A regular meeting of the Merit System Board was held on
Tuesday, April 18, 2000, in Trenton, New Jersey.

PRESENT: Acting Chairman Lewis A. Scheindlin; Merit System
Board Members, Alan Dexter Bowman, Judith L. Shaw and Leo Vartan;
Andrea Grundfest, Deputy Attorney General; Henry Maurer,
Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Acting Chairman Lewis A.
Scheindlin, opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State
and sent to the Trentonian, Trenton Times, Courier-Post and Star
Ledger on November 8, 1999 and posted at the Department of
Personnel, 3 Station Plaza, Trenton, New Jersey.

WITHDRAWAL OF APPEALS

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE
CASES - SETTLEMENT

ACTION: The Merit System Board acknowledge the settlements
with the exception of Regina Driver-Green and
Serge Mitial, which were held over.

A-2 THELMA COLE (REMAND)

Thelma Cole, Hospital Charge Attendant, Buttonwood Hospital,
Burlington County, resignation not in good standing
effective January 3, 1997, on charges of being absent from
duty for five or more consecutive business days without the
approval of the supervisor and without following leave of
absence procedures.

Recommendation of the Administrative Law Judge - Reverse the
resignation not in good standing.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-3 CARLA CRESCENZO

Carla Crescenzo, Head Nurse (12 Months), Vineland
Developmental Center, Department of Human Services,
suspension for 15 days, on charges of failure to follow the
applicable leave of absence procedure.

Recommendation of the Administrative Law Judge - Uphold the
suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-4 ELAINE JEFFERSON

Elaine Jefferson, Correction Lieutenant, Mountainview Youth
Correctional Facility, Department of Corrections, suspension
for ten days, on charges of personal conduct; falsification:
intentional misstatement of material fact in connection with
work, employment, application, attendance or any record,
report, investigation or other proceeding.

Recommendation of the Administrative Law Judge - Reverse the
suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-5 LEILA LAING

Leila Laing, Communications Operator, Northern State Prison,
Department of Corrections, suspension for 45 days, on
charges of insubordination, disobedience or refusal to
accept an order, assaulting or resisting authority,
disrespect or use of insulting or abusive language to a
supervisor and leaving assigned work area without permission
but not creating a danger to persons or property.

Recommendation of the Administrative Law Judge - Modify the
45 day suspension to a 30 day suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-6 GUY SCHAAR

Guy Schaar, Correction Lieutenant, Mountainview Youth
Correctional Facility, Department of Corrections, suspension
for 15 days, on charges of negligently contributing to an
elopement or escape.

Recommendation of the Administrative Law Judge - Uphold the
suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-7 STACI A. SONDRINI

Staci A. Sondrini, Correction Officer, County of Camden,
resignation not in good standing effective July 27, 1998, on
charges of neglect of duty and reporting for duty.

Recommendation of the Administrative Law Judge - Modify the
resignation not in good standing to a resignation in good
standing.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-8 MARTIN TREU

Martin Treu, Investigator, Consumer Affairs, Burlington
County, suspension for six days, on charges of incompetency,
inefficiency, or failure to perform duties, insubordination
and conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Dismiss the
matter without prejudice.

ACTION: The Merit System Board acknowledged the withdrawal
of the appeal.

A-9 DEANNA WALKER

Deanna Walker, Clerk Typist, Newark School District,
resignation not in good standing effective February 24,
1997, on charges of abandonment of position and chronic or
excessive absenteeism or lateness.

Recommendation of the Administrative Law Judge - Uphold
removal and resignation not in good standing.

ACTION: The Merit System Board modified the recommendation
of the Administrative Law Judge to a resignation
in good standing.

A-10 RUTH A. ANDREWS

Ruth A. Andrews, Teacher's Aide, Newark School District,
removal effective September 8, 1998, on charges of conduct
unbecoming a public employee.

Recommendation of the Administrative Law Judge - Reverse the
removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-11 CAROLYN DAVIS

Carolyn Davis, Cottage Training Technician, North Jersey
Developmental Center, Department of Human Services, removal
effective March 3, 1998, on charges of mistreatment of a
client.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-12 CLARENCE FREEMAN

Clarence Freeman, Juvenile Detention Officer, County of
Burlington, removal effective December 15, 1998, on charges
of conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the

of the Administrative Law Judge.

Clinton Lackey, Human Services Assistant, Ancora Psychiatric
Hospital, Department of Human Services, removal effective
December 2, 1998, on charges of neglect of duty which could
result in danger to persons.

A-14 EDWARD URBAN (REMAND)

Edward Urban, Laborer, Department of Public Works - City of
Linden (City), removal effective December 18, 1999, on
charges of inability to perform duties, chronic or excessive
absenteeism or lateness, conduct unbecoming a public
employee and neglect of duty.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-15 CAROLYN WAITERS

Carolyn Waiters, Examination Technician, Department of
Transportation, removal effective November 7, 1997, on
charges of falsification and conduct unbecoming a public
employee.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-16 CRAIG WASHINGTON

Craig Washington, Safety Specialist 2, Department of
Transportation, removal effective September 18, 1997, on
charges of conduct unbecoming a public employee and other
sufficient cause defined as falsification.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-17 ALBERT ORABONA

Albert Orabona, Senior Correction Officer, Mid-State
Correctional Facility, Department of Corrections, indefinite
suspension pending removal effective July 9, 1998 and
removal effective November 30, 1998, on charges of
conviction of a crime, simple assault, and conduct
unbecoming a public employee. The Merit System Board at its
meeting of April 4, 2000, directed that this matter be held
over for further review.

Recommendation of the Administrative Law Judge - Uphold the
suspension and removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-18 KEVIN HANLEY - SETTLEMENT

Initial removal effective March 6, 1997, on charges of being
dismissed before completing the basic Police Officer
training course given by the New Jersey State Police at Sea
Girt due to a failure to successfully complete required
aspects of physical training. Settled to appellant's name
being restored to the list of eligibles for the title of
Police Officer, the list revived to facilitate appellant's
appointment, and when the City hires a class for police
training, the appellant will be provided with employment.
The Merit System Board at its meeting of February 8, 2000,
directed that this matter be held over.

Recommendation of the Administrative Law Judge - Acknowledge
the settlement

ACTION: The Merit System Board acknowledged the
settlement.

A-19 CHRISTINE CARTER

Christine Carter, County Correction Officer, Essex County,
Department of Public Safety, removal effective February 10,
1998, on charges of incompetency to perform duties,
inability to perform duties, unfit for duty and failure to
complete the State mandated training requirements.

Recommendation of the Administrative Law Judge - Uphold the
removal.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-20 RAYMOND FRANKLIN II AND JOSEPH CANNING III

Raymond Franklin II and Joseph Canning III, County
Correction Officers, Police Academy, removal effective May
19, 1998, on charges of failure to successfully complete the
handgun qualification course.

Recommendation of the Administrative Law Judge - Uphold the
removals.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

SECTION B - MISCELLANEOUS MATTERS

B-1 RYAN DIMONE

Ryan Dimone appeals his rejection as a County Correction
Officer by the County of Hudson and its request to remove
his name from the eligible list for County Correction
Officer on the basis of psychological unfitness to perform
effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-2 ERNEST DIORIO

Ernest Diorio appeals his rejection as a Sheriff's Officer
by the County of Monmouth and its request to remove his name
from the eligible list for Sheriff's Officer on the basis of
psychological unfitness to perform effectively the duties of
the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-3 BRIAN GILFEDDER

Brian Gilfedder, represented by James M. Mets, Esq., appeals
his rejection as a Police Officer candidate by the Town of
Harrison and its request to remove his name from the subject
eligible list on the basis of psychological unfitness to
perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal
be granted.

B-4 TERRENCE HEROD

Terrence Herod appeals his rejection as a County Correction
Officer by the County of Monmouth and its request to remove
his name from the eligible list for County Correction
Officer on the basis of psychological unfitness to perform
effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-5 RANIERO MARCIANTE

Raniero Marciante appeals his rejection as a Correction
Officer Recruit by the Department of Corrections and its
request to remove his name from the eligible list for
Correction Officer Recruit on the basis of psychological
unfitness to perform effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-6 MICHAEL J. MIHALIK

Michael J. Mihalik appeals his rejection as a Police Officer
by the City of Clifton and its request to remove his name
from the eligible list for Police Officer on the basis of
psychological unfitness to perform effectively the duties of
the position.

ACTION: The Merit System Board directed that this appeal
be denied.

B-7 LORENZO PETTWAY

Lorenzo Pettway, represented by Edward C. Bertucio, Jr.,
Esq., appeals his rejection as a County Correction Officer
candidate by the County of Monmouth and its request to
remove his name from the eligible list for County Correction
Officer on the basis of psychological unfitness to perform
effectively the duties of the position.

ACTION: The Merit System Board directed that this appeal
be granted.

B-8 VARFEE A. SIRYON, JR.

Varfee A. Siryon, Jr., represented by Thomas M. Murphy,
Esq., appeals the request by the City of Newark to remove
his name from the Police Officer (S9999V) eligible list for
medical unfitness to effectively perform the duties of the
position.

ACTION: The Merit System Board directed that this appeal
be held over.

B-9 FRANK FARRELL

Frank Farrell, an Assistant Deputy Public Defender 2 with
the Office of the Public Defender, represented by Gaye
Palmer, CWA, Local 1033, appeals the denial of sick leave
injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal
be denied.

B-10 RICHARD FISHER

Richard Fisher, a Correction Sergeant Juvenile Justice with
the Juvenile Justice Commission, Department of Law and
Public Safety, appeals the denial of sick leave injury (SLI)
benefits. This matter was held over from the April 4, 2000
Board meeting for further review.

ACTION: The Merit System Board directed that this appeal
be granted.

B-11 ODELLE JEFFERSON

Odelle Jefferson, a Family Service Specialist 3 with the
Division of Youth and Family Services, Department of Human
Services, appeals the denial of sick leave injury (SLI)
benefits.

ACTION: The Merit System Board directed that this appeal
be granted in part.

B-12 WILLIAM W. JOHNSON

William W. Johnson, a Senior Correction Officer at South
Woods State Prison, Department of Corrections, represented
by Richard Tonetta, Esq., appeals the denial of sick leave
injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal
be granted.

B-13 ELIZABETH RICHARDSON

Elizabeth Richardson, a Principal Clerk Transcriber with the
Department of Corrections, represented by Vikki U. Marshall-
Thurston, Staff Representative, CWA Local 1037, appeals the
denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal
be granted.

B-14 BHARTI SHAH

Bharti Shah, a Senior Clerk Transcriber at Woodbridge
Developmental Center, Department of Human Services, appeals
the denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal
be denied.

B-15 JESS M. YERGER

Jess M. Yerger, a Senior Correction Officer at Mountainview
Youth Correctional Facility, Department of Corrections,
appeals the denial of sick leave injury (SLI) benefits.

ACTION: The Merit System Board directed that this appeal
be granted.

B-16 PIETER DEHAAN, JR.

Pieter DeHaan, Jr., represented by Daniel J. Zirrith, Esq.,
appeals the decision of Human Resource Information Services
which found that the appointing authority had presented a
sufficient basis to remove appellant's name from the Police
Officer (M3394X), City of Newark eligible list due to an
unsatisfactory driving record and his failure to satisfy the
City's residency requirement.

ACTION: The Merit System Board directed that this matter
be held over.

B-17 RONALD HARTUNG

Ronald Hartung appeals the decision of Human Resource
Information Systems which upheld Passaic County's request
for the removal of appellant's name from the Assistant
Supervisor Building Service (C0150O) eligible list due to an
unsatisfactory employment history.

ACTION: The Merit System Board directed that this appeal
be denied.

B-18 REGNAR MADARANG

Regnar Madarang appeals the determination of Human Resource
Information Services which found that the appointing
authority had presented a sufficient basis to remove his
name from the eligible list for Field Investigator, Nursing
Care Institutionalized Elderly (S6041O), Department of
Health and Senior Services, for failure to satisfy the
experience requirement.

ACTION: The Merit System Board directed that this appeal
be denied.

B-19 ZONING OFFICER (M6096O) AND (M628O), BOROUGH OF MANASQUAN

The appointing authority requests permission not to make an
appointment from the certification for Zoning Officer
(M6096O) and (M6286O), Borough of Manasquan.

ACTION: The Merit System Board granted the request but
assessed costs.

B-20 WILLIAM HAMP

William Hamp, Assistant Chief, Bureau of Parole, Department
of Corrections, represented by Mariann E. Schick, Esq.,
requests counsel fees as a result of the Merit System Board
decision rendered on February 10, 1998, which found that the
decision of the appointing authority in issuing appellant an
official reprimand was not justified and reversed that
action.

ACTION: The Merit System Board granted the request in part
and ordered the appointing authority to pay
counsel fees.

B-21 ORLANDO L. CHANDLER

Orlando L. Chandler, a Director of Finance with the Housing
Authority of the City of Camden, represented by Christopher
J. Keale, Esq., petitions the Merit System Board for a stay
of his removal, effective November 1, 1999, pending the
outcome of his hearing at the Office of Administrative Law.
This matter was held over from the April 4, 2000 Board
meeting for further review.

ACTION: The Merit System Board directed that this matter
be held over.

B-22 JAMES CAMPBELL

The Jersey City Housing Authority, represented by Edward T.
O'Connor, Jr., Esq., petitions the Merit System Board for
reconsideration of the final administrative decision,
rendered January 11, 2000, granting James Campbell interim
relief.

ACTION: The Merit System Board granted the request for
reconsideration but on reconsideration, affirmed
its prior decision.

B-23 DEBORAH JONES

Deborah Jones, a practical Nurse at the North Jersey
Developmental Center, Department of Human Services,
represented by Robert C. Little, IV, AFSCME, Administrative
Council 1, petitions the Merit System Board for
reconsideration of its final decision dismissing the appeal
without prejudice based on her failure to pursue.

ACTION: The Merit System Board granted the request for
reconsideration and ordered that the case be
transmitted to Office of Administrative Law for a
hearing.

B-24 TERRY FISHER

The appeal of Terry Fisher, an Income Maintenance Worker
with the Passaic County Board of Social Services, of his
indefinite suspension beginning December 5, 1991 and removal
effective March 21, 1995 on charges, was heard by
Administrative Law Judge Margaret M. Hayden (ALJ), who
rendered her initial decision on January 28, 2000,
dismissing the appeal. At its meeting on March 21, 2000,
the Merit System Board (Board) did not adopt the ALJ's
recommendation that the appellant's appeal be dismissed
since he had forfeited his employment based on his criminal
convictions. However, upon further review of the record,
upon its own motion, this matter is now before the Board for
reconsideration.

ACTION: The Merit System Board granted the request for
reconsideration and dismissed the appeal.

B-25 CLAUDETTE GERAUD-ZACCARDI

Claudette Geraud-Zaccardi, a Public Information Assistant
with the City of Union City, represented by Sanford Browde,
Esq., requests a hearing regarding her resignation not in
good standing effective October 29, 1998.

ACTION: The Merit System Board denied the request.

B-26 SHARDAWN MCRAE

Shardawn McRae, an Institutional Attendant with Long Term
Care Services, Morris View Nursing Home, County of Morris,
represented by Arnold S. Cohen, Esq., requests a hearing
concerning her five-day suspension on charges.

ACTION: The Merit System Board denied the request.

B-27 BONNIE KROHN

Bonnie Krohn, an Omnibus Operator with the Ocean County
Department of Transportation and Vehicle Services, appeals
her resignation in good standing effective May 19, 1999.

ACTION: The Merit System Board granted a hearing.

B-28 JOHN MACIAG

John Maciag, a former Senior Correction Officer with the
Department of Corrections, appeals his resignation in good
standing.

ACTION: The Merit System Board directed that this appeal
be denied.

B-29 KEVIN NOAH

The Borough of Pompton Lakes, represented by Joseph J.
Ragno, jr., Esq., and Kevin Noah, represented by John J.
Segreto, Esq., seek acknowledgement of a settlement
agreement between the parties which resolves the outstanding
issues regarding disputes arising from the bypass of Mr.
Noah's name on the Police Sergeant (PM4768P), Pompton Lakes
eligible list and appoints Mr. Noah to the position of
Police Sergeant with Pompton Lakes.

ACTION: The Merit System Board acknowledged the
settlement.

B-30 JENNIFER JONES

The appeal of Jennifer Jones, County Correction Officer,
Burlington County Jail, of her removal effective June 26,
1998 on charges, was heard by Administrative Law Judge John
R. Futey (ALJ), who rendered his initial decision on
December 3, 1999, upholding the removal. At its meeting on
February 1, 2000, the Merit System Board (Board) did not
adopt the ALJ's recommendation to uphold the removal.
Rather, the Board determined that the appellant's removal be
reversed. Based on further review of the record, the Board
granted reconsideration of its February 1, 2000 decision and
determined that the appellant's removal was appropriate. At
its March 21, 2000 meeting, the Board adopted the ALJ's
recommendation to uphold the removal. This matter was held
over at its April 4, 2000 meeting, to allow the Board to
reconsider this matter since not all Board members were
present at the April 4, 2000 meeting.

ACTION: The Merit System Board directed that this matter
be held over.

B-31 MARY A. ACORD

Mary A. Acord appeals the determination of the Division of
Selection Services which found that she did not meet the
experience requirement for the promotional examination for
Supervisor of Records (PC0958A), Atlantic County.

ACTION: The Merit System Board directed that this appeal
be granted.

B-32 LAURENCE J. BERMAN, ET AL.

Laurence J. Berman, Maria C. Fernandez, Joseph L. Huff, and
Eugene G. Tumminia appeal the determinations of the Division
of Selection Services which found that they did not meet the
experience requirements for the promotional examination for
the title of Social Worker (PC0634A), Union County Board of
Social Services.

ACTION: The Merit System Board directed that these appeals
be denied.

B-33 EARL DEAN, ET AL.

Earl Dean, Arnold Stanke and John Richardson appeal the
determinations of the Division of Selection Services which
found that they did not meet the certification or experience
requirements for the Fire Instructor (C2202A), Morris County
open competitive examination.

ACTION: The Merit System Board directed that these appeals
be denied.

B-34 CLARISSA M. ESPOSITO

Clarissa M. Esposito appeals the determination of the
Division of Selection Services, which found that she did not
meet the experience requirement for the promotional
examination for Principal Clerk Typist (PS8472E), New Jersey
Veterans Memorial Home at Vineland.

ACTION: The Merit System Board directed that this appeal
be granted.

B-35 CONSTANCE B. FRALER

Constance B. Fraler appeals the determination of the
Division of Human Resource Management which found that she
was ineligible for the promotional examinations for

The appeal of Rachel Daniels, a Senior Correction Officer at
New Jersey State Prison, Department of Corrections, of her
10-day suspension on charges, was heard by Administrative
Law Judge Anthony T. Bruno (ALJ), who rendered his initial
decision on February 25, 2000, reversing the suspension. At
its meeting on April 4, 2000, the Board affirmed the ALJ's
recommendation. The proposed final decision is now
submitted for the Board's review.

ACTION: The Merit System Board directed that this matter
be held over.

B-87 ISAAC DEBOTTON

Isaac DeBotton, represented by Craig S. Gumpel, Esq.,
petitions the Merit System Board for reconsideration of its
decision on which his appeal of scoring for the examination
