        -  After investigation of a claim has been completed, the claimant shall 
          be informed of the Board's 
          recommendation in the matter and of his/her right to request a hearing 
          by giving written notice to the Board within 20 days of receipt of the 
          recommendation.  After receipt of the claimant's 
          response to said recommendation or where a claimant fails to respond 
          within 20 days, the Board may render a decision in writing or schedule 
          a hearing pursuant to N.J.S.A. 52:4B-7.
 
        -  The Board may, within its discretion, make a determination whether
