Department of Health Proposes to Readopt N.J.A.C. 8:6, Smoke-Free Air, with Amendments, Repeals, and New Rules

The Comprehensive Tobacco Control Program within the Chronic Disease Office of the Family Health Services Division of the Public Health Services Branch of the Department of Health (Department) is proposing to readopt N.J.A.C. 8:6, Smoke-Free Air, with amendments, repeals, and new rules.  N.J.A.C. 8:6 implements the Smoke-Free Air Act, N.J.S.A. 26:3D-55 et seq.

The proposal appears in the July 7, 2014 issue of the New Jersey Register.  The public has until September 5, 2014 to comment on the proposal.  LexisNexis provides free online access to the New Jersey Register at http://www.lexisnexis.com/njoal.  An unofficial copy of the proposal is also available from the Department's website at http://nj.gov/health/legal/open.shtml.

The Department is proposing substantive amendments to add definitions of the terms "electronic smoking device" and "hookah," to delete the existing definition of "evenly distributed," and to revise the existing definition of "not structurally enclosed" to make the term workable with respect to structures of greater than five sides.
