In accordance with L.1975, c.231, Margaret E. L. Howard opened the meeting
with the following statement:
Notice of this meeting was filed with the Secretary of State and sent
to the Trentonian, Trenton Times, Courier-Post and Star Ledger on March
7, 2002, and posted at the Department of Personnel, 3 Station Plaza, Trenton,
New Jersey.

Recommendation of the Administrative Law Judge - Uphold the six-day
suspension and demotion.
ACTION: The Merit System Board affirmed the recommendation of
the Administrative Law Judge.
A-4 EDWARD C. GARVIN
Edward C. Garvin, Truck Driver, Borough of Wildwood Crest, Department
of Public Works, 60-day suspension on charges of, inter alia, misconduct,
misuse of public property, conduct unbecoming a public employee, and violation
of employee rules and regulations. It is noted that the appointing authority
in addition to suspension ordered random drug/alcohol testing for a period
of 12 months.
Recommendation of the Administrative Law Judge - Uphold the 60-day suspension
and random drug/alcohol testing for a period of 12 months.
ACTION: The Merit System Board originally affirmed the recommendation
of the Administrative Law Judge. However, after executive session a motion
was made to reopen the matter.

Upon reconsideration, the Board modified the recommendation of the Administrative
Law Judge to a 60-working-day suspension by unanimous vote.
A motion was made and seconded that the open session be recessed and
that, pursuant to Section 12(b) of the Open Public Meetings Act, the Merit
System Board entered into Executive Session for the purpose of legal advice
on the matters of A-4 Edward C. Garvin and A-5 Randy Geis. The Board subsequently
reconvened the public meeting.

Randy Geis, Fire Fighter, City of Bayonne, Fire Protection Department,
release at the end of the working test period effective August 16, 2000.
Recommendation of the Administrative Law Judge - Uphold the release
at the end of the working test period.
ACTION: The Merit System Board reversed the release at the end
of the working test period.

Virginia Marrero, Police Officer, City of Newark, Police Department,
ten-day suspension on charges of conduct unbecoming a public employee,
and violation of Police Department rules regarding conduct in public and
private.
Recommendation of the Administrative Law Judge - Reverse the ten-day

ACTION: The Merit System Board directed that this matter be held
over.
A-7 FRANK PEREZ
Frank Perez, Police Officer, City of Newark, Police Department, appeals
the following disciplinary actions:
1) Five-day suspension on the charge of conduct unbecoming a public employee.
2) Ten-day suspension on the charge of violation of Police Department
rules regarding conduct in public and private.
3) Removal effective August 29, 1997, on charges of, inter alia, neglect
of duty and official inefficiency or incompetency, absence without leave,
insubordination, and malingering. 4)

indefinite suspension, on charges of actions involving criminal matters
and conduct unbecoming a public employee.
Recommendation of the Administrative Law Judge - Reverse the indefinite
suspension.
ACTION: The Merit System Board remanded the matter to the Office
of Administrative Law.

Willie Goodman, Senior Correction Officer, Central Reception and Assignment
Facility, Department of Corrections, removal effective June 20, 2001,
on charges of conduct unbecoming a public employee and use, possession
or sale of any controlled dangerous substance.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board affirmed the recommendation of
the Administrative Law Judge.
A-11 DANNY KELLY
Danny Kelly, Head Cook 3, Mid-State Correctional Facility, Department
of Corrections, removal effective December 28, 2000, on charges of discrimination
that effects equal employment opportunity, conduct unbecoming a public
employee, and verbal abuse of an employee, inappropriate physical contact
or mistreatment of an employee, and threatening, intimidating, harassing,
coercing, or interfering with a fellow employee on state property.
Recommendation of the Administrative Law Judge - Reverse the removal.
ACTION: The Merit System Board directed that this matter be held
over.
A-12 GREGORY MCDANIEL
Gregory McDaniel, Human Services Specialist 2, Mercer County Board of
Social Services, removal effective March 15, 2000, on the charge of violation
of the County Board of Social Services tardiness and absenteeism policy.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board modified the recommendation of
the Administrative Law Judge to a three-month suspension.
A-13 GILBERT MCGILL, JR.
Gilbert McGill, Jr., Senior Therapy Program Assistant, New Jersey Veteran's
Memorial Home, Paramus, Department of Military and Veteran's Affairs,
removal effective October 9, 2001, on charges of inability to perform
duties and other sufficient cause.
Recommendation of the Administrative Law Judge - Uphold the charges.
However, it is noted that the ALJ failed to make a recommendation as to
the penalty.
ACTION: The Merit System Board upheld the removal.

George Roskilly, Institutional Trade Instructor, Edna Mahan Correctional
Facility for Women, Department of Corrections, removal effective December
21, 2000, on the charge of violation of rule, regulation, policy, procedure,
order or administrative decision.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board modified the recommendation to
a three-month suspension.

Ronnie Seligman appeals the decision of the Office of the Public Defender

Nyasha Sheffield appeals the decision of the City of Trenton (City)
to remove her name from the eligible list for Police Officer (S9999B),
City of Trenton on the basis of an unsatisfactory criminal record and
the decision of Mercer County (County) to remove her name from the eligible
list for County Correction Officer (S9999B), Mercer County on the basis
of an unsatisfactory criminal record.
ACTION: The Merit System Board directed that this appeal granted
in part.
B-12 MICHAEL STOECKER
Michael Stoecker, a Fire Fighter with the North Regional Fire and Rescue
Service, represented by Bruce Leder, Esq., petitions the Merit System
Board for interim relief in relation to his immediate suspension, effective
July 15, 2002.
ACTION: The Merit System Board awarded back pay for the period
from July 21, 2002 to July 25, 2002.
B-13 RICHARD MICHAL
Richard Michal, a Correction Lieutenant with the Garden State Reception
& Youth Correctional Facility, Department of Corrections (DOC), appeals
the determination of the Director, Equal Employment Division (EED), with
the DOC that two individuals only received counseling after he had been
subjected to a violation of the New Jersey State Policy Prohibiting Discrimination,
Harassment or Hostile Environments in the Workplace.
ACTION: The Merit System Board dismissed the appeal, since no
further action is required.
B-14 STEVE VOLKSEN
Steven Volksen, a Social Worker 2 with the Department of Corrections
(DOC), appeals the determination of the Director, Equal Employment Division
(EED), with the DOC, stating that the appellant failed to present sufficient
evidence to support a finding that he had been subjected to a violation
of the New Jersey State Policy Prohibiting Discrimination, Harassment
or Hostile Environments in the Workplace.
ACTION: The Merit System Board directed that this appeal be denied.
B-15 JAMES BANTIN
James Bantin, represented by Gregory A. Busch, Esq., appeals his non-appointment
from the Fire Fighter (M2085A), City of Rahway eligible list.
ACTION: The Merit System Board directed that this appeal be denied.
B-16 KENNETH LITTLE
Kenneth Little, a Senior Correction Officer at East Jersey State Prison,
Department of Corrections, formerly represented by Kirk D. Rhodes, requests
counsel fees in accordance with the Merit System Board decision rendered
on February 8, 2000, which acknowledged the appointing authority's withdrawal
of all charges underlying his 15-day suspension and three removals.
ACTION: The Merit System Board awarded counsel fees in the amount
of $7,323.75.
B-17 MICHAEL MARTIC
Michael Martic and the Borough of Fairview petition the Merit System
Board for acknowledgement of the settlement agreement reached by the parties,
which provides for Martic's appointment as a Police Officer.
ACTION: The Merit System Board acknowledged the settlement as
clarified.
B-18 THOMAS WALLACE
The appeal of Thomas Wallace, a Police Officer with Little Egg Harbor
Township, of his removal effective August 2, 1999 on charges, was heard
by Administrative Law Judge Joseph F. Martone (ALJ), who rendered his
initial decision on August 15, 2002 reversing the removal. At its meeting
on October 23, 2002, the Merit System Board (Board) adopted the ALJ's
recommendation. The proposed final decision is now submitted for the Board's
review.
ACTION: The Merit System Board adopted the final decision.

ACTION: The Merit System Board directed that these appeals be

Judy Moore and Cheryl Morgan appeal the determination of the Division
of Selection Services which found that they were ineligible for the promotional
examination for Human Services Specialist 1 (PC1536B), Mercer County Board
of Social Services.
ACTION: The Merit System Board directed that these appeals be
denied.

Thomas Dunfee appeals the determination of the Division of Selection
Services which denied him admittance to the promotional examination for

B-49 NANCY NELSON, SENIOR PERSONNEL ASSISTANT, TOWNSHIP OF BRICK
The Acting Director, Division of Human Resource Management, petitions
the Merit System Board to relax the provisions of N.J.A.C. 4A:4-2.6(c)
to allow out-of-title technical experience in personnel work to be used
to qualify Nancy Nelson for a promotional examination for Senior Personnel
Assistant, Township of Brick.
ACTION: The Merit System Board granted the request.

Edgar Tuma appeals the determination of the Division of Selection Services
which found that he was outside of the unit scope for the promotional
examination for Employment Supervisor 2 (PS3484N), Department of Labor.
ACTION: The Merit System Board directed that this appeal be denied.

Eleanor Markowitz appeals the determination of the Division of Selection
Services, which found that she was below the minimum requirements in education
for the open competitive examination for Program Nutritionist (C6493C),
Ocean County
ACTION: The Merit System Board directed that this appeal be granted.
B-52 KETLINE CHARLOT
The appeal of Ketline Charlot, a Human Services Assistant with Woodbridge
Developmental Center, Department of Human Services, of her removal effective
November 19, 2001 on charges, was heard by Administrative Law Judge Richard
F. Wells, (ALJ), who rendered his initial decision on July 26, 2002 upholding
her removal. At its meeting on October 23, 2002, the Merit System Board
modified the removal to a resignation in good standing. The proposed final
decision is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.
