase II of the investigation which started in April 1998. It is likely that off-site delineation will be necessary since contamination was identified at the property boundary.

Chemical Land Holdings (previously Maxus Energy Corporation)

Chemical Land Holdings (CLH) completed Phase I of their remedial investigation in the fall of 1997. Phase I data will be used to define the vertical and horizontal extent of contamination and to determine what additional data needs exist.

CLH submitted a Remedial Investigation (RI) Report for seven (7) sites (Sites 42, 45, 53, 110, 148, 169 and 171) in the fall of 1997. This report contained a proposal for deleting these seven sites due to the very low chromium concentrations identified in the soil and ground water. The NJDEP reviewed this document and approved the deleting of chromium sites numbered 42, 45, 53, 110, 148 and 171.

CLH submitted a RI Report and Remedial Action (RA) Workplan for four (4) additional sites in May 1998 (Sites 52, 62, 145 and 170). The work plan currently calls for hot spot removal actions on these sites. These reports are currently under review by NJDEP

PPG Industries, Incorporated

A revised Remedial Action Workplan (RAWP) was submitted for Douglas Holdings (chromium site #147) on February 19, 1998. The RAWP is currently being reviewed by NJDEP.

Investigative work at the majority of these sites is currently on hold pending the possible change in the chromate cleanup standards for soil.

July 2, 1993 AlliedSignal Directive Sites
and Orphan Sites Groups 1 & 2

The preliminary site characterization (PSC) soil investigations have been completed at a total of nineteen (19) sites in the Allied Directive group, they include sites numbered 15, 19, 67, 68, 69, 70, 91, 93, 94, 100, 101, 130, 165, 172, 175, 178, 183, and 185. The analytical data from these investigations is currently undergoing Quality Assurance/Quality Control review. The results and recommendations will be presented in the PSC Remedial Investigation (RI) reports. Monitor wells have been installed at sites 15, 19, 67, 68, 70, 91, 92, 93, 100, 101, 165, 183 and 185. Building inspections have been completed at six sites. PSC ground water sampling has occurred at site 15, 68, 69, 91, 92 and 165. PSC surface water and sediment sampling has been completed at sites 15, 68, 130 and 165. Four sites remain to be investigated under this directive.

The Remedial Investigation Phase 1 has been completed at six of the Orphan Sites Group 1 sites. Investigation has begun at all sites in this group which are in Jersey City. Two sites in Bayonne, Bayonne Sewage Treatment Plant (chromium site #138) and the Conrail Rail Spur (chromium site #162) have complete Phase 1 studies. Phase 1 soil investigations showed that while chromium is present at all the sites, only sites 021 and 086 have chromate waste material at the surface.

Report writing for the Phase 1 Remedial Investigations has not been completed due to delays in receiving laboratory data packages. Phase 2 investigations of these sites are scheduled to commence by fall 1998 and will continue through 1999.

Investigation of the Dennis P. Collins Park (chromium site #172) in Bayonne began in early June 1998.

Orphan Sites Group 2 are still in negotiations with potential responsible parties who may take responsibility for some of the sites in this group.

Droyer's Point a.k.a Society Hill

The Droyer's Point site (site #119) was originally under the Allied Directive. A developer interested in developing the site (Hovnanian) has been proceeding with the investigation and cleanup of the site. A meeting was held on July 16, 1997 with representatives of NJDEP and Hovnanian. During this meeting a plan to fast track the investigation and remediation was presented and related compliance issues were discussed. The Remedial Action Workplan was submitted on June 10, 1998 and is currently being reviewed by NJDEP.

Suggested Soil Cleanup Criteria for Trivalent and Hexavalent Chromium

The guidance for trivalent and hexavalent chromium cleanup criteria is soon to be released by the Department. In addition to generic soil cleanup criteria, this guidance will include site-specific Alternative Remediation Standard (ARS) protocol which can be used Chromite Ore Processing Residue (COPR) sites in Hudson County. The soil cleanup criteria and ARS protocols are being developed in accordance with provisions in the Brownfield and Contaminated Site Remediation Act, N.J.S.A. 58:10B. It is anticipated that the generic criteria and ARS protocols will be released within six months.

Hudson-Bergen Light Rail Transit System

The Office of New Rail Construction (NRC) of the New Jersey Transit Corporation (NJ Transit) has initiated a series of transportation improvements to a 20-mile corridor along the Hudson River Waterfront through Hudson and Bergen counties. Referred to as the Hudson-Bergen Light Rail Transit System (HBLRTS), a series of environmental investigations are being conducted in a phased approach under a Memorandum of Agreement (MOA) executed with NJDEP in 1992. The proposed improvements and new alignments will Impact eight known chromate chemical production waste sites including, sites numbered 19, 67, 100, 107, 183, 185, 199 and 200. The eight sites include sites under the Allied Directive, NJDEP Orphan sites and PPG ACO. Hot spot delineation at sites 19 and 100 has been completed and NJDEP is awaiting a report.

Enforcement Status

On January 8, 1998 the NJDEP issued a directive ordering Allied to conduct remedial investigations at eight chromium contaminated sites in Hudson County. On January 12, 1998, a second directive was issued to all three responsible parties (Allied Signal, PPG and Occidental) ordering remedial investigations at eight additional sites. These two directives collectively will allow the NJDEP to pursue a publicly funded investigation in the event that the responsible parties are unable or unwilling to perform the work. Please see Table 1 (below) for a complete listing of these sites.

General Chromium Site Status

Attached also, please find a copy of the "Chromite Ore Processing Residue Site Status" sheet which details the phase of all known chromium sites, sorted by responsible parties. A copy of the updated Chromate Chemical Production Waste Sites is also attached. Note that this list does not include sites that have been remedied.
