           A regular meeting of the Civil Service Commission was held on Wednesday, January 19, 2022, at 10:00 a.m., in Trenton, New Jersey.

 

            PRESENT: Deirdré L. Webster Cobb, Chairperson, Members Dolores Gorczyca, Daniel W. O’Mullan and Diomedes Tsitouras; Pamela Ullman, Deputy Attorney General; Allison Chris Myers, Director, Division of Appeals and Regulatory Affairs. All individuals listed participated via teleconference.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 22, 2021, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    DERRICK GULLY - CSC DOCKET NO. 2021-358

 

Derrick Gully, Senior Maintenance Repairer, City of Newark, Department of Water and Sewer, resignation not in good standing, effective June 29, 2020, on charges of inability to perform duties, chronic or excessive absenteeism or lateness, neglect of duty and other sufficient cause.  

Recommendation of the Administrative Law Judge Uphold the resignation not in good standing.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    ANDREW JUTTNER – CSC DOCKET NO. 2021-541

 

Andrew Juttner, Battalion Fire Chief, City of Plainfield, Fire Department, 20 working day suspension, on charges of incompetency, inefficiency or failure to perform duties, neglect of duty and other sufficient cause.  

 

Recommendation of the Administrative Law Judge Uphold the 20 working day suspension.

 

ACTION:    The Civil Service Commission modified the recommendation of the Administrative Law Judge to a 10 working day suspension.

 

A-6    GAMAL MOHIELDIN – CSC DOCKET NO. 2019-1903

 

Gamal Mohieldin, Laborer 1, Burlington City, Department of Public Works, removal effective August 28, 2018, on charges of conduct unbecoming a public employee, discrimination and other sufficient cause.  

 

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-7    GERALD MURPHY – CSC DOCKET NO. 2021-1948

 

Gerald Murphy, County Correctional Police Officer, Camden County Correctional Facility, removal effective January 14, 2021, on charges of incompetency, inefficiency or failure to perform duties, conduct unbecoming a public employee, neglect of duty and other sufficient cause.    

 

Recommendation of the Administrative Law Judge Uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

B-1    T.D.C. – CSC DOCKET NO. 2021-1663

 

T.D.C., represented by Theresa Richardson, Esq., appeals his rejection as a Fire Fighter candidate by Paterson and its request to remove his name from the eligible list for Fire Fighter (M1863W) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

ACTION:     The Civil Service Commission directed that these appeals be granted.

Frederick Bush appeals the determination of the Division of Agency Services, which found that he did not meet the experience requirement for the promotional examination for Maintenance Supervisor Grounds (PM4348C), Mount Laurel.

The appellant seeks an Engineer-In-Charge of Maintenance 2 job classification in this proceeding.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-42   A.K. – CSC DOCKET NO. 2019-2557

 

A.K., a Judge of Compensation, Department of Labor and Workforce Development (DOL), appeals the determination of the Assistant Commissioner, DOL, stating that the appellant violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be dismissed.

 

B-43   CHRISTOPHER FERRO – CSC DOCKET NO. 2022-1300

 

The Bergen County Sheriff’s Office, represented by Brian M. Hak, Esq., requests a stay of the Civil Service Commission’s decision in In the Matter of Christopher Ferro (CSC, decided October 27, 2021) pending its appeal to the Appellate Division.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-44   BRIAN DAY – CSC DOCKET NO. 2022-908

 

Brian Day petitions the Civil Service Commission for reconsideration of the decision rendered on April 28, 2021, which denied his appeal regarding his ineligibility for the open-competitive examination for Assistant Institutional Fire Chief (S0455B), Statewide.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-45   K.J.S. – CSC DOCKET NO. 2021-1816

 

K.J.S., represented by Michael J. Prigoff, Esq., requests reconsideration of the decision rendered on April 21, 2021, by the Civil Service Commission which found him to be psychologically unfit for a position as a Fire Fighter, Jersey City.

 

ACTION:     The Civil Service Commission directed that this request be denied.

 

B-46   SEAN MCMANUS – CSC DOCKET NO. 2022-1342

 

          The Superior Court of New Jersey, Appellate Division, has remanded the matter of Sean McManus’ grievance concerning the rate of cash overtime compensation.

 

ACTION:     The Civil Service Commission reaffirmed its previous decision.

 

B-47   OVERTIME PROGRAM, DEPARTMENT OF LABOR AND WORKFORCE DEVELOPMENT – CSC DOCKET NO. 2022-1510

 

The Department of Labor and Workforce Development requests that the provisions of N.J.A.C. 4A:3-5.3 continue to be relaxed to provide certain individuals in non-limited, non-exempt titles cash compensation at one and one-half times the regular rate for hours worked between 35 and 40 hours.

 

ACTION:     The Civil Service Commission directed that this request be granted in part.

 

B-48   G.F. - CSC DOCKET NO. 2022-478

 

G.F., a Senior Correctional Police Officer with the Department of Corrections appeals the determinations of the Director of the Equal Employment Division, stating that the appellant failed to present sufficient evidence to support findings that she had been subjected to violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-49 FRANK KUMANKUMA-SARPONG - CSC DOCKET NO. 2022-1475

 

Frank Kumankuma-Sarpong requests to file a late application for the promotional examination for Family Service Supervisor (PC4847C), Essex County.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-50   DANIEL NEVINS – CSC DOCKET NO. 2022-870

 

Daniel Nevins appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the open competitive examination for Mechanic (C0027C), Sussex County.

 

ACTION:      The Civil Service Commission directed that this appeal be granted.

 

B-51   JUSTIN POLLOCK – CSC DOCKET NO. 2022-871

 

Justin Pollock appeals the determination of the Division of Agency Services that he did not meet the experience requirements for the promotional examination for Mechanic (PM3221C), Monroe Township.

 

ACTION:      The Civil Service Commission directed that this appeal be granted

 

B-52   CHRISTIAN LACICERO - CSC DOCKET NO. 2022-756

 

Lavallette, represented by Eric M. Bernstein, Esq., requests a retroactive appointment date for Christian LaCicero, a Police Sergeant with Lavallette to May 5, 2014, based on administrative error. Lavallette also requests that Christian LaCicero be admitted to the promotional examination for Police Chief (PM4304C), Lavallette.
