[SRRA]: New Notice available for Response Action Outcomes (RAOs) - Historically Applied Pesticides Not Addressed

The Department is aware that the Model Response Action Outcome (RAO) Document promulgated as Appendix D in the Administrative Requirements for the Remediation for Contaminated Sites (ARRCS, N.J.A.C. 7:26C) does not address certain situations that may occur at sites where remediations are concluding. When appropriate, the Department works with remediating parties and LSRPs to ensure that RAOs accurately reflect site-specific conditions and implemented remedial actions. To that extent, the Department has created RAO Notices for use by LSRPs when writing RAOs. Notices for several conditions, as well as a description of the Department's approval process for other RAO modifications, were posted on the Department's website at https://www.nj.gov/dep/srp/ on April 29, 2013.

Farmers, orchardists, homeowners, turf growers, local governments and others have used a wide variety of pesticides over the last 100 years in an effort to control pests and increase crop yield. Many pesticides were used in limited circumstances, others became widely used, and some became the "pesticide of choice" for entire crops or industries. Some of these pesticides are persistent in the environment, and thus may be present in the soil long after they have been applied.

A new Notice has been developed to allow LSRPs to document that historically applied pesticides were not investigated as part of the remediation of a particular site. The Notice should not be used in situations where the manufacture, mixing, or other handling of these chemicals resulted in a discharge to the environment.
