On December 10, 2015, President Obama signed the Every Student Succeeds Act (ESSA), which reauthorizes the Elementary and Secondary Education Act of 1965 (ESEA). The United States Department of Education (USDE) has declared 2016-17 as a transition year. In addition, all waivers granted by USDE will expire August, 2016.
Until further notice the following remains in effect: Title I districts without Priority and Focus Schools will no longer be required to set aside 20% of their Title I allocation to offer SES and/or public school choice transportation to students in their low performing schools. However, districts may opt to continue offering individual tutoring as a potential intervention for students in their schools who are not achieving proficiency. These districts still maintain the flexibility to identity and contract with providers of tutoring services to work with their low-performing students.
