A regular meeting of the Civil Service Commission was held on Wednesday, February 6, 2019, at 10:00 a.m., in Trenton, New Jersey.

In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 20, 2018, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT
ACTION: The Civil Service Commission acknowledged the settlements.
A-2 RANDY BUTLER
Randy Butler, Human Services Assistant, Woodbine Developmental Center, Department of Human Services, removals effective December 29, 30, and 31, 2017, respectively, on charges of chronic or excessive absenteeism, conduct unbecoming a public employee and other sufficient cause.
Recommendation of the Administrative Law Judge – Grant summary decision and uphold the removals.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-3 JUAREZ HILL (remand)
Juarez Hill, Code Enforcement Officer, City of Newark, Department of Neighborhood and Recreational Services, removal effective January 2, 2015 on charges of conduct unbecoming a public employee, misuse of public property and other sufficient cause.
Recommendation of the Administrative Law Judge – Uphold the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
A-4 GRAYLAND MEEKS
Grayland Meeks, Firefighter, City of Newark, Newark Fire Department, removal effective September 20, 2017 on charges of incompetency, inefficiency or failure to perform duties, neglect of duty and other sufficient cause.
Recommendation of the Administrative Law Judge – Uphold the removal.
ACTION: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
SECTION B – MISCELLANEOUS MATTERS
B-1 FIRE PREVENTION SPECIALIST – CSC DOCKET NO. 2019-1953
The Division of Agency Services recommends the reallocation of the Fire Prevention Specialist title to the noncompetitive division of the career service.
ACTION: The Civil Service Commission directed that this matter be held over.
B-2 S.P. – CSC DOCKET NO. 2018-1302
S.P., represented by Stuart J. Alterman, Esq., requests withdrawal of his appeal of his removal from the eligible list for Correction Officer Recruit (S9999U) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be withdrawn with prejudice and the appellant be assessed the cost of $500 for the Medical Review Panel’s review of his case.
B-3 YANZAN ABAZA AND NICHOLAS SALIBA – CSC DOCKET NOS. 2019-1009 AND 2019-966
Yanzan Abaza and Nicholas Saliba appeal their removals from the eligible list for County Correction Officer (S9999U), Passaic County Sheriff’s Office on the basis that they possessed unsatisfactory driving records.
ACTION: The Civil Service Commission directed that these appeals be granted.
B-4 ANTHONY AUTIERI – CSC DOCKET NO. 2019-968
Anthony Autieri, represented by Daniel J. Zirrith, Esq., appeals the removal of his name from the eligible list for County Correction Officer (S9999U), Passaic County Sheriff on the basis that he falsified his preemployment application.
ACTION: The Civil Service Commission directed that this matter be held over.
B-5 DOUGLAS CAROSELLA – CSC DOCKET NO. 2018-2607
Douglas Carosella appeals the removal of his name from the Correctional Police Officer (S9988V), Department of Corrections, eligible list on the basis of a positive drug test.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-6 COREY HENRY, SR. – CSC DOCKET NO. 2019-661
Corey Henry, Sr. appeals his removal from the eligible list for Police Officer (S9999U), Plainfield on the basis that he did not meet the age requirements.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-7 ROBERT MERRILL, III – CSC DOCKET NO. 2019-1288
Robert Merrill, III, appeals his removal from the eligible list for Sheriff’s Officer (S9999U), Union County Sheriff’s Office for failing to complete pre-employment processing.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-8 AMIR MOHAMED – CSC DOCKET NO. 2019-1071
Amir Mohamed appeals his removal from the eligible list for Police Officer (S9999U), Jersey City on the basis of an unsatisfactory background report.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-9 SOCIAL WORK SUPERVISOR (PC2725V), BERGEN COUNTY BOARD OF SOCIAL SERVICES – CSC DOCKET NO. 2019-1218
The Bergen County Board of Social Services requests permission not to make an appointment from the September 10, 2018 certification for Social Work Supervisor (PC2725V).
ACTION: The Civil Service Commission granted the appointment waiver and deferred selection costs.
B-10 INGRID FAIR – CSC DOCKET NO. 2019-1680
Ingrid Fair appeals the determination of the Division of Agency Services which found that she did not meet the minimum requirements in experience for the promotional examination for Assistant Buyer (PS7678TN), Motor Vehicle Commission.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-11 KAYLA HANLEY – CSC DOCKET NO. 2019-1747
Kayla Hanley appeals the determination of the Division of Agency Services which found that she did not meet the minimum requirements in experience for the open-competitive examination for Assistant Mental Health Administrator (C0772W), Hudson County.
ACTION: The Civil Service Commission directed that this appeal be granted.

Lynnette Hunt appeals the determination of the Division of Agency Services that she did not meet the experience requirement for the promotional examination for Supervising Community Program Specialist (PS3797K), Department of Human Services.

B-18 GABRIEL MAIORANO – CSC DOCKET NO. 2019-1653
Gabriel Maiorano appeals the test administration of the physical performance portion of the examination for Fire Fighter (M1556T), Newark, and requests a make-up examination.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-19 JUAN COSME – CSC DOCKET NO. 2019-1471
Juan Cosme, represented by Michael L. Prigoff, Esq., requests that he be permitted to submit an application for the promotional examination for Police Sergeant (PM2504W), Newark after the application filing deadline.
ACTION: The Civil Service Commission directed that this request be denied.
B-20 THOMAS DEL MAURO, ET AL. – CSC DOCKET NOS. 2019-1244, ET AL.
Thomas Del Mauro, Marilyn Gonzalez, Pablo Gonzalez and Vilma Plaza (PM2540W), Newark; and Jorge Garcia (PM2544W), Paterson; request that they be permitted to submit applications for the promotional examination for Police Sergeant (various jurisdictions) after the application filing deadline.
ACTION: The Civil Service Commission directed that these requests be denied.
B-21 LISA TALERICO-PERILLO AND KATHLEEN SEGURA – CSC DOCKET NOS. 2019-1318 AND 2019-1321
The New Jersey Office of the Attorney General (OAG) requests retroactive permanent appointment dates for Lisa Talerico-Perillo and Kathleen Segura, to the title of Legal Secretary 1, effective September 4, 2017.
ACTION: The Civil Service Commission directed that this request be granted.
B-22 FRANCIS MONTONE – CSC DOCKET NO. 2019-716
Francis Montone, a provisional Police Lieutenant with Monroe Township, represented by Michael T. Sweeney, Esq., appeals his reassignment.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-23 MICHAEL NORTON – CSC DOCKET NO. 2019-1406
Michael Norton petitions the Civil Service Commission for reconsideration of the decision rendered on October 17, 2018, which denied his appeal regarding his ineligibility for the promotional examination for Building Services Coordinator 1 (PS3958K), Department of Children and Families.
ACTION: The Civil Service Commission directed that this petition be granted.
B-24 SUSAN GLUCHANICZ – CSC DOCKET NO. 2019-1597
Susan Gluchanicz requests reconsideration of the decision rendered on July 18, 2018, which determined that her position is properly classified as Budget Analyst 2.
ACTION: The Civil Service Commission directed that this request be dismissed as untimely.
B-25 L.P. – CSC DOCKET NO. 2018-2774
L.P., an Institutional Transportation Supervisor with the Woodbine Developmental Center, appeals the determination of the Assistant Commissioner, Legal Affairs, Department of Human Services, which found that the appellant violated the New Jersey Policy Prohibiting Discrimination in the Workplace.
ACTION: The Civil Service Commission directed that this matter be held over.
B-26 MATTHEW CALIO – CSC DOCKET NO. 2019-1598
The Superior Court of New Jersey, Appellate Division, has remanded the Civil Service Commission’s decision upholding the 30 calendar day suspension of Matthew Calio, a County Correction Officer with Camden County, for reconsideration of the penalty.
ACTION: The Civil Service Commission upheld the 30 calendar day suspension.

B-28 TECHNICIAN, MVC – CSC DOCKET NO. 2019-1950
The Division of Agency Services recommends the reallocation of the title of Technician, MVC to the noncompetitive division of the career service on an interim basis.
ACTION: The Civil Service Commission directed that this request be granted.
B-29 LUIS DELACRUZ – CSC DOCKET NO. 2019-967
Luis Delacruz appeals his removal from the eligible list for Police Officer (S9999U), Plainfield on the basis that he falsified his application.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-30 SAMUEL FELIX – CSC DOCKET NO. 2019-445
Samuel Felix appeals the removal of his name from the Fire Fighter (M1545T), Kearny, eligible list based on his failure to complete pre-employment processing.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-31 IN THE MATTER OF PROGRAM SPECIALIST 1 (S0082V), DEPARTMENT OF HEALTH - CSC DOCKET NO. 2019-1786
The Department of Health requests permission not to make an appointment from the May 14, 2018 certification for Program Specialist 1 (S0082V).
ACTION: The Civil Service Commission granted the appointment waiver and deferred selection costs.

Thomas Ayars appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Librarian 2 (PC2454W), Cumberland County.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-33 JUAN DELGADO – CSC DOCKET NO. 2019-1420
Juan Delgado appeals the determination of the Division of Agency Services which found that he was below the minimum requirements in experience for the promotional examination for Director of Inspections (PM1025W), Willingboro.
ACTION: The Civil Service Commission directed that this appeal be denied.
B-34 PATRICIA FRICKE AND NIEISHA LAW – CSC DOCKET NOS. 2019-1605 AND 2019-1743
Patricia Fricke and Nieisha Law appeal the decisions of the Division of Agency Services that they did not meet the experience requirements, per the substitution clause for education, for the promotional examination for Supervisor Housing Assistance Program (PS6974DN), Department of Community Affairs.
ACTION: The Civil Service Commission directed that these appeals be denied.
B-35 CARISSA HAAS-GREEN – CSC DOCKET NO. 2019-1593
Carissa Haas-Green appeals the decision of the Division of Agency Services which found that her position with Millville is properly classified as Senior Account Clerk. The appellant seeks an Administrative Clerk job classification.
ACTION: The Civil Service Commission directed that the appeal be denied and the classification of the position encumbered by Carissa Haas-Green be re-reviewed.

Thesy Inga appeals the determination of the Division of Agency Services which found that she did not meet the minimum requirements in experience for the open-competitive examination for Computer Operator (M0478W), Paterson.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-37 LANDON MCCROHAN – CSC DOCKET NO. 2019-1577
Landon McCrohan appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Senior Postal Clerk (PS7315TN), Motor Vehicle Commission.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-38 KAUSAR AHMAD, ET AL. – CSC DOCKET NOS. 2019-994, ET AL.
Montclair State University requests that Kausar Ahmad, Kenneth Bledsoe, Edwin Camacho, Giuseppa Coppola, S.E. Daughtridge, Lydia Isaac and Janki Panchu be provided with retroactive dates of provisional and permanent appointment to the title of Assistant Housekeeping Supervisor 1.
ACTION: The Civil Service Commission directed that these requests be granted in part.
B-39 JORGE CABRAL – CSC DOCKET NO. 2018-3229
Jorge Cabral requests reconsideration of the final administrative determination in In the Matter of Richard Gizzi, et al., Police Sergeant (CSC, decided April 18, 2018).
ACTION: The Civil Service Commission directed that this request be denied.
B-40 TYHERA JOHNSON-RILEY – CSC DOCKET NO. 2019-1517
Tyhera Johnson-Riley, a former Public Safety Telecommunicator with the City of Trenton, Police Department requests that the Civil Service Commission reinstate the appeal of her removal on charges effective April 10, 2018, which was dismissed based on her failure to participate in a status conference.
ACTION: The Civil Service Commission directed that this request be denied.
B-41 MATTHEW MCMONAGLE – CSC DOCKET NO. 2019-1185
Matthew McMonagle petitions the Civil Service Commission for reconsideration of the decision rendered on October 17, 2018, regarding the removal of his name from the Fire Fighter (M1537T), Harrison eligible list due to his failure to appear for the physical performance test.
ACTION: The Civil Service Commission directed that this petition be denied.
B-42 WILLIAM SHORTER – CSC DOCKET NO. 2019-81
The Department of Corrections, represented by Jessica M. Saxon, Deputy Attorney General, petitions the Civil Service Commission (Commission) for reconsideration and a stay of the administrative decision, rendered on June 6, 2018, in which the Commission modified William Shorter’s removal to a 120 calendar day suspension and granted back pay, benefits and seniority.
ACTION: The Civil Service Commission directed that this petition be denied. It further ordered that the Department of Corrections immediately reinstate William Shorter to his position.
B-43 R.K. – CSC DOCKET NO. 2018-2556
R.K., represented by Mark Wetter, Esq., appeals his rejection as a Correctional Police Officer candidate by the Department of Corrections and its request to remove his name from the eligible list for Correctional Police Officer (S9988V) on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-44 CHRISTOPHER TIMM – CSC DOCKET NO. 2019-1298
Christopher Timm appeals the determination of the Division of Agency Services that he did not meet the requirements for the promotional examination for Maintenance Supervisor Grounds (PC0719W), Middlesex County.
ACTION: The Civil Service Commission directed that this appeal be granted.
B-45 B.F. – CSC DOCKET NO. 2019-1765
The Motor Vehicle Commission, on behalf of B.F., requests the relaxation of the provisions of N.J.A.C. 4A:1.22 to permit her to participate in the donated leave program without having completed at least on year of continuous State service and to permit J.D. to donate more than 30 sick days to B.F.
ACTION: The Civil Service Commission directed that this request be granted.
