Passaic County Pharmacist to Pay $35,000 in Restitution to Medicaid Program

TRENTON - Vaughn L. McKoy, Director, Division of Criminal Justice, announced that a Passaic County pharmacist has agreed to pay more than $35,000 in restitution to the Medicaid Program after pleading guilty to participating in a fraudulent billing scheme that resulted in Medicaid paying for prescription drugs that were never provided to patients. The Medicaid Program provides health care services and prescription drugs to persons unable to afford such services and medicines.

According to Insurance Fraud Prosecutor Greta Gooden-Brown, Kenneth Horwitz, 43, Mohawk Lane, Randolph, Morris County, a pharmacist formerly employed at the Medicaid Treatment Center, located at 935 Allwood Road, Clifton, Passaic County, was sentenced by Passaic County Superior Court Judge George F. Rohde, Jr. to three years probation and ordered to repay $35,012 to the Medicaid Program. Horwitz pleaded guilty to a criminal Accusation charging Medicaid Fraud on April 10, 2003. In pleading guilty, Horwitz admitted that between February and August, 2001, he submitted more than 100 fictitious prescription drug claims to the Medicaid Program for payment or reimbursements. The forged claims were submitted under the names of nine legitimate Medicaid recipients who were unaware of the fraudulent claims.

The investigation was conducted by the Division of Criminal Justice - Office of the Insurance Fraud Prosecutor which investigates fraud and abuse in the Medicaid Program. State Investigator Carlos Ortiz and Deputy Attorney General Riza Dagli were assigned to the investigation.
