Proposal Summary:
The New Jersey Division on Civil
Rights proposes to readopt with amendments
its rules pertaining to Advertising Related
to Real Property. The existing rules prohibit
newspapers from publishing any advertisement
regarding the sale or rental of real property
that expresses, directly or indirectly,
any preference or discrimination as to
race, creed, color, national origin, ancestry,
marital status, sex, nationality, disability,
sexual orientation or familial status.
Upon
readoption, the Division proposes amendments
to cover all forms of real estate advertising,
whether or not published in a newspaper,
and to include domestic partnership status
and source of lawful income used for rental
or mortgage payments as protected characteristics
to conform the rules to recent amendments
to the Law Against Discrimination. Additional
amendments are proposed in order for the
Division to achieve certification as a
substantially equivalent agency by the
federal Department of Housing and Urban
Development, which would permit the Division
to enter into a work-sharing agreement
with HUD. The proposed readoption with
amendments appears in the May 16, 2005
edition of the New Jersey Register.
