In response to inquiries the Department informally relaxed the requirements related to requests for extensions to the regulatory time frame of March 1, 2011, for submittal of receptor evaluations. The Department allowed, and considered valid and approved, requests that were submitted less than 30 days prior to the regulatory time frame. This practice will end on June 1, 2011. After June 1, 2011 any request for an extension to a regulatory time frame that does not meet the requirements at N.J.A.C. 7:26C-3.2 is not eligible for the automatic approval described at N.J.A.C. 7:26C-3.2(c). The person responsible for conducting remediation who seeks an extension to a regulatory time frame must:
Parties who receive notice that their request is denied because it is not complete may resubmit their request up to 30 days prior to the subject regulatory time frame. Note that the Department may assess penalties for failure to comply with regulatory time frames. |
