Notice of this meeting was filed with the Secretary of State

Margaret Ford, Social Work Supervisor, County of Gloucester,
Board of Social Services, demotion to the title of Social
Worker effective October 16, 2000, on charges of incompetency,
inefficiency, failure to perform duties and inability to perform
duties.
Recommendation of the Administrative Law Judge - Uphold
the demotion to Social Worker.
ACTION: The Merit System Board affirmed the recommendation
of the
Administrative Law Judge.
A-3 JOYCE LABRUZZA
Joyce LaBruzza, Physical Therapy Assistant, Woodbridge Developmental
Center, Department of Human Services, appeals the denial of
sick leave injury benefits.
Recommendation of the Administrative Law Judge - Uphold
the denial of sick leave injury benefits.
ACTION: The Merit System Board affirmed the recommendation
of the

A-4 HARRY TOMLIN AND EDWARD F. PAUL, III
Harry Tomlin and Edward F. Paul, III, Emergency Medical
Technicians, City of Gloucester, Fire Department, appeal the
good faith of their layoffs effective July 23, 1999 for reasons
of economy and efficiency.
Recommendation of the Administrative Law Judge - Uphold
the layoffs.
ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.
A-5 TERESA SPALDING
Teresa Spalding, County Correction Officer, County of Burlington,
County Jail, ten-day suspension and removal effective December
22, 2000, on charges of chronic or excessive absenteeism or
lateness, and violation of Burlington County Jail's attendance
policy.
Recommendation of the Administrative Law Judge - Reverse
the suspension and removal.
ACTION: The Merit System Board remanded the matter
to the Office of
Administrative Law.
A-6 JACQUETTA SPINKS
Jacquetta Spinks, County Correction Officer, County of Union,
Department of Public Safety, removal effective May 24, 2000,
on the charge of conduct unbecoming a public employee.
Recommendation of the Administrative Law Judge - Uphold
the removal.
ACTION: The Merit System Board directed that this
matter be held over.
A-7 CARLA YOUNG
Carla Young, Senior Clerk Typist, County of Gloucester,
Prosecutor's Office, was initially removed effective July
2, 1997, based on the criminal charge on possession of a controlled
dangerous substance with the intent to distribute. While the
case was pending at the Office of Administrative Law, the
criminal charge was dismissed. Pursuant to an Interlocutory
Order, the Administrative Law Judge allowed the appointing
authority to amend the charges to conduct unbecoming a public
employee, inability to perform duties, and other sufficient
cause.
Recommendation of the Administrative Law Judge - Uphold
the removal.
ACTION: The Merit System Board directed that this
matter be held over.
A-8 HALL WHITE
Hall White, Senior Correction Officer, New Jersey State
Prison, Department of Corrections, ten-day suspension, 30-
day suspension and two removals effective January 24, 1997
and March 14, 1997, on charges of, inter alia, insubordination,
conduct unbecoming a public employee and violation of various
Department rules regarding personal conduct, intentional disobedience,
disrespect or use of insulting or abusive language to a supervisor.
Recommendation of the Administrative Law Judge - Uphold
the suspensions and removals.
ACTION: The Merit System Board affirmed the recommendation
of the
Administrative Law Judge.
A-9 TODD SILVERMAN
Todd Silverman, Senior Correction Officer, East Jersey State
Prison, Department of Corrections, appeals the denial of sick
leave injury benefits. It is noted that at the time of the
incident the appellant was employed by the New Jersey Training
School for Boys, Juvenile Justice Commission. This matter
was held over from the Merit System Board meeting of April
24, 2002.
Recommendation of the Administrative Law Judge - Dismiss
the appeal as moot.
ACTION: The Merit System Board affirmed the recommendation
of the
Administrative Law Judge.
A-10 CURTIS GERMANY
Curtis Germany, Security Guard, State-Operated School District
of Newark, removal effective December 1, 1998, on charges
of conduct unbecoming a public employee and other sufficient
cause.
Recommendation of the Administrative Law Judge - Uphold
the removal.
ACTION: The Merit System Board affirmed the recommendation
of the
Administrative Law Judge.
A-11 GLADYS EZE (CONSOLIDATION) - SETTLEMENT
Gladys Eze, Hospital Attendant, County of Essex, Hospital
Center, six-month suspension, on charges of insubordination,
conduct unbecoming a public employee, neglect of duty, and
chronic or excessive absenteeism. It is also noted that Eze
alleged discrimination and reprisal and filed a complaint
with the Division on Civil Rights, which was consolidated
with this matter.
Recommendation of the Administrative Law Judge - Adopt the
Order of Consolidation and acknowledge the settlement.
ACTION: The Merit System Board adopted the Order of
Consolidation and
acknowledged the settlement.
A-12 HENRY R. CIOFFI - SETTLEMENT
Henry R. Cioffi, City of Long Branch, eligible list bypass
dispute. Settled to appointment to the next available regular
appointment as a Fire Fighter. This matter was held over from
the Merit System Board meeting of March 27, 2002.
Recommendation of the Administrative Law Judge - Acknowledge
the settlement.
ACTION: The Merit System Board acknowledged the settlement.
A-13 DOLORES PHILLIPS (CONSOLIDATION)
Dolores Phillips, Senior Parole Officer, Division of Parole
and Community Programs, Department of Corrections, ten-day
suspension, and removal effective May 18, 1998, on the charge
of neglect of duty, a 20-day suspension on the charge of insubordination,
and a resignation not in good standing effective May 18, 1998,
on the charge of absent from duty for five or more consecutive
days without approval. Ms. Phillips also appeals the denial
of an extended medical leave of absence. This matter was held
over from the Merit System Board meeting of March 27, 2002.
Recommendation of the Administrative Law Judge - Dismissal
of the charges and reinstatement of the appellant with back
pay and benefits.
ACTION: The Merit System Board affirmed the recommendation
of the
Administrative Law Judge.

B-1 HECTOR I. SALVA, JR.
Hector I. Salva, Jr. appeals his rejection as a Correction
Officer Recruit candidate by the Department of Corrections
and its request to remove his name from the eligible list
for Correction Officer Recruit on the basis of psychological
unfitness to effectively perform the duties of the position.
ACTION: The Merit System Board directed that this
appeal be denied.
B-2 SYREETA SPIVEY
Syreeta Spivey appeals the removal of her name from the
(S9999A), County of Mercer eligible list for the title of
County Correction Officer on the basis of psychological unfitness.

Ron C. Storey appeals his rejection as a Correction Officer
Recruit candidate by the Department of Corrections and its

of an unsatisfactory background report.

Anthony Goodell appeals the decision of Selection Services
which found that the appointing authority had presented a
sufficient basis to remove his name from the eligible list
for Ranger Trainee (S9999A), Department of Environmental Protection,
on the basis of an unsatisfactory background report.
ACTION: The Merit System Board directed that this
appeal be granted, and
the appellant's name be restored to the Ranger Trainee (S9999A),
eligible list and reflected on the October 13, 2000 certification
as
interested but not reachable for appointment.
B-19 CUTHBERT E. HARRIS
Cuthbert E. Harris appeals the Department of Corrections'
removal of his name from the Correction Officer Recruit (S9999A),
Department of Corrections, eligible list due to an unsatisfactory
criminal record.

Elyana T. Harvey Dudley appeals the decision of Human Resource
Information Services which upheld the removal of her name
from the County Correction Officer (S9999A), Atlantic County,
eligible list due to the falsification of her employment application.

Steven P. Lohmeyer appeals his removal from the Correction

The Township of Lawrence appeals the decision of Human Resource
Information Services that it had not presented a sufficient
basis to remove Joseph Nuzzo's name from the eligible list
for Housing Inspector (M0611O), on the basis of an unsatisfactory
employment record which related adversely to the position
sought.
ACTION: The Merit System Board directed that this
appeal be granted
in part.
B-27 ANTHONY PATOUNAS
Anthony Patounas, a Correction Sergeant with the Department
of Corrections (DOC), represented by Donald Dudich, Vice-
President, New Jersey Law Enforcement Supervisor Association,
appeals the decision of Selection Services which upheld the
removal of his name from the list for Correction Lieutenant
(PS6320I) based on his unsatisfactory employment record.
ACTION: The Merit System Board directed that this
appeal be granted.

Ray Rose appeals the Department of Corrections' removal
of his name from the Correction Officer Recruit (S9999A),
Department of Corrections, eligible list, on the basis of
his failure to complete pre-employment processing.

Vonjo R. Tommy appeals the decision of Human Resource Information
Services which upheld the removal of the appellant's name
from the Community Service Officer 2 (S0669C), Department
of Community Affairs eligible list, due to the appellant's
failure to appear for an interview.

appeal be granted.

Ronald Williams appeals the decision of the Township of
Winslow, to remove him from the special reemployment list
for the title of Laborer.
ACTION: The Merit System Board directed that this

Mitchell D. Worlds appeals the decision of Human Resource
Information Services which upheld the removal of his name
from the County Correction Officer (S9999A), Camden County,
eligible list due to the falsification of his employment application.
ACTION: The Merit System Board directed that this
appeal be granted.
B-32 VINCENT P. STRIGNILE
Vincent P. Strignile, a Senior Sanitary Inspector with the
City of Paterson, represented by Irwin H. Tessler, Esq., petitions
the Merit System Board for interim relief of his immediate
suspension, effective September 13, 2001.
ACTION: The Merit System Board denied the request
for interim relief
regarding his immediate suspension, denied the request for
counsel
fees, and directed that the request for back pay be granted
in part
from December 13, 2001 to January 15, 2002.
B-33 DENNIS BENSTER
Dennis Benster, an Investigator 1 with the Department of
Banking and Insurance, represented by Walter R. Bliss, Jr.,
Esq., appeals the determination of the Commissioner of Banking
and Insurance, stating that the appellant failed to present
sufficient evidence to support a finding that he had been
subjected to violations of the New Jersey State Policy Prohibiting
Discrimination, Harassment, or Hostile Environments in the
Workplace. The appellant also appeals the Commissioner's determination
that sufficient evidence was found that the appellant engaged
in unprofessional and inappropriate conduct in the workplace
and violated the State Policy.
ACTION: The Merit System Board directed that these
appeals be denied.
B-34 FRANK CAVALLARO AND TRENT LYONS
Frank Cavallaro, a Lieutenant with the Division of State
Police, Department of Law and Public Safety, represented by
Frank A. Bitoni, Jr., Esq., appeals the determination of the
Attorney General, stating that sufficient evidence was found
that Cavallaro engaged in conduct in violation of the departmental
policy against discrimination and the New Jersey State Policy
Prohibiting Discrimination, Harassment or Hostile Environments
in the Workplace with respect to the discrimination complaint
filed by Trent Lyons, a Sergeant First Class with the Division
of State Police, Department of Law and Public Safety. Additionally,
Lyons appeals the determination of the Attorney General stating
that the investigation of Lyons' discrimination complaint
substantiated only certain allegations against Cavallaro and
Peter Hallock, a former Lieutenant with the Division of State
Police, Department of Law and Public Safety.
ACTION: The Merit System Board directed that these
appeals be denied.
B-35 HEDWIG CIERNIAK
Hedwig Cierniak, a former Personnel Assistant 1 with the
Department of Law and Public Safety, represented by Rosemarie
Cipparulo, Esq., appeals the determinations of her grievances
by the appointing authority. The appellant also appeals the
determination of the Attorney General, stating that she had
failed to present sufficient evidence to support a finding
that she had been subjected to violations of the New Jersey
State Policy Prohibiting Discrimination, Harassment or Hostile
Environments in the Workplace.
ACTION: The Merit System Board directed that these
appeals be denied.
B-36 NICHOLAS M. KAUFMAN
Nicholas M. Kaufman, formerly a Grounds Worker at Hagedorn
Gero-Psychiatric Hospital, Department of Human Services (DHS),
appeals the determination of the Assistant Commissioner for
Human Resources, DHS, which found that the appellant failed
to present sufficient evidence to support a finding that he
had been subject to conduct in violation of the New Jersey
State Policy Prohibiting Discrimination, Harassment or Hostile
Environments in the Workplace.
ACTION: The Merit System Board directed that this
appeal be denied.
B-37 TARA KING
Tara King, a former Assistant Supervisor of Educational
Programs with the Juvenile Justice Commission, Department
of Law and Public Safety, appeals the determination of the
Attorney General, stating that the appellant failed to present
sufficient evidence to support a finding that she had been
subjected to violations of the New Jersey State Policy Prohibiting
Discrimination, Harassment or Hostile Environments in the
Workplace.
ACTION: The Merit System Board directed that this
appeal be denied.
B-38 JUAN MUNOZ
Juan Munoz, a Sergeant, appeals the determination of the
Attorney General, for the Equal Employment Opportunity and
Affirmative Action Unit, of the Department of Law and Public
Safety, stating that the appellant failed to present sufficient
evidence to support a finding that he had been subjected to
a violation of the New Jersey State Policy Prohibiting Discrimination,
Harassment or Hostile Environments in the Workplace.
ACTION: The Merit System Board directed that this
appeal be denied.
B-39 TRUCK DRIVER (C9122A), COUNTY OF MERCER
The County of Mercer, represented by Alfred B. Vuocolo,
Jr., County Counsel, requests reconsideration of that part
of the decision rendered on March 13, 2001 by the Merit System
Board ordering the appointing authority to pay selection processing
costs in the amount of $2,048.
ACTION: The Merit System Board granted the request
for reconsideration
and directed that the assessment of selection costs be rescinded.
B-40 JAN RONK
Jan Ronk, a Behavior Modification Program Technician at
Woodbridge Developmental Center, Department of Human Services,
represented by Sarah Evans, Staff Representative, CWA Local
1040, petitions the Merit System Board for reconsideration
of the final administrative decision rendered on January 30,
2001, which denied her request for sick leave injury (SLI)
benefits.
ACTION: The Merit System Board denied the request
for reconsideration.
B-41 CARLYS ALEXANDER
Carlys Alexander, a Support Services Representative 3 with
the Department of Transportation, requests that the Merit
System Board reinstate the appeal of his release at the end
of the working test period, which was dismissed based on Alexander's
failure to appear at the scheduled settlement conference.
ACTION: The Merit System Board directed that this
appeal be denied.
B-42 ANNA WHITE
Anna White, a Human Services Assistant with the Vineland
Developmental Center, Department of Human Services, requests
that the Merit System Board reinstate the appeal of her release
at the end of working test period, which was dismissed based
on White's failure to appear at a scheduled settlement conference.
ACTION: The Merit System Board directed that this
appeal be denied.
B-43 KENDRA BROWN
Kendra Brown, Judiciary Clerk 2, appeals the determination
of her PAR grievance by the Judiciary.
ACTION: The Merit System Board directed that this
appeal be denied.
B-44 LISA JACKSON-DIKKOH
The Township of Irvington, represented by Paula A. Garrick,
Esq., requests that implementation of the determination of
the Division of Human Resource Management to terminate Lisa
Jackson-Dikkoh from her provisional appointment of Assistant
Purchasing Agent be stayed pending the outcome of its request
to the Merit System Board to relax the rule governing provisional
appointments to allow her to continue to serve provisionally
in this title.
ACTION: The Merit System Board directed that this
request be granted.
B-45 CARLOS IRIMIA, ET AL.
Carlos Irimia, Frank Kennedy, Joseph Lameiro, and Joseph
Riccelli, of the West New York Police Department, request
retroactive seniority, for record purposes only, due to the
changes in Merit System rules which govern layoffs.
ACTION: The Merit System Board directed that the
appeal of Mr. Irimia be
granted, Michael Indri be granted similar relief, and the
appeals of
Messrs, Kennedy, Lameiro and Riccelli be denied.
B-46 WILLIAM DONNERSTAG
William Donnerstag, a part-time Senior Emergency Medical
Technician with the City of Passaic Police Department, represented
by Gregory A. Busch, Esq., petitions the Merit System Board
for back pay and benefits following the dismissal of a disciplinary
charge at this departmental hearing. Appellant also requests
counsel fees for his representation in this matter.
ACTION: The Merit System Board granted the appellant
$2,084.28 in back
pay plus PERS contributions from September 30, 1997 through
May 11, 2000 and granted the appellant $7,233.72. in counsel
fees.
B-47 JOHN K. KAVAKICH
John K. Kavakich, represented by Merick H. Limsky, Esq.,
requests appropriate salary step placement consistent with
a retroactive permanent appointment date of August 25, 1998
to the title of Police Officer, City of Clifton.
ACTION: The Merit System Board granted the request.

the case of Melani v. County of Passaic, 345 N.J. Super. 579
